Whether you are called a debtor or some collector thinks you can flush one out, you have rights and options. Many are simple to exercise if you only learn how. You are entitled to proof of claim and fair treatment. If one or the other is not provided, the collection agency should *not* win your assets. You are granted control of how you are contacted, the right to dispute debt claims, and the means to sue violators at low cost. The FTC and the CFPB can start you on your homework. Fairly typical "Foti" message, giving away just enough to spur a response but not enough to create understanding. If it's really you being targeted, you should see a dunning letter soon after the first calls.

The FDCPA mandates both privacy and disclosure, but not at the same time. Discussing a debt with the wrong person can get collectors sued. They may not have such a problem violating your other rights to coerce payments, however.

These people call every single day - sometimes more than once - and I let it go to voice mail.  The person's name they're looking for is obliterated at the beginning of the call.  The message they leave is "To discuss an important business matter.  This is not a solicitation.  If you'd like to speak to a representative at this time, please press .  Again please call Maggie Long at Maggie Long at Northstar Location Services", or reach us on the web at www.gotonls.com", then leave a reference number.

This company asks for all your personal information before they will tell you why the are calling or who you have a debt to. They call everyday and can barely speak English.

These people call everyday saying my husband owes a debt. That's impossible because I pay all the bills and have his recent credit report. When you ask them to stop calling, they ask for your date of birth and other personal information. Why would I give personal information to someone who barely speaks English and is making up a story about owing money?
