I got the same call today from Brooke Taylor at the same number. She almost had me for a minute since she provided me with my SSN. That really scares me that they had that much information. I think I might have to go to the ss office to make sure my info is safe. They said I owed $600 in a magazine fee and that I could just pay $300. I told her I wanted to look all of this up before I made any decisions since she said I set this up back in 06 and I never recieved magazines or a bill. What mad me question it more was she provided me with multiple address and a couple where of places I've never been. Thankfully having looked all of this up they will not get a dime!!!

My husband got the same call same detail only it was Elizabeth.  She sent an 'agreement' to settle in full for $180 with a payment today of $180 and another one for $30 something in a month. Um I'm not the best at math but I'm sure that does not add up.  Additionally she called me first and disclosed information.  We sent the following response:

To whom it may concern:

1)  I do not believe I owe this debt.
2)  I do not in any way agree to any type of payment arrangement for this debt as I do not owe it.
3)  I have requested written verification
4)  by law the statute of limitations to collect on a debt this old has run out
5)  Your firm has violated the FDCPA section 804 by telling my wife there was a civil suit against me, section 807 by not giving the mini Miranda (this is an attempt to collect a debt...), and section 809 by refusing to mail verification.

I am revoking any rights to communicate with me in any way other that USPS to my current address in Dallas TX, and am advising you of my intent to counter use should you try to maliciously continue with the collection of this false debt.  Again I state for the record that this is not my debt and I owe nothing.

W M

We will see what happens, but should the choose to pursue court, we will counter sue with confidence!

I received a call from Joseph saying that I was directly involved with a civil suit and needed to contact them with the case number and that I "have been notified." First of all I have received debt collection notifications before and I was always mailed something first. Secondly, I just went through bankruptcy, if I had any debt going back as far as they may claim (they used my maiden name, which I haven't had for 8 years) it should have shown up on my credit report. I will not bother calling them back I will just report them to BBB. BTW the phone number was 855-403-3860

Contacted my attorney he told me to ask them to me a bill via certified mail. Of course they won't do it it's a serious federal offense to send a fake bill in the mail. When I called the Miller Davis and Peoples rep back I told them I contacted my attorney and that they want them to send a bill via certified mail. The rep got scared and said she was dropping my case I don't oh them anything. I was also informed they werent even real attorney's. Scammer's. Karma will have a field day with them eventually probably the FBI too if they keep it up.

I received the same call today from Kristen Greene! She said she could offer me a settlement of $568.57 but would accept $400.00 as pif... I am so glad I decided to google the "Law Firm" before taking any action. I did receive the promised e-mail but there was no proof of debt, just a letter accepting $400.00 as pmnt in full and a typed up, untitled page listing some magazines. This certainly seems to be a scam... I am embarrassed I almost fell for it!

They have called me several times....I believe they got my information from a bogus web site I happened across for foreclosure help. The company called me and told me I could send them $3000 cash and they would help me fight my mortgage company and I could win a lot of money because my mortgage company was doing illegal things and I could win if I took them to court.....WELL needless to say I did NOT fall for this crap.  But he called me back gave me a hard time about my name....which I now believe was too fish for more info....just happens the name I used on that form I NEVER use....and it just so happens that happens to be the SAME NAME this Miller Davis and Peoples are using....so my guess is they are into scamming at multiple levels.....these calls started shortly after I had filled out the form on the bogus foreclosure site. Then when one of them called Natasha Trip....very snotty rude....I told her to call my lawyer because I have filed bankruptcy ....she was belligerent and rude...she talked over me and did not want to hear my lawyers info....but demanded I pay her!!!  YEAH RIGHT!!! Now they have a Kate Beckworth calling....they make their web site look very believable....  but they also made their foreclosure help form look legit also.....I can only imagine how many poor innocent people they steal from!!!  I have never ordered magazines I did not pay for....they have the last 4 of my social but that is my own fault for filling out that form!!!

Sandra, see my post above and read all of it. Both you and your daughter need to file reports on these creeps. Next google your name, and also your phone number, any place like Spokeo that shows up, make them remove it. Next, if you all have facebook, make sure the personal info isn't showing public, change the setting if you need to.   A lot of this info is found online and it doesn't take the scammers long to find info, phone numbers etc. They also hack into places like payday online forms and other places.

The call you got is very much the MO for scammers hoping to scare money out of their potential victims.

