New Twists to Telephone Collection Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center (IC3) continues to receive complaints from victims of payday loan telephone collection scams. As previously reported in December 2010, the typical payday loan scam involves a caller who claims the victim is delinquent on a payday loan and must make payment to avoid legal consequences.

Callers pose as representatives of the FBI, ?Federal Legislative Department,? various law firms, or other legitimate-sounding agencies and claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, or other Internet check-cashing services. The fraudsters relentlessly call the victim?s home, cell phone, and place of employment in attempts to obtain payment. The callers refuse to provide information regarding the alleged payday loan or any documentation and become verbally abusive when questioned.

The IC3 has observed variations of this scam in which the caller tells the victim that there are outstanding warrants for the victim?s arrest. The caller claims that the basis of the warrants is non-payment of the underlying loan and/or hacking. If it?s the latter, the caller tells the victim that he or she is wanted for hacking into a business? computer system to steal customer information. The caller will then demand payment via debit/credit card; in other cases, the caller further instructs victims to obtain a prepaid card to cover the payment.

The high-pressure collection tactics used by the fraudsters have also evolved. In one recent complaint, a person posed as a process server and appeared at the victim?s job. In another instance, a phony process server came to a victim?s home. In both cases, after claiming to be serving a court summons, the alleged process server said the victim could avoid going to court if he or she provided a debit card number for repayment of the loan.

If you are contacted by someone who is trying to collect a debt that you do not owe, you should:

   Contact your local law enforcement agencies if you feel you are in immediate danger;
   Contact your bank(s) and credit card companies;
   Contact the three major credit bureaus and request an alert be put on your file;
   If you have received a legitimate loan and want to verify that you do not have any outstanding obligation, contact the loan company directly;
   File a complaint at www.IC3.gov.

What practices are off limits for debt collectors?

Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:

   use threats of violence or harm;
   publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
   use obscene or profane language; or
   repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:

   falsely claim that they are attorneys or government representatives;
   falsely claim that you have committed a crime;
   falsely represent that they operate or work for a credit reporting company;
   misrepresent the amount you owe;
   indicate that papers they send you are legal forms if they aren?t; or
   indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:

   you will be arrested if you don?t pay your debt;
   they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
   legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:

   give false credit information about you to anyone, including a credit reporting company;
   send you anything that looks like an official document from a court or government agency if it isn?t; or
   use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:

   try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
   deposit a post-dated check early;
   take or threaten to take your property unless it can be done legally; or
   contact you by postcard.

Here are 20 other numbers they call from I know they are a scam I fight with them all the time I block number after number I changed my number and somehow they still got the new one they have been calling me since August 2010 If I block the # they call unknown. They call my parents house because it was my last known address.  You think they would get the hint since never give them any info and fight with them constantly!! They have threatened to have me served about 20 times have I ever been served NO lol!!!  They threatened my dad saying I was going to be arrested in 24 hours he told them bring it on did anyone come NO lol!!!  What a joke is what I say I just laugh and hang up they get so pissed they call back and leave a lame message that I am not intelligent because I am about to go to jail lol  OBVIOUSLY they are the unintelligent ones because they have nor will they ever see a penny from me and waste their time trying!!!  KISS MY A$$!!!!!!

Yeah, I recieved a call like this today.  They used my maiden name and referred to a returned item from my bank.  I have no bank account with my maiden name and have not had one for 10 years.  When they call back, I will ask for which bank account and let them tell me.  If they can't, I will call the Better Business Bureau on them.

This is prob in regard to a pay day loan. I received a call from them in regards to a friend taking out a loan that he didnt pay back. He must have put me down as a reference. Next thing I knew, he was sued for fees on top of the loan that was not paid back. These loans never go away. maybe you guys should pay your bills too. If they have all your info, you know you took it out.

Came home to the exact message "we are calling regarding  the returned item from your bank, that requires your immediate attention" on my machine. Love the way they have the woman then the threatening guy deliver the message.
And the way they refer to "your bank" ... we use THREE. Which one, nitwit?

Guess I'll go knock on their door and say "I am calling regarding the crime you committed against me."

Received phone call and voice mail that I needed to call about a check returned from my bank which is not true.  I would really appreciate not receiving phone calls like this from them ever again.

Yeah- I got a call from them, they left a message without saying who the message was for. They said an item had been returned by my bank. I haven't ever bounced a check or been overdrawn in my entire life (granted, I'm only 30, but still, never). So I called from my office phone. He pulled up the phone number, my cell phone number that they had called. He gave me a name that wasn't mine. I told him it wasn't me and he said "Are you sure? You know lying about these matters only makes it worse and can make you vulnerable to other criminal charges, in addition to the onces you're already facing." Whatever schmuck- It's not me. I pay my bills.
