If I get one more threatening voicemail from them.  They will be reported to the NYS attorney general's office.  Payday Loans are illegal in NY both getting them and "collecting" on them.   Unfortunetly these scammers do not seem to go away.

Yes, these calls are getting really old.  I only hope that there are not too many people who fall for their shananagans.  Never ever pay anyone based on a telephone call.  If it is a legitmate debt they have to send the information in mail with a notification of 30 days to dispute ther debt.  This should include their business license to collection debts in your state.

They left me a threatening message on home number the other day.  I guess they figured they would give it a try!!

Oh my god, this just happened to me. My daughter was sure she had paid off a payday loan. They called me with all of her correct information and threatened to put a lien on her car. Because I am a senior citizen they gave me a "break" if I would settle right then by providing them with a Visa credt card. I just cancelled my card but have no hopes of recovering my money.

Thanks for the information posted here, unfortunately, I found it too late but maybe it will save someone else from the same fate.

My dad has been receiving calls from a guy or guys going by the name of David Web and Eric Nelson claiming I have an outstanding check of $300 something and that if I don't comply and pay it they will find a way to get in front of a judge. One they never contacted me personally with a phone call or anything in writing and I looked up the numbers that they gave my dad to call them back and both came back to the Delaware Assets Management. The one guys (David Web) was really rude and demanding and called from 855-641-3220 and claiming to be a court official, the other guy (Eric Nelson) called from 866-473-0226. I have called the county court house they are claiming its through and they have no record of me in their system. Pretty sure this is the same thing everyone else on here is complaining about. Please beware!

Thank you for this information! My call generated from Delaware Solutions and they claimed I still owed on a payday loan. It's true I had a payday loan at one time, but it was paid in full over a year ago. Delaware Solutions will use language like "serious allegations," and threaten to forward documents to "your county." After I told them this debt was paid in full, they demanded I send a "paid letter" to prove I paid off the loan. I don't think I owe them that documentation, so I submitted a complaint to http://consumerfinance.gov/complaint. I'll share the follow up when I hear something.

Filed a complaint with the CAFB and my state AG today.  On my way to file a complaint with Go Daddy for hosting a fraudulent website.  No, it won't shut them down, but at least I can be a little pain in their a**.  Hey, just returning the favor!

The "Delaware Solutions" website is a fake.  A WHOIS search shows it was registered with GoDaddy on 1/2/14.  The website is a Wordpress template that looks like it could have been designed by a 3rd-grader.  Stock photos and repetitive paragraphs.  A legitimate collection agency would hire an IT firm to do a much better job than this.  Wouldn't surprise me if they're stealing copyrighted images.  These people have no ethics.

Two ways they could have your contact info:

1)  If you've EVER taken out an online payday loan, even if you've paid it back in full.  Once you have given them your contact info, they'll sell it to crooks who will sell it to more crooks, and so on.  The people who have your info now don't know if you have a loan, if you've ever had a loan, or if your loan is repaid.  They're counting on convincing you that you owe someone money somewhere.  That's why they won't send you any proof of the debt....because they don't have it.  They'll just keep harassing you until (they hope) you'll give in.

2)  Someone has stolen your identity and sold it to them.  Sadly, if you've ever used and ATM or made a purchase from a fishy (or phishy) website, you run the risk.  If they have your bank info, they can run money in and out of your account for money-laundering purposes, which might attract the attention of the REAL authorities (not the fake ones they threaten you with).  If you think your bank account info has been compromised, even by no fault of your own, close your accounts immediately and NEVER give them ANY account information.  In most cases, it's not your money they're hunting for, but access to your accounts to precipitate their other "shady" activities.

Bottom line....they're criminals, and are likely operating outside the U.S., where they think the Feds can't get to 'em.  Report them to the appropriate state and federal authorities.  Also, it might not be a bad idea to report "Delaware Solutions" to GoDaddy for violations of their TOS.  GoDaddy is a pretty big web-hosting provider that advertises nationally, and I'm sure they wouldn't want their good name associated with this kind of fraudulent activity.  At the very least, we might get their fake website shut down and send them scrambling for another hosting provider.

Yes I was contacted yesterday, on my cell.  I didn't respond a message was left of my voice mail re:  1099c.  I ignored for whatever reason I am targeted alot with this type of callers.  However, today I received a call at work, it was an automated call asking for me.  I hung up and decide to google 855-641-3220 and ended up on this page.  People be aware!!!  This is a fruadulent call and everyone that get a call from them should report them to the www.irs.gov/uac/Tax-Scams-Consumer Alerts
If the IRS gets enough of us reporting this number hopefully it will send up enough red flags for them to be prosecuted.

1099c is a forgiveness of debt form filed by the creditor.  Has no effect on your right to claim a refund.  If you were being sued by a bank you'd have received some warning from the bank.  Writing bad checks is in fact a crime and if it occurred you would be visited by a police detective.  Debt collectors DO NOT  have police powers and cannot get warrants issued for arrests, only public prosecutors and police can do that.  Threatening  people with civil  debt with criminal prosecution is a crime in itself.   The debt collector can be held liable.

Next time they call with their phony threats, tell 'em to put their claim in writing and mail it to you by US mail, otherwise tell 'em to go to hell.

So I called the company and of course it is Saturday and I received a recorded message. I will however be calling them on Monday to get this stuff staright.

They told me they were filing a 1099c form to the IRS that would effect my refund..when I told them I had no idea what they were talking about the guy got aggressive and claimed to be from an attorneys office and I was being sued by a bank for writing bad checks..funny thing is I haven't had an account in years and never wrote checks. He claimed he was issuing a warrant for my arrest and if I didn't pay my kids would have to visit me in jail. He had a lot of my information that could easily be seen from a credit report. I called him some names and he said he was recording me and would then push the warrant and show the judge my nasty behavior. I actually thought it was real until my mom googled the number for me and seem it was a scam. My husband and I then kept calling THEM back so they could get a good taste of their own medicine. They kept hanging up and making threats..but when we claimed to be talking to police they tried to be nice. I even called back and asked if I could pay my debt with them and they were more than happy to take my info until I told them I was just kidding I was paying $hit. Don't fall for their games!

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.
