Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

Guy left several voicemails threatening my sister "Officially" Notifying her that she is being served.  Left a case number and contact number of the above listed number.   Told her we were estranged but he had my number listed as her contact number.   I could hear a girl in the background making snarky remarks like, "Well that's where he address is listed", and calling me a liar in the back ground.  My sister and I are recently estranged and I could care less if she is summoned to court or not but they weren't asking for money or anything like that.   I told my sister about it and she got pissed and told me it was a scam.

Keeps calling. Man named Troy Matthews threatening to come to my home or work to serve me papers. Call the company back who is the RH company, state they don't know Troy Matthews. I'm sick of this they even called a family member looking for me! How did they get my info!

Thanks for posting BW...makes one feel as if you aren't crazy when other people share their experiences with this scam.    Sarah Price was back at it again today.  Same pissy voice be even more menacing.  I have Lifelock and have been reporting the instances of her calls.  Their advice is to keep on doing the ignore bit and to even go a step further in having the phone company blocking numbers marked 'Unknown'  And yes, as stated earlier in this thread, know the Fair Debt Practices act.... Lifelock stated the same information, that there would be more communication from a creditor before it even gets this far let alone being served with process papers.

First of all: Use common sense. Please. You should already be aware of the debts you owe to various debtors, and the names of those companies or collection agencies. Any debtors/collectors you've been working with will give you more than adequate warning that your state of affairs with them is headed so far downhill that it will result in legal action. Any companies you feel may be headed in that direction, call them directly, using the phone number on the company website or your account statement, to discuss it with them.

I had the same thing happen to me as many others have already said. They called my cell phone and the number came through as Unknown.  I received a voice mail from a snotty, pissed-off sounding woman telling me that I had ONE opportunity to contact the plaintiff in some sort of lawsuit I was charged with (no details of course) and a fake case number. She ended with the line "you have been SERVED" and I half expected her to say "respect my authoritah!" like Cartman from South Park. I mean seriously. Go get a life - and a real job.

They called back almost as soon as I heard the voicemail, and since I'm at work where saying what I really want to say to people like this would get me fired, I answered and just held down one of the number buttons on the phone until they hung up (it didn't take long). I'd hope I injured their eardrum, but I don't get that lucky.

Please don't fall for crap like this. This is the phone call version of those emails everyone gets about Nigerian royalty leaving them 7 billion dollars in their will. These worthless a-holes prey on people that they see as desperate or gullible due to debt and lack of resources, and use any scare tactic they can think of to intimidate you because they would rather take the money you worked for than work for their own.

A friend of mine got a call about me that I owed a debt and the guys name was Paul Lewis. He sd he was a Duluth State Process Server, Duluth Dist Ofc. He gave a court id#, and told her that I was pending charges and they were trying to serve me papers. He asked her all kinds of personal information about me. Of course she was smart enough not to give it out. I called the company back and asked questions about who they were and was told that if I didn't know who I was calling and didn't have a case # then they couldn't help me.
This is a rip off agency trying to get you to pay.
*****PLEASE know your rights under the Fair Debt Collections Act***** Notify your states Attorney General and the FTC of these calls, and NEVER pay then without have them send you papers from the original creditor in writing. I PROMISE they can't provide that

This is a collection agency. They are threatening you and these are IDOL threats, because they have no basis and they purchased the debt from companies such as Pay day loans, Small loan companies, online loan companies. As the DD said Hang up on them, they cant do anything to you! Just continue to harass you and call, so I blocked them from calling me.

A woman who says she is Daisy XXX ( I forget her last name) called me this morning. She said she is looking for Mirial. She emphasized several times that I live with Mirial, and I DON'T KNOW this person at all!! This woman has an African American's accent. The same, she gave a number 855-707-1495 and asked me to call this number to find Mirial. Also came up with a case number 2250651060.

Same deal, a phone call left on my voicemail at work and it came through on my cell as unknown.
Sarah Price, called and said there was a complaint and a summons has been issued at her office.  I am up to date on all bills, no loans outside of the car loan .... did have an identity theft issue back in February of 2012...and what was listed here for ftc practices and the attorney general's office is what I followed.  I am also a member of LifeLock.  But Ms. Price ended the rather terse voicemail with the lines 'you have been served'... really?  Not according to FTC fair debt practices... scam  all the way.  855-707-1495 is the number she said her 'plaintiff' can be reached at.

I recd a call from this # and i spoke with them. I told them I did not recognize the creditor info and I requested an email with my loan info. She refused. I then asked her how did she expect to pay for this if she would not forward the info to me. She kept insisting that I talk to her and throwing around threats of legal action. Finally i told her that I would contact the police because I don't recall taking out a loan in Dec2011. At that point she got real nasty and told me that there was no point in contacting the police. When I told her that it was a legal matter and I had the right to contact the police, an atty and I had a right to the loan paperwork. She hung up. ***THIS IS A SCAM***

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or

If you think that a caller may be a fake debt collector:

?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

My wife received at call from R A Group and the man told her that if she did not pay today, she was going to be arrested. He threaten that if we did not pay we would have to take a week off from work just to fly to Indiana to see the judge. he also said the if we did not pay right now that would have to othe fees instead of paying 707.09 dollars. I asked what was the name of the court and phone number, but he couldn't tell me.  He had also told her that cops were on their way to arrest her. I called my local police department and was told that it was a scam.

Someone from a blocked number called me by the name of scott cain and left a message for me to call this number when I call the number back I spoke with Jan Valo.  She stated that I owe money and when I was trying to get information in regards to the company she just kept telling me that I don't pay by today I would have to go to court so I told her I will call her back when I call back nothing not even voice mail. I received the same call. When I called the number a gentle man tired getting nasty with me and I informed him I had done research on his company and asked if they had a web site and he said no. I asked what company that is big as you are describing does not have a website. I informed him I was contacting my lawyer and let her know people from RH Group are impersonating a government official. I asked the guy who called first if he was with the state and he said yes. I asked what state and he stumbled all over his words until I said North Carolina. Then yeah I am with the state of North Carolina. Crooks. I told him I would not send them any money and would contact the company I am suppose to owe and he said they can not speak to me. Yeah ok, if I owe money why will they not speak with me to get it paid.

Received two calls from a Sara Price advised a summons has been faxed to her office regarding a legal matter and I am to call 855-707-1495 and give them my reference number.   The calls came across land line as UNKNOWN and across my cell phone as BLOCKED. She also stating on voice mail that this call serves as a legal notice that I have been notified.

I called this number that was left back and all I get is a fast busy signal.  I say this is a scam.
