Exactly the same thing! A person identifying as "Tory Davis" left message saying an important matter concerning me (she accurately gave my name & address...identified my age & that I'm a non-believer...right then I was suspicious bcz what legit collection company knows or even cares that I'm an atheist) Turned out to be someone trying to recover an 8 yr old debt! Very threatening & very rude. Tried to use the same "fraud" subpoena scam on bank checks drawn on a closed account 8 years ago.. Wouldn't identify themselves or say much about the debt or how they got this rather small outstanding amount that I had forgotten after a long hospital illness.

Hey, I got the phone call yesterday they said I had a payday loan for $982, never, never, did I ever get a payday loan, especially in that amount, she said to get an attorney  I told her that I never had one and that I filed Bankruptcy even if there was an amount, which there wasn't.  She yelled again and told me that she was pressing charges.  I called back and told her that I reported her to the Attorney General, she hung up.

I have also received a very threatening call from "Lisa Banks" ending with "get yourself an attorney and good luck". I also recorded the message left on my machine.  She went on to say that her company "Liberty" had received a "returned check" from by bank that would be punishable by going to jail if I did not immediately make good on said check!  This never happened!  There is no returned check!  When I called 855-638-0844 I was also put on hold.  I then confronted this women and said that I would very much appreciate our number being removed immediately as I believed "Liberty" to be a scam and that I was reporting them to the attorney general.  She screamed at me and told me to go f...k myself!  I couldn't believe it!  As consumers, we need to ban together and get whatever this scam is removed as soon as possible.

The state has nothing to do with payday loan debt unless they mean the regulation of it.  This is simply not a criminal matter.  I would recommend two things:
1st read the two posts under this number that tell you what to do and provide links to give you the proper information.
2nd call the payday loan company and either make arrangements to pay the bill or find out which collection agency they have assigned it to and call them directly.

If you can find out who these people are most certainly send them a certified return receipt letter asking for verification of the debt which must come from the original creditor, not from the collection agency.  You can find form letters on the CFPB,gov website which is the federal agency in charge of problems such as this.  The link to the web site is:

I also received a call from this "Liberty Adjusters" company where a girl named Lisa answers the phone and then transferred me to a Samantha who claims they are a 3rd party collection agency who work for the state.  When I asked her to mail me a verification letter regarding this debt she stated she could not due to state law that I've been deemed non-collectable.  She then proceeded to tell me to get the funds and call her back so this debt could be settled or to get myself a criminal defense attorney.  She had way too much information on me as well as friends.....names, phone numbers and addresses.  When I called her back to dig further since she ended the first call by hanging up on me, she pretended to put me on hold and call my debtor to have a 3 way call but was unsuccessful in doing so.  Her voice then got very shaky and again the call ended by her hanging up.  I'm not saying I don't owe this debt, which was for a payday loan, but it's 3 times as much as what it was for.  I just don't think this is a legit company trying to collect.

I recieved a very detailed message regarding a person I know. The message leaver Lisa Banks  stated that this message is fully intended for....."    " from the fraud division and that the person she was referring to " we have problem" and he or his attorney needs to call her immediatly or " failure to return this call will result in " my "  assumption that you waive your rights in this matter". This person left very detailed information that would probably result in a HIPPA violation for the intended persons rights. I returned the call and tried the extension and it did not work, but I was given the option to choose another extension. I spoke to a person who transferred me to Lisa...I told her that she left very personal information on my phone regarding the intended person...she argued with me and denied that she left personal information. I told her I have a recording that she left...she again argued with me and eventually told me to have a good day...and hung up.

?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

It's federal law that I should of received papers in this matter without 5 days of the first phone call.I am reporting them to the attorney general office. Called us today too! Said we owed money! I called back and left a message and told them to mail the official documents that our attorney wanted them!! Had something like this happen about 2 years ago and it was a scam and I sent the email they sent us to our state attorney general and never heard from them again!! Scary thing that people call wanting money and its a scam!! Use to be, you could trust a telephone caller!

Oh yeah they will use scare tactics to try to scare you but like I said before thats all they can do is scare you .You cant go to jail or even get sued for defaulting on a payday loan and the people who give you the loans have insurance.

They can't file a "judgment" against you unless they have sued you, you've gotten the summons, gone to court, and LOST your case.  Per the FDCPA, you should not pay any caller who refuses to MAIL - do not accept email or fax - proof that you owe a debt and proof that your callers have the legal right to collect said debt.  Refusal to mail this documentation is a violation of federal law.  The fact they are refusing to send any paperwork - actually because they have none - tells you right there, that it's a scam.  Please do report them to the FTC, FBI and your state's Attorney General.
