I received a call to my cell phone on 12/11/2013 @ 3:19pm PST from 855-222-3082 from a company called Allen Goldstein and Asso. They said that I was about to have felony charges against me for writing bad checks. They said there were 2 lawsuits files against me one from Cash Central and one from Cash Net. They said that they sent me information regarding the issue and that they had sent it to my current address. The amounts from both lawsuits were both over $1000. They told me that the law was on the company's side. I told them that I would like to have some proof since this was the very first I was hearing of this. They also said that they showed a payment of $200 some years ago from me. They told me to look thru my records and they would call me back. They also said that this was normal for the original company to go after large amounts and that their company did not want to work with the original company anymore.
On 12/12/2013 at 2:25pm PST I received another call.  I was transferred to someone new and she asked if I was able to look up my records. I informed her that I was now banking with a new back and that I would need more than 24 hours to research anything on my end. She again said we already sent you a letter. I told her I had not received anything regarding the issue. She was very rude and said that I was fully aware and she was just going to put this down as a refusal to pay and press charges. I said, "I am not refusing to pay I just want to know what I am paying for and have proof that I do indeed owe this payment." She said she was doing the refusal to pay and hung up on me.
Many years ago, maybe 5..., I did do a payday loan with Cash Central but I have no knowledge of any outstanding debt. The repayment for the payday loan was automatically deducted from my account. I also have not been contacted at all regarding this matter by anyone. I continued to bank with the same institution for a couple of years after my payday loan before switching to a new bank. At no time did they try to debit my account for any outstanding debt if there was one.
I looked this company up online and there was a long list of people going thru the same situation with many fraudulent charges. I find it very odd that this company will not give me proof and that I am just now being contacted.
By all means, If I owe a debt, I want to pay it but I would at least like to be given proof that I owe the debt.
After read other posts on this website, I immediately filed a complaint with the Consumer Financial Protection Bureau. Is there anything else I should do? I now live in a different state from the one I had a payday loan in several years ago.

I received a call from a miss Hood calling for Allen Goldstein & Assoc.  Stating that I would be arrested for check fraud on a payday loan I did not pay back in 2008.  I was so scared I had my mom pay the money 10/28 and I paid more money two weeks later 11/15.  Today I received another call from Miss Hood stating she was trying to draft my account for even more and it came back insufficient funds.  Freaking out yet again, telling her that this is not what we discussed and why is she trying to continue to debit my account.  She puts me on hold and comes back to the line and advises me that the sheriffs department has given her authority to hold my case and work with me till Friday in which I agreed.  Once I got off the phone with her it just didn't seem right.  so, I called back and started asking questions I should have been asking from the beginning like the company in which I owe and how much.  suddenly her computers were down.!  Because I keep records of everything going back to 3 years ago on a payday loan in which I paid to a miss Eliss in 2010 had the same case number then as the one miss hood is giving me in 2013.  Called the court house they adv me to check online. I Did, found this site and a few others and realized I had been a victim of fraud and this had not been the first time.  I just didn't realize then because the person was  so nice and I had the money to pay.  Now Miss hood wont come to the phone every time I call back.  How can we get them and put an end to this?  Class action suit or what Email unaky1012@yahoo.com

Don't worry about these people but they are very relentless in the efforts to collect, I had one call my mother once
with they were on the way to my job to arrest me so she paid it, once I told her it was a unpaid payday loan she
contacted her bank who got the money back for her. So they will call relatives if they think they can get paid from them
but don't lose any sleep over it because think about it since when do they give you advance notice of serving papers on
you at work. They figure you don't want to be embarrassed at work so they use that, they are not going to serve any papers
on you at work or anywhere else its a scare tatic, I had one tell me that for almost a year and no papers ever came. Relax.

You said you did commit check fraud.  Not sure if they are telling you this and that is why you said this or if in fact you know that you did this.  If they told you that based on the fact that there was no money in your account when they tried to collect on the payday loan, but if this is the case, then it's not check fraud.  The other thing here is that if this payday loan goes back to 2007, then more than likely it is what is called time barred.  Meaning it's past the statute of limitation for them to come after you.  I live in Florida and no type of payday loan or any other type of personal loan without collateral can be collected back that far.  If I were you I would try to stop any type of transactions they are trying to do on you credit card.  Notify the bank for the credit card and tell them that these people were threatening with arrest and you didn't know that they couldn't do that.  Hopefully you won't have to tell them every thing as I feel sure you probably don't want to do that, but I would try to get back any of the money you may have lost at this point.

