This company has left four or five "FINAL ATTEMPTS" to have me served. They say after the third attempt they will tell the judge they could not serve you because you didnt cooperate. That wont work cause you can only be sued if they can serve you. But I digress so... They never tell you the name of the company. There number comes up "Unknown". They never leave a number where they can be reached but direct you to return the call to the "Processing Center". They leave a bogus case number which is really just there file number. When you do call back you don't get the "Processing Center" instead you get the "Corporate Office" (strange). But the receptionist could tell me nothing about the company other than the name (which I had to literally ask for), the address and the fax number (she put me on hold to find it so she says). After speaking to a rep today, I was immediatedly hung up on for not supplying the last four of my social.
Why would I verify that. He did not give me the Mini-Miranda which is the first thing a collection agency would do. There was no recording while I was waiting for a rep to come to the phone. He did not explain to me why he needed my social. There are about 5 different things he could have asked for. Instead he hung up on me. Now I did not have any attitude cause today I was on a fact finding mission. \
Getting know other info from the source I searched the internet. I did find their rating with the BBB, which was an "F", six complaints, and know responses if I read it correctly. Tell your friends about this rundown of a scam. I called the Attorney General's office in Florida today and emailed the AG.

Your story still makes no sense. If you got out of prison and were worried about your debts, you'd simply call your lenders after you got out. If you received a call from a collector before you could call your lenders, why don't you return the call to the collector instead of posting on 800notes? How can posting on 800notes possibly further your goal of paying your debts?

You want to play comment parsing? Let's dance.

} "I got a message yesterday.

That's it? Was it for you? Was it about a debt account someone thinks you owe?

} "I am set on paying my debt.

How nice. This has what to do with your phone call and the current topic?

} "My brother was sued by Chase."

Repeat: This has what to do with your phone call and the current topic?

You then imply that everyone who complains about the collection agency is a liar, and berate complainers as irresponsible. You have a bunch of nonsequiturs followed by some fairly typical bullying suppositions seen commonly in threads for suspect debt collectors. That's why you don't make sense if you're here to make a rational argument.

You don't need to be a debtor or a litigant to understand rules of civil procedure, or to read what collections laws say. Nor can a person from any background miss the pattern of deception in the original post once a little time is spent reviewing forum threads on junky debt collectors. "RS" breathes not a word about the validity of the debt claim or raising any defense, but only drags on about shame and cost and absurdly suggests that "they own the account so they must be right". That's another moment of "makes no sense", unless the object is to confuse and frighten readers.

My post makes no sense to you because you have deliberately taken it out of context and proceeded to claim your twisted interpretation of what I had intended "makes no sense." What has "obviously we all are worried about this or we wouldn't have searched the number" got to do with "why did you not pay your debts when they were due but waited for a call from a fake collector?" Precisely nothing. And fake collector as one who violates section 809 of the FDCPA and other consumer protection laws, maybe I should have used "scammer collector" instead? Today is Sunday and I guess the shills are away from work and hence away from their scamming terminals.

"Professional Debtor" is a polite term for "lying deadbeat who is allergic to hard work". Learning your rights does not equal being a welfare queen. Forewarning means you can't be suckered by hostile and lawbreaking debt collectors.

Simply paying up to shut up is not wise. There is little to keep a suspect collection agency from claiming they never got your money, or demanding more than agreed, welching on a payment plan, reselling any "forgiven" portions, or combinations of the above. For under six dollars you can send a proper dispute and revoke call permission on paper, sent USPS Certified, and preserve all your rights besides. Anyone at your workplace could have barred collection calls there from day one. But hey, do what you like Bill .... er, Lynn.

"We are all worried" for different reasons. The shills in this thread worry that the collector's cheap scare tactics will be less effective because others are worried enough to debunk that collector and its shills.

The initial post is a bogus song we have heard a hundred times before: "I ignored them and now I'm in bigger trouble and I should have paid in full like a good debtor when I had the chance." The other variant whines "I should never have believed all those bad things people said about the agency", or else cops a furious tone and blames debunkers for leading everyone astray. Of course they all come running to a mystery call site to tell us about their woes, even though ostensibly they already have all the contact data they need from their new best friends at the collection agency.

Debt lawsuits don't just drop from the sky. They follow weeks of calls and/or letters which the consumer can dispute. Real process servers do not make appointments, nor do they act as debt collectors. This Lincoln Legal reportedly makes false threats of litigation and arrest, making them serious FDCPA violators. Don't suppose you can lecture us about being "responsible" while yet another bullying collection agency tries to deny people's rights.

Oh, and this outfit is headquartered in Clearwater, Florida, arguably the scam capital of the southeastern US, where the "Heather" and "Rachel" debt reprice scam calls were first made popular.

I'm not a professional debtor like anonymous, but I do know that you can be sued in civil court for the debt. Not saying it will be from this company but being in car sales I have seen civil records on credit reports where some people were sued by credit companies. I going to pay these people so they wont call my job again and talk to my boss. That's something I'd like to avoid from happening again

Your post makes no sense. Real debtors live with the constant threat of lawsuits and can be served anywhere -- at work, at home, at church, whatever -- and suffer embarrassment so there is really no point posting about this as real debtors already know this. Only REALLY STUPID process servers will call up debtors to tell them where they will be served (debtors can run away!). Real process servers will NEVER call. Which makes your post a scammer shill post.

Legit collectors per section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf *must* tell debtors at initial contact, or send debtors paperwork within 5 days of initial contact, the following:
1. $amount of debt,
2. name of the current creditor (which may differ from the original creditor who might have sold debtors' debt),
3. a statement that that debt will be assumed to be valid unless debtors dispute in writing within 30 days,
4. a statement that that if debtors do dispute in writing within 30 days, the collector must mail debtors written verification of the debt,
5. a statement that if debtors ask collectors in writing within 30 days, collectors must send debtors the name and address of the original creditor if it's different from the current creditor.
If you don't get the above 5 items, then it is likely an abusive collector who's breaking the law or a scammer.

If you would have been responsible you would not be in the predicament.

6 months ago I received a few calls from a process server saying they were going to serve me at my home or job. I called the number on the voice mail 1-855-674-1293 and they put me into contact with the attorney agent for my case. He says its a lawsuit from a delinquent credit card that has been retained by them. I was scared it was a scam so I hung up and ignored it. The process server winded up coming to my job and I had to sign a summons right in front of my boss. What an embarrassment it was!  I went to civil court months later and the legal fees were 2x what the original account balance was. The judge ordered me to payments and now they garnish my wages. Sad thing is I could of settled out of court for the original balance and saved myself a whole bunch of time, money, and trouble. I followed the paper trail in my discovery and it turns out that they legally owned the account. I should of just paid my bills on time and I wouldn't even be in this situation.
