DM assoc called and said I was to call them back ASAP regarding a summons in my name. He didn't give me a name and I couldn't understand him.  Said he had my social security number and would be moving ahead with the process. What process? What a JERK. Thanks to all for this information.

How do you suppose "the consumer and state reg boards", more specifically attorneys general and the FTC, act against fraudulent companies, anyway? They have to go to court, the same as you can, which means someone eventually has to "fund lawyers" to punish lawbreakers.

The thugs who want you to confuse payday loan defaults with "hot checks" are breaking the FDCPA and other laws by design, laws which grant private right of action. You can sue and win on solid claims *without* paying more than a court filing fee out of pocket. You have a right and a duty to take the role of private attorney general. There are thousands of dirty debt collectors and only a a few dozen regulators to stop them.

The fatal limiter here is that PDL thugs often don't have a domestic address you can serve with a summons. The few high profile busts of the scheme have involved a front man found working stateside like a ranch herder, who of course denies that involvement.

Never let bullies on the phone confuse extortion with debt collection. Honest debt collectors do not typically send their claims straight to a judge, and they don't take your ransom money to broker quick deals with so-called "process servers". There are no secretive "arbitrators", "investigators", "mediators", or "prelitigation specialists", only sweaty criminals with a script full of coercive remarks. Lawful debt collection is a process, not an ambush, and you are due a chance at each stage to raise a dispute. The agents' horrid threats are empty and their conduct is illegal. Do not reward lawbreakers with your money. Challenge them always, sue them if you can.

My husband received a phone call from these people yesterday saying he had 24 hours to call back or they would issue a summons for a bad check. They are trying to collect on a payday loan that was taken out 5 years ago and have supposedly been sending letters to our old address. He did return their call and the guy told him that he needed to call MTE Financial and gave him the number. He called and no one answered and it went to a Go Phone..hmm.  So he left a message and never received a call back.  Called the original person back after we did some research and found out that MTE had 15 names under it including a payday loan place we did use, but paid off LAST YEAR when we got a letter about it.  The guy couldn't tell him who the original creditor was except for it was MTE @@. So my husband ask the guy for MTE's number again, the guy put him on hold, then came back and said...I am sorry they don't have a consumer line and someone gave you that number the other day..Umm...really? There was also a lot of Umm's, Uhhh's and Well's in this call and the guy said....You will have to wait for your summons to court. Hubby said...Ok, bye and hasn't heard anything else. I will admit we did take out payday loans, but it seems that they are trying to collect on one that has already been paid.

I had a weird, repeating recorded message left with this telephone number and company name on my fax line - it was a very vague message, referencing "my" name and social security number (though the message didn't actually use MY name or SSN!).  I don't have any outstanding debts, never have, and while it could have just been a wrong number, it sounds like an absolute total phishing scam.  I don't think that number is published anywhere - just have VM on it as a backup for power outages - and I don't use it for anything (I have a home land line and a cell phone).  Very, very odd.

Received same message did not call back.  Probably won't.   If i was more litigious by nature I'm pretty sure they're breaking all sorts of regulations.    I hope they get busted, but i'm not going to fund lawyers pockets with this nonsense, just hope they get shut down eventually.  reporting to all the consumer and state reg boards.

Yeah - I just got one of these call at my office.  My mother just passed May 6th and her obituary stated she worked here for 20+ years - little do this scammer know I took over my mothers position 12 years ago.  I think they may be using public records - like the obituaries.  Anyone else out there with a similar situation??  I'm not calling them back and am telling my employees to disregard.  The number on my caller ID was 855-380-7726

I received a call from this number on my work VoiceMail.  There were a few red flags that went up.  First, I have never used my work number as a contact for any of my personal credit files.  Next, the voicemail was extremely generic.  It says ?your name,  and your SS number?  instead of using my actual name or part of my real SS number.  Last, the voicemail threatens that I am being ?scheduled for proceedings in 72 hours?.  Hmmmm, the machine knows exactly how long, but nothing else?  They must use some kind of kangaroo court, otherwise, you are served for court.  At the very least a registered letter.  It?s worth noting, that these scam debt collectors are becoming more & more common.  The sad fact is, most people these days have owed someone something at some point (even if it?s as small as an overdue library book or a late return of a movie.)  These generic scammers will pray on that & try to get you to send some type of certified funds to them.  Occasionally, they will do a little work & pull some information from your credit profile, then use it for the scam.  Never seen anything by Western union, green dot, or the like to someone you don?t know!  You will just be giving your money away. If you want to do that, send it to me ?  Be careful people!  The world is getting weird!

If they call themselves DM Associates or something similar,  you  can be reasonably assured they are little more than debt scammers.  Don't talk to them; don't give them any information.  They are incredibly abusive and use all sorts of meaningless threats.  Do not agree to anything and don't send them any money.    Debt collectors do not have the power of arrest, warrants are issued by judges to duly constituted law enforcement agencies NOT to debt collectors and there is no arrest for ordinary  civil debt in any case in the US.