By the way they also told me I committed check fraud but I already knew enough about this type of stuff to know that was a scam.  I really don't believe these are legitimate debt collectors since a legit collector should know that making a threat of arrest is not legal.  Furthermore you don't call the Sheriff's office to get them to issue a warrant.  I do believe that has to come through the District Attorney's office and they would probably laugh at these people over trying to turn a payday loan around to be check fraud.  The other thing once a warrant is issued it will then be giving to the Sheriff's Department to make the arrest.  This doesn't just happen over night, it takes time for all of these things to take place.  The only type of warrants that can be issued in a moments notice would be a warrant signed by a Judge or a warrant issued through Corrections for a Parole violator.  I use to work for Probation and Parole and I can promise you we did not call these people and tell them we were issuing a warrant.  Most people that know about a warrant for there arrest will usually go into hiding or lay low as long as they can.  So it makes no sense to me that these people are telling people they are calling the sheriff's office to have them arrested, but I do understand how people that don't know all of this would be afraid.

Also research in the state you live in what the statute of limitation is for Check Fraud, if in fact you believe after reading what I wrote that you did commit this.  The other thing is if you got the loan while living in one state and then moved to another state the laws will apply where you are living now.  I hope this helps you and I really hope you were able to stop the credit card transaction before they got any of your money.

Good Luck and I'll check back in a day or two to see if you have replied back.

Yes, file a police report also and cancel your CC, they will give you a new one.  Debt is a civil matter, a phone call, nor fax or email are legal proof either, it has to be sent via the us mail. A real legal server will not call either..

Please do file reports with the FBI, your state attorney general and Department Of Justice,FTC & FCC..

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

I received a call from these idiots today 10/29/13.  So they are relentless in there efforts to continue to try to scam people out of there money.  First and foremost in my research, I found that you can not be brought up on criminal charges for failure to pay off a pay day loan, as long as you did not commit fraud in obtaining the loan.  Second they can not issue the warrant.  This would I believe be up to the DA in the county you reside in to decide if he wanted to issue a warrant and again a warrant can not be issues for failure to pay the loan.  That is a civil matter and all they can do is sue you for the debt.  I don't owe any pay day loans as I have paid off all of the ones I ever got and I won't ever deal with these types of loans again.  I even told these jerks that if in fact I did owe any, that the statute of limitations had expired on them and therefore they don't have any grounds to come after me.  The last time I had any dealings with pay day loans was in October of 2007 and to my knowledge in the State of Florida they are considered time barred at this time.

I may be wrong about some of this info, but I did do extensive research on this and I do believe I'm correct.  As for any one who these people are harassing, please don't just give in to them due to fear.  Do your research and demand that they send you via US Mail a copy of any thing that they are claiming that you owe.  Don't give any banking info to them as they could end up wiping you account out and don't agree to any thing in there favor.

Again remember that not paying off credit cards or pay day loans is not a criminal issue, so don't let them scare you with that.  And most of the time if they threaten you with criminal charges they are scammers.  Most credit collectors know that it is illegal to threaten someone, as that can cause them to loose out on what you owe them as well as cause them to end up getting sued and owing you due to the penalties for doing this.

Remember DON'T GIVE THEM ANY INFO, even if they claim to know all kinds of info about you.

Well, it appears there really is a Allen Goldstein and Associates..  However, they may not be aware that someone is spoofing their names & business, which btw is not unusual. Have read several threads where the real Attorney has no clue to what is happening until called.  The phone numbers do not appear to match when googled.. Appears to be a tax attorney.

You did the right thing, this appears to be a extortion scam! Legal servers don't call you and of course the FDCPA laws are pretty clear in regards!  And if you bounced a check, the bank and the store would have contacted you long before now, not to mention all those bounced check fee's.   And every time I see one of these regarding a check, I also think since they always claim they only have a "copy" or they don't have it and can't give you any info so you can't check with the bank since your bank would know whats up, that if they have a check or even a copy of, then forgery is a possibility as well.  And should I also mention that the real deal wouldn't alert you first?

Please do file reports with the FBI, your state attorney general and Department Of Justice,FTC & FCC..