Just received a phone call from this company, Miller, Davis and Peoples. A lady named Kate Beachwood, said that my daughter Veronica, had used my name and phone number as a referrence. She was trying to contact my daughter to inform her of a "potential civil lawsuit case, that was time sensitive". She wanted my daughter to call her back at 1-855-420-8276, case # H49963. After contacting my daughter to ask her to stop using me for a referrence as I am in ill health and don't need the added stress. She told me she didn't use me as a referrence and hadn't in over a year. So my question is how did they get my phone number and knew that I am her mother? How did they know that she used to use me for a referrence? I googled the law firm and discovered this webpage. So now I am really worried. what if they somehow access my personal info? How do I stop them before it's tooo late?

I recieved my first phone call on Halloween from a Joseph Williams from Miller Davis and People.  He said I had ordered  magazines in 2005 from Great American Readers and if I did not give him by debit card or credit card information today to settle the $391.00 debt GAR was going to conduct a civil suit against me.  I googled this before I called him back and saw all of this.  Naturally I was totally freaked out!  I never ordered magazines.  I recieved them for a while and then they stopped, but they came to me in my maiden name, never my married name and I had been married for many years. It was all just weird.  In 2011 I started getting phone calls I owed money from GAR, I told them I never ordered these magazines and they said I was lying they had me on recording.  Then never another word, and now these MDP are calling. So orginally they gave me 72 hours to settle, well its been over 2 weeks and every day they call 2 or 3 times and tell me today is the last day.  Now a girl Kate is calling me and saying she is the boss and trying to work with me. I asked them to send me proof of debt and I get this BS letter that says I agreed to pay them money.  I guess now they say I have a docket number for my case and they are moving forward with the law suit but I  can still pay today by 5pm.  How so I get them to stop?  THey won't give me an address to send a certified letter to ask for all communications in writing. They also said they were reporting this on my credit. How did you get it to stop?  I know its all BS and a scam.  ANd are we all women getting phone calls?

My husband just happened to be in the room when she called, he is a retired Marine. My 2 sons are both in the marines. My husband tooked the phone from me and he wanted the exact location of there office and him. me and our sons would come see her at her office. My husband told her that is she could prove in her office we owed money we would pay. If she could not prove he would give her some good old southern marine hospitality. She hung up the phone.

"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Bills.com FDCPA FAQ

Below are questions Bills.com readers ask frequently:

Can a Collection Agent Call My Cell Phone?

Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

This was a true statement before the US Civil War, but has not been true since. People may be arrested if an aggressive judge files a bench warrant for a person who does not appear at a hearing relating to a lawsuit regarding a debt. However, in that case, the offense is the failure to respond to a court order, and not the existence of the debt. As stated above, it is illegal under the FDCPA to threaten a consumer with arrest if the consumer does not pay the debt.

I got the same call this morning, same drill. They had my current and previous address and last 4 numbers of my SSN. They claim they mailed me paper copies of the file 2 months ago and that they won't do anything else but take me to court. I got them to email me (to my spam email address) the file and they actually sent me a "bill" with no details on the claim or anything else. I just filed a complain with the FTC, will be filling a police report later today and I'm getting a 7 year permanent alert on my credit file. Got the phone call too.  Only thing is I keep records for 10 years.  So when she gave me the dates of my so called no more payment.  I told her funny I'm holding the canceled check in my hand and if you want I will make copies of the canceled checks and send them to you.  She told me " I will mark this file in good standings and there should be no more prosecution against you"  Damn right I pay my bills and I am still to this day using the magazine company she said she was filing law suit against me.  Boy just love the way our names get sold off on lists.  I can see why some people fall for these scams.  Like I said I'm still using the magazine company she said this was from.  So why haven't they ever sent me a bill for this

BBB has seen a major increase in collection agencies setting up businesses in the Upstate New York area over the past several years. In an effort to keep consumers informed about which collection agencies are operating in accordance with Federal Law, we are asking for specific information from all collection agencies operating in our service area. The requests includes the following: :Federal Employee Identification Number-EIN :Proof Of Licensing, bonding and or registration by the city, town in which your business is located. :Proof of licensing required by any state in which you operate by mail or telephone or email. 1.) This collection agency has not responded to our requests. BBB advises consumers to be aware of their legal rights in regard to collections. The Fair Debt Collection Practices Act is a statue enacted in 1978 which seeks to eliminate abusive and harassing behavior by any debt or collection agency. The act states specific practices and rules under which debt collectors must abide by. There are penalties for agencies found breaking these laws. Some of these laws state that a collection agency is forbidden to harass a debtor, which includes threatening violence or threats of legal action. They may not use crude or offensive language or identify themselves as anyone other than by their business name. If a consumer believes a debt or collection agency has violated any of the FDCPA laws the BBB encourages them to file complaints with the BBB at bbb.org and with the Federal Trade Commission at ftc.gov.
