I got a call fro Gerald Stone, private investigator today about a payday loan from 2007. I just sent him $700. He said his company was Sovereign Reconciles and the attorneys he dealt with are Harrison and Harris out of VA.I probably just paid some jerk who doesn't even pay my bills. Which, it was so long ago, I couldn't remember if I had paid it or not. I asked him for a receipt, the name of his company, the names of the companies I loaned from, and the name of the law office he represented. It all seemed legit to my until now!

Here's the thing. If you have ever put your cell # on anything, from a paycheck to a credit app or even an innocent contest, and even if you're broke or you're a millionaire, you can get these calls because some scum have no other way to make an honest living. Our legislators need to get off their tails and stop this with very punitive legislation

Dear Mr. Helenbrook, owner of Franklin, Delaware, Stevens (an unlicensed, unregistered payday loan sweat shop),  you might want to be careful what you post, you never know who is watching you....thanks for letting us know who's portfolio's you are purchasing...very helpful tip.   You cannot sue or arrest anyone in any state - so stop the false threats. Violating a consumer's personal information? really?  you should watch your own back.  Maybe you should stop and smell the roses - get it?  like flowers? in a flower shop......yeah, we know.

He tries to intimidate and threaten you to send money....but then never says who he is representing.  Then their is the tired courier message I get too.

I filed for bankrupcty and called him and gave him my case number and attorney information.  What does he do?........he calls me and then throw insults like "my kids must be very proud of me"  I told him to f---- off.  Then I seen online where this guy and his so called company is a scam.  So....I started calling him and harrassing him telling him I know about his scam.  He finally told me to stop calling him......that I WAS HARRASING HIM......isn't that funny

I also received a call from Same Day Courier Service saying that they will be delivering legal documents to me between 2-4pm and I should have two forms of ID. I was also informed that if I wanted to Change delivery day and time to call 855-373-1858. So I call and get a voicemail to Delaware,Franklin,and Stevens law firm. I left a message. An hour or so later I get a call from that number from a guy named Dennis Franklin. He had a deep voice and told me that I couldn't change the delivery and that I had to $1,370 immediately. I asked for an address to the firm and he starts to curse at me and tell me that I would be prosecuted. Then when I ask about a payment arrangement he goes off again and hangs up. So I call back and another guy answers claiming to be Dennis Franklin. His voice was no where near as deep as the first guy even though he tried to say it was the same guy. After getting off the phone, he sends me an email stating that I owe money but it's not stayin who I owe money to or how much I owe.

And you in fact Mr. Franklin, are an absolute liar about your telephone number since the one that I used just a while ago to contact you at was 855-373-1878.  And you in fact hung up on me more than once on this phone number that I called you and you gave my father to give to me.  Since you think you are legal in some form or fashion, let me state that you are not allowed (by law) to contact "references" to locate a person in the event of a debt owed.  References are exactly that: REFERENCES!  Possibly you need to learn the law Mr. Franklin and abide by our rights when we state you are to contact us via writing from here on out and no phone calls should be made.  And, I hope you have a great day!

Dennis franklin called and kept given different numbers from all over texas when i call the numbers they are personal people numbers.  In texas a debt collector must have security bond with the sectary of state and be license to collector debt in texas. All u have to do is called sos ask for dennis franklin and cmpany they are not license by the state of texas.

I received a call from what sounded like a disguised voice stating they were a courier company and that I needed to be home between 2-4 with 2 forms of identification for them to deliver some documents. Then stated if they make several attempts, they will come to my place of employment where a supervisor or manager must be present to witness. If I needed to change the appointment or have any questions as to what I am signing for, please call 855-373-1878. When I called, I got the voicemail of Delaware, Franklin and Stevens. The number the caller came from was a local number,but when I tried to call it back, I got the recorded message "We're sorry, your call cannot be completed as dialed.." Called again and it rings fast busy.

Seaside payday loans are based  in belize city belize in central america. Debt management partner buys their debt sell it dennis franklin. Dmp claims to be in nyc and has only 2 employees. But if u asks dmp where dennis franklin is locate they claim to only have his number not address.

