I have received two phone calls from the company listed below. The man on the message said that they have a claim against me. If I do not call back soon he will put on the claim that I am being uncooperative and he will not be able to help me once that happens.  I will not call back because the call sounds suspicious,  which why I do not know what the fake claim is about.

Called the FCC and they will be dealing with Ms Nelson, for misrepresenting herself over the phone. These are scammers sitting in a cubicle getting paid a little above minimum wage and while they try to scam for someone else. Sad day we are living in that someone would want to get paid a minimal pay for trying to scam someone.

I received a call on my cell number that was for my daughter.  A man that claimed to be Investigator Phillips.  He claimed that he was going to serve a summons on her today in Bedford County (where she resides) if she did not call 980-223-4321 (a NC #) to attempt to have this matter resolved.  The call came from 323-973-2500. (a CA #)  I called the number and told them I was her mother and they had called my cell number.  They indicated that she must have used my number as a secondary contact #.  (which she does not do)  I asked if there was something that I could do.  They asked that I contact my daughter (who is 26 yo) and have her call.  I send my daughter an email.  She said it was a scam.  They had contacted her before and indicated she owed some bill and that she could pay it through a green dot card...which I suppose is some sort of prepaid credit card?  I called them back to get the original creditor's name.  Of course they would not give me information since my daughter is 26.  This lady put me on hold for a second and came back and immediately hung up on me.  I called back and a David Banks answered.  I asked him the same questions, requested information about the original bill.  He indicated he couldn't give me the information and to have my daughter call him.  He then said, I see here that you work for a law firm.  What kind of firm is that? and what areas do you practice?  I told him I didn't think that was relevant.  I would have Katie contact him to give me permission to discuss the matter with them.  They are idiots that are taking advantage of innocent people.

Extortion Scam Related to Delinquent Payday Loans

Washington, D.C.
December 07, 2010  FBI National Press Office
(202) 324-3691

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

It's all regarding payday loans...

Before you freak out, remember to look at the state laws on filing a case regarding payday loans. The collections companies may say you owe a loan from 8 years ago and that they will take you to court over it....But depending on where you live, the statute is 2-4 years to file a case against you; which they most likely weren't going to do it anyways...especially when it will cost them more to file a case against you then the actual collection amount. Also they have to file in your own state and county if they are attempting to file a court claim against you. It's their scare tactics to get you to throw some cash their way. Bottom line is, they bought the debt from the payday loan agency, so they will try to make some form of profit off of it. If they can't offer you a valid statement of the debt, your signatures, loan agreement, etc. basically anything proving the debt is valid and paperwork on where it originated from, you don't have to give them jack s***!

Report them if they continue to harass you or let them know you obtained an attorney and they most likely will leave you alone.

If it hasn't shown up on your credit report, I seriously wouldn't worry about it. All valid debts (good and/or bad) are suppose to be reported to the credit bureau, therefore if you don't see it on your credit history it's not a mark against you anyways.

This company is based out of NY and they are having a serious crack down on how debt collector's do their practice. Interesting article...

Here's a good general rule....

No summons...
No court date..

=  Send NO $$$$$$

Why would you ever send money to anyone without first going to court. In case you are unaware, there is NO debtors prison! Even if the court finds you guilty, you can make a payment arrangement that can take years to pay back... If you ever pay it back at all. The worse they can do is eventually try to garnish your wages.... If you have wages to garnish. A simple LLC set up in a "company name" can fix that. Then simply have your work checks made out to your LLC, not you. They are not after your LLC. Anyway, Don't lose any sleep over this crap! File the phone number in your contacts as "Idiot" or "Scams" or whatever, and give it a silent ring tone. This way when they call you won't even hear the ring.... And you no longer have to leave the volume off on your phone. Screw these idiots!! Never let a "phone call" ruin your life!!

My husband got called by these people at work, claiming I owed for a payday loan that dont exist because if it did I would have had something in the mail for the last 2-3 years. I agreed to pay in payments but they got one payment of 61.00 and I cancelled my card today with my bank. They want payment they have to give proof of bill. Already submitted this to the FBI

It's not against the law to advise people of their rights under federal law.  People are getting calls and they have either paid those debts off or they never owed them to begin with - fake debts, in other words.  Why don't you let the door hit you where the dog would've bit you shill - on the way to your boiler room! It's --> that way!

I got a call from Amy Parker too. I took out a payday loan with Pepper Cash nearly 3 years ago and I paid they way more then I owed. It was a 300 loan with a 75 fee. They kept deducting 175 dollars every 2 weeks until they took nearly 700 bucks from my account. When I called them about it they said I was paying extension fees for not paying off the loan in full and I still owed them the loan and fee. Which was somewhere in the ballpark of 500. I said they were out of their mind if they thought they were getting anymore money from me so I changed my account info and they attempted to take more money apparently.

Now 3 years later I am getting a call from these people stating they are trying to settle a debt out of court. I was so sick of this I initially agreed. But then I was advised not to give them my information without a statement or a notice by mail because that is the law. When I called them back and asked for this they hung up on me. I asked for their website and they said they didn't have one. I find it shady they don't have this information. When I ended the call they called me back 6 times in a row while I was at work. I finally turned off my phone because they blocked their number every time and wouldn't leave a voicemail.
