They're now ringing the UK, I've had 4 calls from this number today on my mobile phone, I never answer calls unless I know who's calling me and I just reject the call as soon as it comes through. Pain in the proverbial they are!

Ok everyone......I have new information these frauds. I've done extensive research on them, and I've had my attorney's office to research on them as well (I was fully prepared to initiate a full FDCPA Violations  Suit).

The bottom line? THESE PEOPLE ARE FRAUDS!! This is NOT a legitimate debt collection agency, they aren't legitimate collectors, and they are out to STEAL your money. Here's the information that I have discovered how they operate:

1) First stage of the process is to try and scare you into calling in to them by having a fake "process server" call you and threaten to serve you legal papers for court. The one that called me used the nae "Randy Snyder" and he calls from a "394" area code which research shows as an invalid area code. This is the first part of the scam, as most people aren't aware of their rights, and therefore do not know that this practice is HIGHLY ILLEGAL.

Also, just so everyone here knows and is informed. A TRUE process server will NEVER give you advance notice that he/she is about to show up. This is counterproductive to getting their job done in a timely manner b/c anyone that knows its coming will avoid the process server.

2) They give you a number and a "case number" (another ploy to scare the caller/victim) into believing their scam is real. This phone number is to the scam collectors that try to scam you into believing they are collecting for an old payday loan you had or didn't have. They use the following scam tacrics to get you to agree to pay them on a phony debt:

- They say they are "A legal outsourcing company" thats designed to act as a "mediator" between you and the people that are supposedly going to sue you in court for "Bank fraud". They'll tell you its both a criminal and a civil matter and in order to avoid it, you will need to pay them!

First off, lets make this clear: YOU CAN NEVER BE PROSECUTED CRIMINALLY FOR A DEBT....EVER!!! They make it seem like b/c they are a "legal outsourcing company" that they are able to do this, and that they are immune to regular collection laws. THIS IS 100% UNTRUE!

- When you ask for basic information that you have the right to have (things such as their address, a validation letter validating the debt, etc) they'll get loud and rude with you. They'll say "I'll just let you tell it to the judge" and hang up on you. This is because they are a scam, and cannot provide this information to you.

- When they DO cave in to giving you an address, they give you the following phony address:

Smart people will immediatly google the address and see where its at and if the address exists. The building exists, but theres no 10th floor, and a phone call to the management company for the building proves no such suite exists, and no collection agency occupies any space in the building.  

HERE'S THE LOW DOWN AND DIRTY TRUTH:

1) They are a scam - They use the name of a legitimate collection agency (Clear Credit Solutions) but once myself + my attorney made calls to the actual company, they verified a different address than what was given by the scammers.

2) You can NEVER be prosecuted for a debt, ever! No law exists that allows for ANYONE to persue to criminally for a debt....no matter who they are and what kind of company they claim to be...including "legal outsourcing" companies.

3) ANYONE trying to collect money for a debt (No matter who or what kinda company they are) are bound by the laws under the FDCPA. Anyone that tells you otherwise is a scammer....bottom line.

4) DO NOT give them any information. Hang up on them immediatly and contact your local FTC and attorney general's office to file charges. RECORD ALL CONVERSATIONS so this can be used against the scammers in criminal court.

Names that these scammers use:

- Valerie Nixon - The scam collector that tries to tell you that you will be prosecuted criminally if you dont pay.

- Steve Johnson - The scammer that answers the phone as "Legal Outsourcing Dept" , and tries to collect personal information on you before "transferring" you to the scam collector above

- Byron - Another person like "Steve Johnson" above

- Randy Snyder - A bogus "Process Server" that baits the victims into calling the scammers

Use this information and feel free to spread it all over the internet. Knowledge is power folks!

Funny how you qualify your actions. True, there are some people who got into debt and used a legal means (bankruptcy) to clean their slate, yet you still pursue these folks after 25 years. How do you explain that? How about buying old debt that has been written off years ago? You pay pennies and harass the folks that have gone through the hardship for one reason or another, struggled to rebuild their credit and you call yourself a professional. Prostitutes also call themselves professionals.

I have not received a call from this number, but they are calling my Grandmother! It's a recording asking if you know *my name* hit !. If you do not know *my name* hit 2.  She will not press any numbers for fear of an electronic scam, but does say "No" and hangs up. As several others have stated, I do not/nor have I ever had an account with Time Warner.

