Debt Collector
I, as well as several family members, have received phone calls from this agency several times in the past week regarding a family member who we no longer have contact with. When I first called, I informed the young man he has no authority to threaten using the local authorities to resolve a debt collection, he replied with "uhhhhhhh...." and then hung up. When I called back again, a rather sassy woman answered by saying, "Investigator." So, I had my number removed from the list and asked how she got my phone number in the first place- she told me she used a database the FBI sometimes uses.... I asked if she had authority to use this database, apparently she did. When I informed her I was a licensed attorney, she told me to stop telling her how to do her job, she was a VERY GOOD attorney. I told her, well as an attorney, you should probably know the law dealing with debt collection and "counts of fraud," her response was, "Im so very happy that you are an attorney, good for you. Im ending this conversation, you have a great day mmmk mmmmk." Suffice it to say, they better be prepared for the wrath of my legal knowledge (that I sacrificed three years of law school for and a whole lot of time practicing to gain)!

Good luck to those of you who receive this call, looks like none of us can get anywhere with this "company"!

I am very concerned of what they would have asked my daughter,  and if legal course can be pursue if they call again (after i was done with her i dont think they be calling back anyways)

The address information I was given is:

Copeland and Associates
875 3rd Ave
New York, NY 10022

I googled it, there is an office building at that address, and a lawyer's office at that address...however, it is a personal injury attorney, like for car accidents. LOL

Got a call from "Brian Young" today, same old broken record. When I called his bluff, and asked for a letter of verification of the debt, he told me he doesn't do that because he is an attorney's office, not a debt collector. Gotta laugh.

Oh, he did the usual threatening to have the police pick me up, have my kids taken away while I'm in jail, yadda yadda yadda.

Seriously considering filing complaints.

My ex-wife received a call from this number and they were claiming to be a county prosecuting attorney. So I called the prosecuting attorney's office and gave them the phone number. I hope they may pursue criminal charges. That was a real moronic thing to do.

Ask for their address and provide them a written notice that you are: (i) disputing the debt, or a portion of it, or (ii) requesting details of the loan, which they are required by law to provide, including the original lender, the amount, etc.  Until they provide you with that information, they are not supposed to contact you to collect the debt.  Like I've said before, they have no authority to dispatch the police.  This is a civil matter, not criminal.  It's a scare tactic to get people to pay.  Judging from the posts I've read, they aren't particularly interested in following the law.  They've changed the name of their "company" and changed their phone number.  If you truly owe the money, my suggestion would be to negotiate a payment plan, otherwise I would contact a local attorney.

I did a search for "Brian Young debt collector" and discovered that he has been doing this for quite a while.  Do a search for 855-531-1877 and you'll see the type of person you're dealing with.  Please, do not let this guy intimidate you.  By reading the FDCPA you can learn about your rights and the appropriate steps to take.  If he continually violates the Act contact your attorney general.  I'm assuming they continue to harass people because if you're unable to pay your debt you're probably unable to afford an attorney.  Unfortunately, I'm sure there are a lot of people who fear criminal penalties, including jail time, so they just pay them.  They have absolutely NO AUTHORITY to issue an arrest warrant or dispatch law enforcement officials.

He is not very well spoken, uses poor grammar and foul language, has changed phone numbers and business names (formerly Logan & Associates apparently), all of which indicate to me that his business is not a legitimate one.

I just got a call from this same guy (Larry something).  Very abrupt and rude. And to top it off....was looking for someone who we don't even know.  I called back to tell them to take our number off of their list and they were very rude. I don't know who these think they people are, but I work in LAW as well and not only was the call misleading, it was fraudulent. They cannot do ANY of what they threaten to any of you! THEY MUST take you to court the old traditional way and get a judgement. You have the option to show up or not. But they can't just call the cops and send them to your home or place of business. Dummies-lol
If it was that easy, every debt collector would do the same...don't ya think? Police, Sherriff, etc. do not get involved in legal matters as such until AFTER a judgement has already been made against you and cannot be collected on OR if they need to serve you/your job with a notice of garnishment. And if for some reason they do manage to call the cops, they are filing a fraudulent claim against you in order to get your attention. I've looked them up and it looks like they started doing this not too long ago. But they will threaten the wrong person one day and get themselves SUED!

They contacted her again this morning and told her they were issuing a warrant for her arrest if she didn't set up a payment arrangement by 3:30 today. Now the name of the pay day loan place has changed. I told my friend to contact the Attorney General.  And if the office that's calling is really a law firm they should know that they can't freely give me any information on the issue. I just called to find out their name and location and they asked who it was in reference to. I told them I was calling for a friend who received a call from them and we want to know if it's a legitimate call and the went right into giving me her information.

Have your friend go to this website and read the FDCPA:

http://www.ftc.gov/os/statutes/fdcpa/fdcpact.shtm

It will inform her of what the debt collector must provide (see Section 809).  In short, your friend needs to contact Copeland and Associates for their address, then write a letter disputing the debt and requesting a verification of the debt or a copy of a judgment.  While she is waiting for that information they are not permitted to continue their collection practices.

Also, tell her to look at the sections that identify violations of the Act.  I'd be surprised if they didn't violate a few in their initial phone call.

I have a friend that was just contacted by this company about a Pay Day loan that apparently her ex husband "e-signed" her name for. They threatened her that she had to pay his debt within 24 hours or they were going after her for defrauding a bank. Has her scared to death. She asked for proof of the signature and more info and they told her she can't have it because it's evidence against her.

Have received several voicemails from somebody who is not very clearly spoken who was looking for someone else (a family member). The caller identified themself as Investigator <mumble mumble> and told me that my file had been red flagged for 2 counts of fraud and then <mumble mumble>. I just received a follow-up call which I actually picked up and the guy on the other end asked for the same person (not me). I asked that he identify himself and his business. He claimed to be Investigator Larry Brown with Copeland and Associates and asked who I was. I told him to tell me why he was calling first. He said that he would not if I was not the person he was trying to reach. He got some nasty attitude when I insisted on knowing why he was calling my number and then hung up. I've also heard from several other family members that they have been contacted by the same sketchy outfit from this number.

Received a voicemail at work from this number looking for someone else.  The caller identified himself as "Investigator, Bryan Young" and said that my file had been red flagged for 2 counts of fraud and that if I didn't contact him by 5:30 p.m. that he would dispatch a sheriff to my home or place of employment.  Unfortunately for Investigator Young, he called a law firm by mistake.  His message was a clear violation of the Fair Debt Collection Practices Act.  Debt collectors have no authority to "dispatch" law enforcement and the mere threat is clear violation of the law.  When I called back someone answered the phone by saying "Can I help you?"  I asked the name of the company and was told it was Copeland & Associates.  I got the "investigator" on the phone but he had already spoken to the individual he was looking for.  When I offered him free legal advice regarding his debt collection practices he got an attitude and hung up.
