This company has called using at least 5 different phone numbers and they claim I owe them money.  I have blocked all of the numbers but they just call again using a new number.  I pick up the phone but do not speak and a recording comes on about a debt I owe, which I do not, so I just hang up.  They call every day and its been going on for almost 6 months.  They have never verified in writing what this is about and I found out they want $126 from 1999!!!!  All of this for that little money, UNREAL!!!!!!  I will continue to ignore them as there is nothing on  my credit report and after reading all of this I may call a lawyer. There is no name on the caller ID but they say on our answering machine they are a non-attorney collection agency for Brachfeld Law Group.

I have spoken to so called supervisors and have been assured several times that my number was removed. i used to be on night shift and i would get 3 calls a day for this guy while i was trying to sleep. well this morning i answered and informed them a little more harsh that they had the wrong number and that after 6 years of being told so they needed to fix the problem. the woman was rude and said they just received the guys information today. i pretty much called her a liar in not so many words informed her that for 6 years they have been harrassing me and then hung up. i received another call this evening so i called them back. the woman answered and said "can you hold please." of course at this point i was livid. i said no and started explaining the problem she hung up on me...i think i would like to make a complaint as well and appreciate all the info i am finding here.

yeah they have called my house for 6 years weekly for someone i have never heard of...up until this very week i have respectfully asked them to remove them from their file...I PAY MY BILLS THANK YOU. and yet i am still harrassed.

On June 2, 2011, a man claiming to be an attorney from Brachfield Law Firm by the name of Mr. Harper contacted my husbands cousin (same last name, different first name) looking for my husband.  His cousin did not have our new number yet so he gave Mr. Harper my father-in-laws phone number.  Father-in-law contacted us and told us the number Mr. Harper left with his is 1-866-837-4402 ext. 6181.  I have called several times since June 2, various times during the day and evening & receive an answering service for Mr. Aubrey (we don't know if it's Mr. Harper or Mr. Aubrey trying to contact us!!)  He did not leave a mailing address for the law firm. What disturbs us, is our contact information is updated thru the postal service.  We have unlisted phone numbers b/c we are tired of receiving solicitation calls at 3 am.....regularly!!  If this group is truly legit and needs to inquir about a debt issue, then they need to mail us a letter.  In the past 4 years, our checking account has been hacked into twice.  I will discuss absolutely nothing regarding money to anyone over the phone.

I have been getting calls from this number 866-834-3940 they called my home and 1st told my daiughter that they were MY LAWYER and needed my work number and need to speak to me right away . Well then the calls started at work two messages saying that they were going to contact my supervisor . Well today the called the main number and asked for my supervisor was not in let message that they are going to call back in the am to speak to her . I have this on my answering message I called them andasked for her supervisror and the would not give me anyone I could hear her in the back ground and told the guy to put her on . I told her never to call my work and to stop calling my minor children she said that I should then answere my phone and what lind of mother am I . I have filed a complaint with the FTC but didn't have their name I called back tonight to aske their name and mailing address and they would not give it to me . I was told to call and file withthe state Att. in the morning.

Erica Lynn Brachfeld, a California Attorney at Law (Bar #18063), represents LVNV Funding in filing bogus lawsuits for breaching contracts that do not exist.

As a result of defending myself, I have spent nearly $6,000 in attorney fees and court costs.  Ms. Brachfeld dismissed the lawsuit before we went to trial.

It was her “rental” lawyer that came to a Mandatory Settlement Hearing and told us there was no reason to waste anyone’s time when he approached my attorney and myself as we sat in the hallway of the Superior Court.  He admitted they (LVNV/Brachfeld) had no proof of burden to support the lawsuit.  The “rental” lawyer and my attorney set the trial date as he suggested.  He said it would be an easy “less than an hour” defeat for us should it go to trial, but assured us the case would be most likely be dismissed.  Sure enough, it was.  

It just saddens me to think this woman knowingly and willingly signs these frivolous lawsuits that abuse the system and line her pockets in gold.  I seriously doubt she even reviews the lawsuits she files.  Had she followed proper protocol established by the Federal Trade Commission and showed me the proof I requested upfront it would have saved me a great deal of time, grief and money.  It would have cost less money and stress to give in to her demands, but it was just so entirely wrong.  

LVNV is also at fault here.  However, Ms. Brachfeld is an attorney and she absolutely knows she is abusing the judicial system by assisting companies such as LVNV Funding in what seems to be in the business of contemporary racketeering.

