Debt Collector
I used to be a Collections Manager at a Software Company collecting on Business to Business Debts.  First and Foremost, educate yourself regarding the Fair Debt Collections Practices Act.  Some of the basic info:

The company has to announce that they are a debt collection company and that they are attempting to collect a debt.

If the debt is not valid or  you think it is in error, you have to right to dispute it.  If you choose to dispute the debt, the company has to provide you with written proof of the debt and the original signed documents proving the debts existence.  A simple letter written on their stationary is not proof in the eyes of the court. If they can not provide proof, they have no legal claim.  Normally you have 30 days upon receipt of the documents to respond.  Check your records thoroughly.  Our credit reporting system has tons of errors and wrong information, and unfortunately the responsibility resides with we, the consumers, to check the validity of our reports.

They can not disclose the nature of the debt to anyone besides you (an anyone the may have co-signed) and your attorney if you have legal council.  They can not tell your family, employers, ANYONE the details as to why they are trying to talk to you unless you authorize it.

Know the statue of limitations for debt in the state in which the debt occurred.  There are a number of debt collection companies that purchase old debt for pennies on the dollar.  (By the way, the statue of limitations differs state to state and is NOT the same standards as the credit reporting agencies).

Harassment.
Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
use threats of violence or harm;
publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
use obscene or profane language; or
repeatedly use the phone to annoy someone.

False statements.
Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
falsely claim that they are attorneys or government representatives;
falsely claim that you have committed a crime;
falsely represent that they operate or work for a credit reporting company;
misrepresent the amount you owe;
indicate that papers they send you are legal forms if they aren?t; or
indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
you will be arrested if you don?t pay your debt;
they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
give false credit information about you to anyone, including a credit reporting company;
send you anything that looks like an official document from a court or government agency if it isn?t; or
use a false company name.

Unfair practices.
Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
deposit a post-dated check early;
take or threaten to take your property unless it can be done legally; or
contact you by postcard.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (naag.org) and the Federal Trade Commission (ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

Now, keep in mind, the above information is for the more unscrupulous types of collections companies.

If you do owe the debt, a valid collection agency will allow you to make arrangements to settle the debt.  They are not violating your rights, they are just trying to collect on what is owed.  Please take my advice and make payment arrangements that you can handle. Do not promise the moon if you wont be able to pay your other bills.  Also, if you have truly been served legal documents, do not ignore them.  I suggest getting an attorney to make sure that your are properly represented.

Hope this information helps.

These people are getting on my nerves. They have called my job twice and at my job it has to go through 2 other people before the call gets to me. One of those people is my BOSS. So you can imagine how upset I am right now that these scam callers are calling me. Its embarrassing and I can't wait to get home so I can call them and curse them out. I bet they will stop calling then.

I received a call today , acted like they had called me before.  Only said my first name said this is "Investigator James Stone" contact me at 1-866-575-4903 x-206 call immediately.  How many people honestly would call back a "scam" call like this.  First of all how do they get our phone numbers and why do the never stop calling.  If it is the REAL DEAL, they would give you more information, if they REALLY needed to talk to you about something of importance.

Yep. These people are slime. They are absolute scum. Now they are are calling themselves "detectives". I am also documenting every time they call as well. Some of my good friends work in the State House here and I have contacted them and I have a meeting with our attorney general deputy to investigate this "company". It looks like we might be able to file criminal charges against them.  I am taking affidavits from my workers every time they call. Dont allow them to intimidate you or harass you. By law, they can not.
