Tammy, Somethings not right here. Did you contact the real loan outfit you got the loan from? Some of these scam outfits are getting a hold of folks info by hacking into the data bases online, so if you applied online that may be how they got your info.  So I'd contact the number on the original loan in person if possible, if not, give them a call..  You still have the contract and payments made? That should provide with the legitimate info..

Record and keep messages from the ones calling you. Compare the phone numbers from the real contract to the one calling and write down every call in a notebook you get from the ones calling you. If you can, tell them your recording the call when you call the number back calling you too.  

Do go down to your bank and close that account and get a new one. Demand they send proof of debt.. by US mail, phone, email or fax are not legal proof.  Read up on your rights and the laws regarding what they can not do. The lists are over on the right hand side of the forum  with tips and links.

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

These dumbasses keep sending me emails about a payday loan I took out 8 years ago and paid back (I still have the bank statements) after the loan was repaid, the shady company (online payday loan company) changed the amount to continue debiting my account, my bank said the only was to stop the debit was to close the account, so not only was the company paid but they got extra money.  Now I have these idiots bothering me! I don't care if I have to find dirty info and harass them at home like they do to me, I'm sure they are just a bunch of doped up felons who can't get a real job anyhow. Please everyone, don't be scared by these fools, they have NO basis for their threats, in my case their claim is completely bogus...it is so far out of the statute of limitations, it's laughable, and I even if it happened within the SOL I have plenty of documentation to prove they are full of crap.  They just try to scare people into paying and hope somebody will bite, DON'T FALL FOR IT!

He is scheduled to be in at least 4 states tomorrow. Please do more research, i do owe a debt but these people dont actually know that. Dont be fooled!!!

Nice try SCAMMER.  FAIL!!!!!  Scammers like this CANNOT do "whatever it takes" to get YOUR money as you "claim".  They MUST adhere to FEDERAL LAWS, not do "whatever it takes".  They need to PRODUCE PROOF of:

(1) who the debt is for, their LEGAL MAILING ADDRESS and CONTACT information
(2) How ANY amount including interest was "factored"
(3) your ACTUAL HAND WRITTEN signature as PROOF that you took out and owe this debt
(4) LEGAL proof that they can "collect" on this "debt'  (THAT MOST LIKELY DOES NOT EXIST)

ALL FOUR need to be answered 100% BY FEDERAL LAW.  They CANNOT threaten lawsuits, arrests and act as if they are a law firm, that is ILLEGAL...

Now that's just plain stupid.   Sure, people already know whether they do or do not owe a debt.  The purpose of making a collector validate the debt is to determine whether or not YOU HAVE THE LEGAL VALIDATION TO COLLECT SUCH DEBT!!   AND YOU MUST VALIDATE THE DEBT INACCORDANCE WITH THE LAW AND FDCPA..     If you can't validate,    nobody owes anyone anything....and you can't legally collect a penny.  Now do you get it???   Of course you  do because you can't  validate your own shoe size.

As much as everyone would like to get revenge on these extortionist frauds, there is no way.  Literally, NO WAY.  As soon as you find one, the name, numbers and localities change.  This happens on a daily basis.  I have started locally and worked my way to the top.  It takes a massive amount of man hours (which I have spent) to track down who is calling you and even then, you CANNOT prove it was that person.  Say you do have a ton of money to spend on a PI and an attorney (which I did), you then file your lawsuit, the person may or may not show up.  10 times out of 10, no one will!  Then you have to delay again and again and pay MORE attorney fees.  My advice is to not let it upset you, its not worth it.  It isn't right, but you can't change it.  Your time is being spent on a very negative situation and not on the good ones.  Make the important people aware of whats going on and hope that they will stand with you.  Take it from me, I've dealt with it for over five years.  It is illegal but the federal and local governments are in way over their heads and have no time to scout out people like this.      