I had sent several certified return receipt requests for validation long before I was served.  All were signed, all were ignored.  Harassment by virtue of phone calls continued even after litigation started, including phone calls to relatives asking them how I was going to handle the lawsuit.  Until then, relatives knew nothing of the suit.  I still have a message from “the Law Office of Erica Brachfeld” on my phone that establishes the "edge" in the tone of voice used to intimidate her victims.

Ms. Brachfeld feeds on the ignorance or weak financial status of her victims, and usually wins her cases by taking advantage and abusing the legal system as she has with me.  I stood up and fought for what was absolute.  However, I do not feel as if a victory was made.  I not only suffer the loss of the cost to defend myself, my credit has also taken a plunge and now it will be my task to get this mark removed from the  three credit scoring agencies.  

I am handicapped in a sense that I can not get a low interest loan because of this scar.  I will have to invest time and money to have it removed.  I am sure this is the last priority of LVNV Funding or Ms. Brachfeld.  In my opinion; they are scum.

I suffered from her conscience disregard of the legal system and actions.  Ms. Brachfeld terminated the case she filed against me because she knew she/her client would be easily defeated, thus they establish the essence of my innocence.  She knew the courts would have sanctioned her and the possibility of damages be rewarded.  She ran like a dog with her tail between her legs.

I don’t believe any reasonable attorney would have filed a lawsuit that had no basis or proof of burden.  She has a host of pending lawsuits against her which implicates to me her dishonesty.  Ms. Brachfeld has violates sacred public trust which bestows the power to file and prosecute legal actions. Ms. Brachfeld is a threat to the judicial system and deserving of the indignation I feel.  She is being fed by dirty hands and she has to know that.

Erica Lynn Brachfeld is profiting from manipulating the judicial system for which I suffered from her maltreatment.  Should a medical doctor act so unprofessional he or she would have to pay a horrific price.  In my research, her father Martin (who works for her) was disbarred, and so should she.

I would love to see a class action lawsuit against Brachfeld & Associates.  They have been calling my house constantly for about a year and a half and harrassing me.  I told them many times the party they are looking for does not live here and not to call my number again. The number they were calling from was an 866 number for Meridian Management Solutions in Texas. When the rude people would call they would say they would say they were from Brachfeld & Associates. They called almost every day and I ended up filing a complaint with the FTC which obviously did no good.  Then I sent them a cease & desist letter via certified mail in January 2010.  After that I started getting a recording from them daily.  Now I am getting calls from a new number, 866-835-1915.  When I answered the phone today there was a recording that said "please hold, your call is important to us".  After listening to this about 4 times I hung up.  I know this law firm has totally violated the FDCPA by continuing to call me.  Erica Brachfeld needs to lose her license and all the rude people who call on her behalf need to be dealt with too.

This particular company has a very bad reputation and track record of scamming people for money. Companies like this that pose as lawyers are fraudulent and need to be prosecuted for illegally calling 3rd parties that are not involved in the said financial affairs.

If the person who is conducting the harassment/collection calls is working for a law practice, they are bound legally to the "FAIR DEBT COLLECTION PRACTICES ACT" that 1st became law 9/20/1977 and was strengthened 7/9/1986. The law states that any law firm that collects 2 or more debts a year is ONLY a debt collector and not a law firm in regards to the said debt. Thereby, a simple cease and desist letter removes this companies abilities to do anything more towards harassment or you can sue and win in court against them.

Brachfield and Associates have hounded me for 3 months. They called my home many times. When I changed number, they recently sent me a summons to my home and said I have 30days to settle. Due to family/health problems, the lawsuit defaulted and they are trying to collect from me for $1000.

I have harrassed by Brachfeld & Associates for over a year with threats of being filed with court papers by the Sherrif for 15 to 16 months. They don't know my addresses they call me at work... they only have a P. O. box for me and their letters say they do not hassel people on the job.  About to years ago the could not even pronounce my name correctly, so I just hung up.  This stuff is so old that there must be a statute of limitation... They threaten and bully, various people call, they are so pathetic, I just laugh in there face and hang up.  I though I had a way to get rid of them when my desk moved and I got a new telepone #, but the person on my old line gave them my new #... that is when the 16 month siege started.  P.S. - put in for the class-action-suit.