Do not answer this phone call.  The (855) charges the consumer instead of the company calling.  The charge is anywhere from $1.99 to $2.99 per call.  Look it up.

This number calls for a tenant we had here when we rented our home to tenants for a year while we worked out of town.  We have told them repeatedly that he no longer lives in this house (and in fact, this wasn't even his phone number - they've found it based upon the debtor's old, address I guess).  I blocked the number, but our phone rings once before the call is terminated.  I'm tempted to unblock it so I can threaten a lawsuit.  Seriously annoying to me and my husband who have NO debt or unpaid bills.  Any causal surface investigation on the collection agency's part would, I am certain, reveal addresses the debtor has since had, and phone numbers attached. Sheer laziness on their part, and a waste of everyone's time.

Why don't you call the Federal Trade Commission and tell them what your are doing. I have no issue with paying my debt. However, I refuse to deal with collection agencies. We had a business that failed several years ago and it left us financially devastated. Even though I could have I did not file for bankruptcy because I did not feel right about it. My reward from collection agencies was to be called stupid, threatened, and lied to. Because of these unethical individuals, I refuse to deal with collection agents. It is the lowest form of legal employment.

Want to know how to stop them? The next time they call, inform them they are violating the TCPA and FDCPA by INTENTIONALLY harassing a non-debtor and you will take legal action against them if the calls do not stop. This consumer did against NCO Financial---and won:

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.  

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

So what can you do if you receive "wrong number" calls from debt collectors?

1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

I am getting freakin' tired of these idiots calling my home.  My ex sister-in-law, who is a low life scum and deserves to go to jail for defrauding the government, grand theft, and probably a long list of other unknowns apparently has a debt for Charter Communications.  These idiots see the same last name, call my house constantly, yet everytime I try to get a live body on the phone I get "Call back during normal office hours".  Well it was 1:50pm Saturday here, they say they are open 8am-5pm on Saturdays, yet nobody answers the phone.  

I know a tiny bit about debt collections as I had a client who had a debt collection business.  But I don't think they are using legitimate tactics here as my phone number, even my business phone number, get calls for her debts.  She has never lived here, never been associated with my phone numbers, probably doesn't even have my business number, yet I still get harrassed, almost daily, at least 4-5 days a week, with debt collectors because of her.

What recourse do I have against these debt collectors if they are harrassing me with a computer dialing program when I have, literally, nothing to do with these debt collections?

When I do get a live body on the phone lines from these collectors, I provide them all known phone numbers she is associated with and ask to have my number removed from their lists, but I think they ignore that 99% of the time.  As soon as I let them know she doesn't and has never lived here, they just hang up on me.

What I do know, is the majority of the debt collectors that make the calls are scumbags.  As I said above, I had a client that did this, he had about 50 employees.  Every one of those employees lied, used fake names, offered false information, made phoeny threats, etc.  I would periodically go upstairs at the office and listen to them talk to debtors.  "Let me put you on hold and talk to the case manager"...they put them on hold, smoked a cigarette, chatted with office mates, etc., came back on with a phoeny story about "they said they can do this for you, but only if you act right now or else they are going to serve you notice to appear in court" etc.  They never served papers, they never talked to a "case manager", most times if they put on their "supervisor" or "manager" it was them talking in a different voice with another false name.

What did they get out of the collection?  I think it was 30% commission on whatever was collected.  That is why they are a pain in the A$$ and also why when they find they have a bad number they don't really give a crap, all they know is they aren't making any money on that call.

The Do Not Call Registry was made permanent a few years back.  No need to re-register unless you change phone numbers.   If you ever choose to opt out you would have to call them.  Otherwise,  you're there as long as the FTC maintains the list.

Mr. Johnson, very impressive that you make over 60K calling wrong numbers!  I like that fact that you believe that calling people with no debt, or pay their bills on time, like me, are receiving these calls and should not complain about the inconvenience of having to drop everything to listen to a recording meant for someone else.  All I can say to you is - UPDATE YOUR CALLING LISTS and earn all of that money you make!  Also, maybe you are unable to feel empathy for those who are down on their luck, but it does you no favors to post your condescending comments about people who are already experiencing something they never expected to go through.  It's something I hope to never go through myself - now you, and I understand that your job is not an easy one, but I believe you need to feel the pain to bring a little understanding for others into your life.
