If legal in your State. The 1 party/2 party consent varies from State to State. But it's an excellent idea to start off all phone calls with "I'm recording this call, do you consent to that?" Should cut through the dead wood.

There is no charge against you from these jerks.  They broke the law by calling mother (third party)  so how honorable can they be????  IF you were to be served, the server would NOT call first.  They are trying to extort money from you.  How to stop it - ignore or tell them you are recording the message.  That may help.

I have been receiving calls from them as well.  They call from various numbers- private, local, long distance...they called my mother and scared the crap out of her- told her I was being sued for check fraud and was being served papers if I didn't call by 3pm today.  While I'm sure this is a scam, how do I stop this??

They have been calling and harassing me for over 2 years. It is a scam. It was from a payday loan I had years ago that was paid off. I have also taken out bankruptcy since then so its not like it would matter. I do not answer nor return their calls. Let them waste their money paying people to call me. They leave the number of 8555196674 with a reference number. Maybe one day I will call them just to get a kick out of what they have to say when I tell them It was paid and yes I have proof.