FYI -- I did find one.  I found his home address and his criminal record.  He had been in prison for 10 years for Loan Fraud in Florida.  I reported him and his return response came through a dirty lawyer who said hat if I pursued him, he would come after me for defamation of character. I KNEW it was him, I had my thumb right over him.  Only thing was, my evidence was inadmissible due to the fact that I had recorded him without his consent.

There are three reasons for a debt collector to contact you: your creditor has not received a payment from you within the time frame discussed in the contract; you are a victim of an identity theft meaning someone used your identity to obtain credit and didn?t pay it off; and finally, you might be contacted by collectors who are looking for someone other than you .

When contacted by a collector, take as much information as possible from the caller. Ask for the name of the company, address, the caller name, fax and phone number, amount owned, and the name of the creditor who passed your account to them. Also, tell them you expect to receive a notice in the mail concerning this debt. The last step is very important because you need to have proof of the debt in question in writing.

If you discovered that the debt is not yours, never pay it off simply to get rid of the collector. Also, never ignore the collector either. They will not stop contacting you, and may even file a lawsuit against you. If you are repeatedly being contacted by a collector looking for someone other than you, it may be considered a form of harassment. To stop this you need to send them a letter requesting to cease calls.

If you established that the debt is yours and you don?t feel comfortable dealing with a collector via phone, tell them you want all future correspondence in writing. You need to send this request via a certified mail and request a return receipt. If you want to allow calls only between 5pm and 6pm, tell them about it in the letter. By law collection companies are required to respect your privacy and will have to cease all phone calls to your home, relatives, neighbors, and work.

Once you have their claims in writing it?s easier to seek legal help, and keep records of your correspondence.

Send all your responses to bill collectors via Certified Mail. This way you will have proof of receipt by the addressee.

Remember that the amount they claim you owe is negotiable. You can negotiate the total amount due, number of payments, and the payment deadline. Once you worked out the payment plan, request it in writing.

What a debt collector CANNOT do:

?Use deceptive practices. For example, threaten you with arrest or  trick you into paying for collection calls.
?Use obscene language.
?Call you at work after you tell them that your boss does not approve these calls.
?Deny you the right to receive a written notice (within five days after your first phone conversation) that would tell you how much you owe and the name of the creditor that says you owe the money. If you do not receive the notice within five days, call the collection agency and ask for its address and fax number. Then, send a letter to the collector noting its failure to send you the required notice. As a minimum, make a note in your file.
?Refuse to give its name and the name of the collection company when asked.
?Put a debt on your credit report if you file a dispute. It must validate the debt by obtaining a verification of the debt or a copy of a judgment from the creditor before continuing their collection efforts. The results of the investigation must be mailed to you.

Please see all the posts on the number 877-957-2492 on this site as well. Samuel Sole & Associates is the same that called me and many more. DO NOT PAY ANY MONEY OR GIVE ANY OF YOUR INFORMATION LIKE SS# OR CREDIT CARDS to ANYONE over the phone. Unless it is a person you actually know personally. THESE are scams and I've had a pay day loan when I went through a tough time. Paid it off and was over a year later they called with that info to that old account and demanded money. I asked them nicely to email and physically mail me the documents to that showing I owed it...as I knew I no longer owed. After they kept arguing, literally arguing with me, they obliged to mail and email. I still have yet received ANYTHING. Now they called my cell phone and I've changed that number. And YES these people read these messages. ANOTHER man from Samuel Sole & Associates called and said "if you'd stop spending so much time blogging on 800 Notes and talk to us like adults......"  WOW! No professional company is going to speak to anyone like that in the first place. These guys get angry in their tone. Why do they take calling all of us so personnally??? They have issues and will continue to get any money from anyone. Be smart, do your homework and check your credit history/score often. OLD debt gets sold to company after company after company to collect. THEY all have the documentation from origination creditor, just ask to have it sent to you if you're unsure. They must comply in ANY state. For me...I will NOT STOP "blogging" about this so called Legal Firm ever. I've posted this on every site I can think of and I'm searching daily for any similar sites to post this on.

