The Fair Debt Collection Practices Act (FDCPA) prohibits debt collectors from making false threats that they will sue.

If there is a violation of the the Fair Debt Collection Practices Act FDCPA you can get up to $1,000 in statutory damages, plus actual damages including compensation for harassment, embarrassment and frustration.  If you are successful, the debt collector will have to pay your court costs and reasonable attorney?s fees.

Your best option may be to have an attorney help get their attention or pursue claims under FDCPA.  Your state may also have its own remedies for abusive or unfair debt collection.

Thanks.  I did verify the debt with the original creditor, it was valid.  The amount was $300 less than what the collection company had told me due to the original creditor dropped the interest charges and just ask for the original loan amount to be paid.  

I don't know where any of you are that are posting the private couriers never show up to deliver the paperwork.  But they will eventually serve you.  The courier showed up at my home but the collection company placed a stop order on the papers so she didn't have to deliver.  If they havent found you, its probably because they don't have your updated address yet.

They said they would be at my house last saturday or monday morning. I have seen no one. They also threaten to come to my work and so far nothing.

just got a call from someone similar but I have never been notified of any litigation. I am going to call the number on my lunch break to see what its all about. gave me a case number. The woman I spoke to was very nice. Unlike some that have left me messages in the past.

I got a call from a private courier today named Brooke Owens.  She stated she has important documents for me and will be visiting my home and work places tomorrow afternoon or early friday.  Has anyone actually been served by these people?  She gave me a number to call the "Firm".  I called them and spoke to Chris M. and he informed me that a payday loan lender from 2006 filed a complaint against me over a 900.00.  I am considering paying it but have been reading the posts on here and wondering if i should just let them serve me and get an attorney to handle this situation. Any advice?

AND she said I should call "The firm" to have them fax or call her to stop proceedings/her coming out.... I'm really worried, but at the same time, this just does NOT seem real to me.

Same message today-- NEVER says what or who the "Firm" is, and I'd better have a witness etc available when she shows up for me to sign the papers-- gave me a "case number" as well.  Called at 7:05 am-- while I was at work.

Caller ID says private number-- message is from a Pearl Collins saying she's coming to serve me either at home or work, left that number to call them "in the event that the client never sent me any information stating that I would be served"...