Back in 05 I received an app in the mail for a new Aspire Visa Card. It said I would have a initial credit limit of $1000. When the card arrived I activated it and found it only had a limit off $300. so I called Aspire and they said they now longer had the $1000 initial credit limit program so I told them to cancel the card and they said that was fine and they would do it for me. Then 6 months later I received a bill in the mail from them claiming I owed $800 for this card I told them that the card had been canceled, they said they had no record of it being canceled and if I didn’t pay, it was going to collection I asked them to prove this debt was valid but they never sent me any paper work. Then a month later I got a call from Jefferson Capitol who said they now had the account and would like to set up payments I told them that the card was canceled and that Aspire Visa had sold them a bad account. I asked them for supporting documents that proved this was a valid debt. They never sent me anything they did continue to call for about a month, and then I heard nothing for over a year. In 2007 I got a letter from Midland Funding saying they now had the account and the amount was now $1351.99 I called them and told them that the account was canceled and that it didn’t matter how many companies bought the account it wasn't going to make it valid, I asked them to provide me with documents showing it was a valid debt but they never sent any after that I heard nothing so it figured that they had decided not to try and collect. Then on 11/20/08 it was severed papers at my home by Brachfeld and Associates I called the court to find out what was going on they said that Brachfeld had filed on me back in July of 08 and had a hearing on the 28th of September and at that point they had asked for case management which is scheduled for the 29th of January this was a surprise to me because I had never gotten anything for Brachfeld in regard to this account , no phone calls no mail not a thing from them. I called Midland to find out why they had never sent me any supporting documents and why they had turned it over to Brachfeld they refused to tell me anything and said call Brachfeld they now have the account . so I did but no one answered so I left a message for someone to call me back not once but five times and no one called, so on 12/01/08 I sent registered letters to both parties asking for supporting documents I gave them a month to respond but I still yet have to receive anything from them. I filed an answer contact with the courts and asked for a fee wavier because the courts wanted $180 to file the papers. Yesterday I went to court and the judge is allowing me to make payments on the $180 as I was trying to info on Brachfeld and Midland I came across your site I have printed out all then info on your site in regards to these two low life companies and have contacted my local congressman to see if he can look into this for the people of CA because it obvious that these two companies have violated the law and continue to. I would like to know what I options do I have if they don’t show up for the case management hearing. Can I sue them? and also Midland has been reporting this to the bureaus for sometime now I disputed it and on my report it show NO STATUE for this account I’m not sure what that means it also has no dollar amount or credit limit showing it petty much has no info except for Midlands info if Brachfeld doesn’t show for court can I sue to get back my $180 I paid for the filing fees? I checked the court records for my county which is Kern CO CA and Brachfeld has over 890 cases most set for case management I also checked all the surrounding counties and Brachfeld has an average of 675 case in each of these counties please tell all your readers out here in CA to contact their congressman if they ever deal with this Brachfeld she and Midland need to be stopped they are back logging the court system with bogus law suits

keep getting calls at my place of work and have already alerted them to stop calling me at work. calls are harassing and still continue. I have already dealt with any legal actions that have no dealing with them. the staff (Miss Green, in particular) is very rude.

Got a message from both of my neighbors stating that this person called and they asked how they got their numbers and Mr. J Riley Cates said he googled them, wow what balls to do this.  Anyways he said it is very important and urgent that we get ahold of him tonight.  Wow, I am glad I found this online, I called back and didn't get any thing but a fast busy signal the second number I received it was to a Redline recovery service. I have no idea what these people want but I think they are stupid for going to the area neighbors and finding them, calling them and having them come out of their houses in a rain storm to come over and tell us this.  I am going to a lawyer tomorrow and I am going to seek info on these people.  What a**holes!

Rent-A-Lawyer Brenda Lee Kretschman, 50 released letters making statements on her lawyer letterhead stating how they never have proof of any debts they buy and new flunkies Amy Oatmeyer may find herself in deep legal trouble for signing those bogus affidavits (Amy, can you spell perjury? And whose girlfriend are you??) Her statements state she is authorized to make hearsay statements about accounts that were purchased AFTER they defaulted, so anyone with a First American Investment Company suit or credit bureau placement may have a nice legal claim for their lies. (Copies of those letters are on page one of this site).

Based on the number of complaints we receive daily, I speculate that FAIC and their Rent-A-Lawyer Empire is hurting for money and that things will only get worse. The debt buying industry is drying up from too many players, this organization and their members are feeling the wrath of both consumers and the legal industry. To make matters worse, Head Boss Douglas J. MacKinnon reportedly has a big gambling habit, too many toys, loves his women and acts as though the money will never run out. He is working a lot of paper that is old, out of statutes and worthless, however it still brings in money, so he can keep up appearances and his extravagant lifestyle.