if anyone has received a call in which a collector threatens you with legal action, having papers served, or criminal action over a payday loan, please call the NYS Attorney General's office by calling 716-853-8404. Process servers DO NOT call you when they are coming, and this company is not a lawfirm, and can't sue you over debt.  Please save any recordings where legal.  Also check with your state's department of state to see if they are licensed to collect in your state.   Calls to an employer that reveal the nature of the call are also illegal.  Failure to provide a dunning letter within 5 days of the initial contact is also illegal. Failure to register to do business in each state you operate in is illegal.  Implying that you can and do sue accounts is illegal.

I have been receiving these phone calls for years and nothing -- I turned this company  into the Federal Trade Commission as they gave personal information to my coworker -- also the person who called me telling me I was going to be served -_ I traced her number and it was for a company that sold vinly siding -- and they did not have this person even working in their company.   They are also going to see what can be done about these people using their phone number.  I wish they would come and see me -- would love to get them in court because once the judge throws it out I will be filing a suit against them.  They have called my family and have called me at work.  If I owe money send me proof -- I'm not going to give anyone any  of  my hard money without first finding out if it is actually owed.  How hard is that --------send me proof -- not threaten me which is against the law

I am so glad I was able to find this site my husband took the message that I was going to be sued because I took out a payday loan and I have never took any kind of loan out. they told him they would be sending someone out to my house in the next couple of days. But them I get a phone call this morning and they have been calling non stop ever since. I'm posting because so many others have and I'm grateful for the support I found when I first got blindsided by these scam artists.

I was contacted by an Anthony Cicero via email telling me I was going to get sued but that Samuel Sole and Associates was willing to work out options by calling them immediately. They hunted down my parents as well as my employer and left horrible messages. Guess they were just too cowardly to call me outright. or maybe since this is my millionth run in with these fraudulent firms my name is blacklisted because I know the laws and end up out Heroding Herod when they do call. I've had several ask me to not ever call them again.

My advice is file a formal complaint with the New York State Attorney General's office and with the one for your state as well, file complaints with the fair trade commission and the the FBIs white collar crime division. Then talk to your boss, family, friends, whoever they are making you look like a lowlife loser with - let them know you are being victimized. Several states have prosecuted these kind of firms and won and more states are following suit. That's why it's important to file complaints. And above all do not worry they aren't coming to get you they can do nothing but harass you. Be a bigger pain in the a** back. Tell them to serve you and your attorney is eager to take their deposition. That works well on calls I've found they usually go silent and hang up. If they know you are not a sucker they can squeeze for money they will move on.

Lastly the comedic part of the disclaimer at the bottom of the email I got sounded all officious until the part of if you got this in error reply by return email or call me (you may call collect)... What kind of law firm refers to themselves as "me" or says you can call a toll free number "collect"? Hope this helps someone as much as you all have helped me. Peace and much love.

855-654-8305. They left a vm for me, with a man with a name of Wayne Jackson.  I saved the vm. He siad that he was a process server in the state of Washington yet the company linked to the 855 number is in NY.   I guess they think the majority of the people who obtain payday loans are unintelligent and don't know the debt laws.  

First off; you can't be a NY DEBT COLLECTOR and sue me. I would be sued by a legit law firm.  Samuel Sole & Associates?  Cute how they want to be seen as a possible law firm, huh?  They use a law firm sounding company name and then employ people to claim they are process serverse who are going to serve you that same day by 5pm if you don't call 855-654-8305?  WHAT A JOKE!

I have their voicemails to me recorded in addition to a friend of mine who called them and got them to admit they are NOT a law firm yet they HIRE process servers?  Why would a debt collector hire a process server?  Not to mention the case # they give is no where near a LEGIT actual court case number.

Do yourself a favor.  Call up any NY court or look up online how many lawsuits have been filed by Samuel Sole & Associates.  NOT ANY!!!