Be aware that payday loans charge VERY HIGH interest rates and why payday loan companies do not want to discuss payday loans in terms of an Annual Percentage Rate (APR) but rather in terms of a fee charged for a certain time period. For typical fee charges of $15 for every $100 borrowed for 2 weeks, your $420 loan can grow into 420*[1+(15/100)*(52/2)]=$2,058 in a year's time and that's not including penalty fees. Avoid payday loans. There may be credit unions or banks in your area who can give you a better deal on small loans. Best of luck.

Alfalfa's post says you must by law receive from legit debt collectors "a written "validation notice." ... must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act" and this is spelled out in Section 809(a) of the Fair Debt Collection Practices Act (FDCPA) http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf which states you must receive at initial contact, or send you paperwork within 5 days of initial contact, the following:
1. $amount of debt,
2. name of the current creditor (which may differ from the original creditor who might have sold your debt),
3. a statement that that debt will be assumed to be valid unless you dispute in writing within 30 days,
4. a statement that that if you do dispute in writing within 30 days, the collector must mail you written verification of the debt,
5. a statement that if you ask the collector in writing within 30 days, the collector must send you the name and address of the original creditor if it's different from the current creditor.

You do not even have to ask for the 5 items above, all collectors are required by law to give them to you "at initial contact" which means the very first phone call or letter. They MUST give you their mailing address because items 3, 4 and 5 requires it. If you did not get the 5 items above or an address, or if they refused to send them to you for whatever reason when asked, then you may be dealing with a criminal and not a legit debt collector. Also, the FDCPA says if you have an attorney, the collector is required by law to stop contacting you and must contact your attorney instead. If it refuses to deal with your attorney, it's another clue it is a criminal and not a legit collector. Garnishment of wages can ONLY be done through court action, i.e., the collector must sue you in civil court, which means you must receive a paper notice to appear which is typically done via the US mail or in person (my guess is the US mail for small cases like payday loans), i.e., you must receive PAPERWORK from the court. If they simply tell you over the phone they got a garnishment and you must pay over the phone, then they are lying because you did not get a paper summons to appear in court.

I encourage you to read through the FDCPA once because you have to know what is allowed and not allowed by law in debt collection, and this is how you can tell the difference between a legit collector and a criminal. Best of luck.

this company got a man to call me today and told me to be at home between 12-4 and have my drivers icense ready for the driver. this company will no give me their address or website and said that my lawyer needs to call them if they need their address for my case because i have filed for bankruptcy and i wanted to add them in it but they are so unprofessional they kepted hanging up on me then when i call back they Domino's Pizza may i take ur order and if im not at home they serve the papers to my job so i told them GOOD LUCK BUDDY

Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

Better yet look up a Attorney's office and call them and just ask where are they located or ask for there address and they'll provide it for you without asking any questions. These people ask a 101 questions " Do you have a claim number" and if you say no they'll just hang up on you. I should know we obtained a recording of MrFranklin and his so called professionalism and we currently have him and Goldstein and Dwyers under Federal investigation. So for those who are looking for advise get everything in writing. By Law you have the right to see what it is your being charged with.

My mother in law got a phone call from a Gerald Stone today staying he was a private investigator and wanted to know how to reach me. Thought I lived with her which I never have and have never given her address or number only on private emergency documents. Said he was investigating me for check fraud on my bank out of new York. All very bizarre she probed more to which he responded he couldn't saying more due tu privacy law. I collect for payday loans I know due to privacy laws you cannot even say that. I called the number he left which went to delaware franklin and stevens. Never have I gotten a call collection call anything from these people. Something is not right here.

Dennis Franklin called my work number, a violation of the FDCPA, if he has my home contact information.  He stated he had contacted me numerous times by email (why not USPS MAIL which is the LEGAL form of contact).  He stated the case would be filed May #TH and he understood that it was just a few days away and he apologized but he had tried to contact me and had it documented for legal purposes.  So MR FRANKLIN, if this is a valid debt and you are valid debt collector, lawyer or whatever you want to call yourself, why is there absolutely no information such as a web site or other sort of information for your so called company DELAWARE FRANKLIN & STEPHENS (STEVENS).  If you are valid you would have no problem giving out your license information as a debt collector or your State Bar information if you are a Lawyer.  You also wouldn't have an issue dealing by USPS MAIL!

GO AWAY AND GET A REAL JOB!