Consumer lawyers from across the country are suing them for their brazen disregard for the law and heir incredible stupidity, or is it ignorance? I am of the opinion that many of these players WILL end up in jail, including MacKinnon and several lawyers. The push things too far, they think they won’t get nabbed and they don’t think anyone is watching them. When they do go down, I will publish a LOT of information.

In the meantime it is VERY important that anyone being contacted by their Rent-A-Lawyers, or who find anything on their credit files by First American Investment Co do the following:

-NEVER give them any money, banking or credit card information, you are throwing it away.
-ALWAYS send them a dispute validation notice on every letter or call they make.
-FORWARD any affidavits from First American Investment, we will get it in the right hands.
-DISPUTE anything placed on your credit files with the credit bureaus as…”Not my account.”
-CONTACT us for referral to a local consumer law professional if needed.
-TAPE all of their calls from their collectors (where legal) for use in legal proceedings against them.
-CANCEL any bank drafts, checks or credit card agreements made with them or their collectors.
-LIARS, they lie about me and anyone in the advocacy business, what else would you expect from this trash?
-YOU DO NOT WANT TO BECOME A VICTIM OF THEIR SCAM! DON’T FALL FOR THEIR LIES!!

I'm another one who's been getting calls for someone he's never heard of before.  I'm actually having some fun with this; it's not often I get to rip someone a new anus over the phone with a totally clear conscience.

Told 'em nicely once they had the wrong number.  A few weeks later they called again.  Told 'em more forcefully this time, and they responded by barraging my phone three times in as many days with partial messages about collecting information to resolve a debt.  So I left a message raising Ms Brachfield's Lic #, the specter of the FTC, and the Attorney General's Office; I repeated that I had no idea who they were after and I dared them to call me again.  My letter's cocked and locked.

Macho crap, I know - but I NEVER get to vent any testosterone, and here these punks are with flouresent bullseyes on their foreheads.

If they do call, they're getting my written order to stop, and a copy of the letter with complaint will go to the FTC and the California Attorney General's office.  If they suddenly sprout brains enough to stop calling on their own, I'll drop the matter.

UNLESS this class action gets off the ground.  I'll participate willingly, and I don't care about compensation.  The principle's good enough for me.

It seems that Erica’s father was an attorney until he got caught stealing money from a client. and was ordered by the Bar to take the professional responsibility exam -- and he took it, but he COULD NOT PASS, so they stripped him of his license until he passes.  He could not pass the professional responsibility exam.  Now he runs his daughter's debt collection firm.

Martin Brachfeld stipulated that he did not keep his client informed of significant developments in its case.

I was sued by Brachfield and Associates last year which they are representing Capital One. I started making monthly payments but they started processing three payments at a time from my checking account. After the third time happening I stopped making payments. I don't know if my wages can now be garnished because I stopped making payments. They are so rude and I also got tired of them calling me and harrasing me any way they could. Carlos Villa and Michael Padilla are the ones that I've dealt with. They yell and scream at me and call me during working hours. I don't know what to do after this point. Tried contacting Capital One to complain with no success. Any advice?

I have been receiving calls from Brachfield and Associates and was nervous so immediately started making payments to them.  I asked them to mail be the information in which they were stating that I owed the debt and still have not received anything.  They just recently said that my direct withdrawl came back NSF and when I called our bank it had never hit the bank and if it would of it would of cleared since the money was in there.  I called them back and they would hear what I had to say just wanted a credit card or debit card to pay the payment plus a 50 dollar NSF fee.  CRAZY and RUDE.  I told them I would see them in court.  What should I do?

I have been receiving calls at my employer from Shawn Davis (call back# 866-598-9371 x6002). I have asked repeatedly that he not contact me at work and gave him my home info. I have never received anything in the mail from them and have asked why that is and they have no answer. I asked for thier mailing address and they gave me a PO BOX 421088, Houston TX for thier "client" which is supposedly in my case Capitol 1. I have asked for supervisor's and get hung up on.

Claimed to be a lawyer looking for someone down the street, fought with me about delivering a message. Said it was in the persons best interest to call asap...  Insane ... then called right back me back.. extension 6031

I sued them in Small Claim for violation of the FDCPA. I was awarded 3000.00. They defaulted. I also reported them to the CA Bar and everyone who gets a call from them should do the same.

Just got a call (this is the second one in years) regarding a person who I knew but wish is dead.  I told them that I hoped the person was dead and to stop calling me.  HOpefully that works.  THe number they left on my machine was 866 834 3556 ext 6011 Mr. Thompson.  When I called him back again to find out how he got my number he told me that since I wished the person was dead he had no reason to talk to me and hung up on me again.
