Sorry, meant to add after reading the entire thread, I was told that this call is being recorded, so I replied that I would be recording as well, that was met with another disconnect. Which to me means that they want to use what you say against you but don't want others to know exactly what they say, this has happened appx 12 times, as I was receiving appx 3-4 calls a day even on Sundays which I though was wrong as well as the early am and late night calls that have gone on. Too bad we can't start a class action against these nasty, threatening people that don't care who they're harassing, as I am not one of their debtors....thankfully! Sorry for those that may be for they would never get any peace. However, as much grief as they have caused me I think they should be paying me and the rest of us they call. I know, never happen just am sick and tired of this garbage.

They have called my house for months never ask for anyone that actually lives here or anyone I know. I have asked them repeatedly to stop they disconnect when I start telling them that. They also disconnect if you start asking them what is your name as I am going to file suit as I am tired of you calling me. The only thing I found that works (for Now) is to put them on call block but now calls have started again from a different number. Same day, different number, same crap.

Mostly incorrect .... Monarch is known for illegal tactics but still considered "legitimate" and able to force people to court for debt claims. Dunning letters can safely be sent by plain old First Class. The consumer's written replies, however, should be via Certified with return card to best preserve FDCPA rights.

You think "contact is never made over the phone"?! Have you not seen another collector thread on this or any other mystery call site? The telephone is a collector's primary weapon and perfectly legal within statutory boundaries, absent instructions from a call recipient to limit or cease the calls.

People...they will continue to call you no matter what...they are debt collectors from the scum sucking bottom of the collection pool..meaning, this debt whether yours or not has been floating around forever and they are the 10th in line to buy it and try and collect before its due to come off the credit report..DO NOT answer your phone if you dont know the number....they call me...I never answer, I reject the call etc...they will eventually go away...if you speak to them..it triggers them to keep calling because they know you will pick up...regardless if you tell them you are not who they are looking for...they think you are lying or they just dont care.....don't speak to them or give them the time of day...they eventually will be tired of listening to your voicemail message

I get a phone call every single morning about the same time from this number. I know it is a collection agency, However they are looking for some one I do not know. I called twice and let them know, however these call continue, every single morning and now when I answer, it no longer offers me a option to 'press 1 if this is or isnt you'. I got a call from this number at 7:30 this morning. He asked if I was Kevin and I said... before I give you any information I want to know who this is and why your calling me at 7:30 in the morning. He said If I'm Kevin then I SHOULD KNOW THE INFORMATION HE WAS ASKING ME. These extremely rude people keep calling for a male named John on my cell phone.  I have informed them that they have a wrong number and they continue to harass me. Apparently they are looking for someone that has a name similar to my husband's name. We have no outstanding debts.  They have asked for personal information and I have refused to provide it. Never give any information over the phone.  If they are unprofessional (rude, using inappropriate language), that's an excellent clue that they are not legit.  Hang up.  If you have caller ID and you see its them, don't answer.

MRM is not a legit collection agency.  They are looking for someone to give too much info over the phone.  They are looking to conduct a scam.  If you are being persued by a collection agency, you should receive a certified letter.  Contact is never made over the phone.

Concluding a case that drew the largest civil penalty ever imposed on a debt collection business, the Federal Trade Commission settled with the two remaining individual defendants who allegedly misled, threatened, and harassed consumers; disclosed their debts to third parties; and deposited postdated checks early, in violation of federal law.

The settlement order requires each of these senior managers to pay a civil penalty and bars them from future violations.

?The FTC wants to remind debt collectors of their responsibilities and obligations under the law.

Abusive collection actions are illegal, and if debt collectors use abusive tactics they could face legal action,? said David Vladeck, Director of the FTC?s Bureau of Consumer Protection

?At the same time, we want consumers to understand their rights if their debts go into collection.

Money matters, and the more people know about managing their debt and dealing with debt collectors, the better off they will be

? According to the FTC?s complaint, filed by the Department of Justice on the FTC?s behalf, the defendants participated in, or controlled, the actions of debt collectors whose unlawful practices included false or deceptive threats of garnishment, arrest, and legal action; improper calls to consumers; frequent, harassing, threatening, and abusive calls; and unfair and unauthorized withdrawals from consumers? bank accounts.

The complaint also alleged that the defendants failed to adequately investigate consumer complaints or discipline collectors, and collectors who were terminated for violating the Fair Debt Collection Practices Act (FDCPA) often were rehired within a few months.

In 2008, Academy Collection Service, Inc. and its owner, Keith Dickstein, paid $2.25 million to settle FTC charges that Academy collectors violated the FTC Act and the FDCPA while collecting debts, and that Dickstein failed to stop the violations.

The settlement order announced today, negotiated by DOJ and the FTC, imposed civil penalties of $375,000 and $300,000, respectively, on Albert S. Bastian and Keith L. Hurt III, who oversaw Academy?s Las Vegas collection center.

The judgments were suspended upon payment of $7,500 each, based on their ability to pay. The full judgments will become due immediately if the defendants are found to have misrepresented their financial condition.

The order bars Bastian and Hurt from making false, deceptive, or misleading representations in debt collection efforts, such as that nonpayment will result in garnishment of wages, seizure of property, or lawsuits, or that they or their agents are attorneys.

They also are prohibited from withdrawing money from consumers? bank accounts without their express informed consent, and from depositing or threatening to deposit postdated checks before the date on the check.

In addition, the pair are barred from improperly communicating with third parties about a debt; communicating with a consumer at any unusual time or place; and harassing, oppressing, or abusing any person in connection with debt collection.

The Commission vote to authorize DOJ to file the consent decree was 4-0. The consent decree was entered in the U.S. District Court for the District of Nevada.
