They just did the same thing to me, but my HR mgr wasn't as nice as the other.  They told me Capitol One was suing me. So, I told them to send me the original Statement and Bill from Capitol One. He then goes, but they don't own it, we do. So I go then how is Capitol One suing me? Okay thanks and I hung up. I then let my HR Mgr know to not give them any information about me, they are not the police but an over aggressive Collection Company using illegal methods and that I will have my Attorney friend handle it.

I have received several voice mails over the the past TWO MONTHS and not once has a "uniformed officer" come to my home to serve me coffee, let alone papers! If this was such a "time sensitive" matter, the voice mail ON MY CELL PHONE in July now seems a little silly, doesn't it? I will be making digital recordings of all the voice mails on both my home phone and cell phone and forwarding them as a complaint to the MN  Attorney General. She REALLY doesn't like us being harassed here in MN.
Also, they have the wrong first name anyway, don't know how they got my cell phone number. Not happy about THAT.

Notice in the script, Sarah very carefully words her lies:

"my name is sarah walker i'm with the process service division. this is regarding a complaint that was forwarded to my office.  This case is against xxx. for more information my suggestion would be to call the issuing agent handling the complaint at 866-990-2990.

the case number is xxx.  If there is no contact within three hours, we will dispatch a uniformed officer out to your location for service of the summons and complaint."

Points of interest: no actual mention of courts, law officers, legal proceedings or any other REDLINED words.  This does NOT make them any less culpable...but it shows their interest in avoiding litigation in reponse.  

Advice: definitely file with your state's attorney general a claim of deceptive practices.  If you are in the Great State of Texas, get a lawyer, and take them to task.  The Laws of Texas have wonderful protections for consumers from these practices, and the courts have been sympathetic to the abuse of the victims.  Record EVERYTHING - but be aware of your state's laws in relation to recording calls; if you have to notify, do so under as much cover as you can, but to be admissable, notice must be given.  In Texas...only single party is required, and since you are aware, you can record every word.

That jerk is probably just one of them.  They appear to be making phony posts all over the complaint boards, either claiming to be victims who have been sued, or claiming they were glad they settled. Their other posts also portray complaints as just from "losers" living off the government, pissed that Obama hasn't bailed them out.  Phony posting is just part of this scam.

They just finish calling me again w the same threat. I say again because 2 weeks ago, I got the same call by a Sarah walker and with the same threat but they never sent anyone. This is harassment and it needs to stop.

This just happened to me.  I asked them who they were on the phone and they said they are a legal complaint division.  I asked them what exactly they do and the girl put me on hold.  I hung up.  This is ridiculous and unfair.  Is this real? Am I actually going to be served papers?

so they call my dad and it's all the same old story.  I'm with the sheriff department and were sending a cop out to get you if you don't pay the debit.  The first thing comes to mind is: what county are you in and what state?  so they verify my dads name - yeah we have a similar name - then he ask for the SSN.  My dad turns the tables asking for him to provide the information and he'll verify.  so the dumb @Ss starts giving him my info - I'm thinking how many people has he given my ssn and name to?  I've had a few numbers and a bunch of address' - so of course my dad says No he has the wrong number and that it was me he was looking for.  I wasn't with my dad at the time of the call but wished he would have asked for an address to send the payment because I would love to have my credit magically adjusted in three months when it normally takes six to a year - not really, just curious to see where they are based.  so they tell my dad to have me call them or they are going to send someone to pick me up.  ha ha - then maybe I can pay off all my warrants at that time - hope you picked the right state - county - city - address?  Good luck with that. I think I'm going to play scared and provide them with the info they provided my dad and see what info I can get out of them.  Can you say HIPPA?

Hey I would love to be invovled, they contacted me with the same bull and left a message stating that they will be sending a uniformed officer to my location if I do not call within 3 hours.  It has now been over 4 hours and no "uniformed" officer has shown up.  The second thing about it, is they are looking for my mother not even me, and lastly they discussed the matter with me, so far I count 2 major violations of the FDCPA.

Both of the above posts, on the same day, want you to believe that, even though they are "shady", they "legitimatelly own the debt".  In fact, they both use identical language.

"Wrex" also would have you believe that they not only "bought the debt", but that they got the cell phone number when they "bought the debt", that if you don't "settle" on this alleged debt they "bought" but mysteriously refuse to send ANY documentation on, it will cost you a lot more, including "court and attorney fees" that have not been awarded by any court but are just magically "owed".

Supposedly this appeared on a credit report, and after paying this allegedly delinquent account, his credit score immediately went up so he "can get a new car", even though it was supposedly only marked paid and not even removed.  He also would have you believe that this number is a "process server office".

My brother's wife got a call from a Kevin Johnson from the same Process Server office for me so I called in, spoke to a document filer who wanted to settle on an credit card that I hadn't paid on. They said due to court and attorney fees I'd owe $3,500 but they could settle out of court for $1,700. I was scared so I paid almost $940 over the phone to settle the debt. After I hung up I searched the number and read all types of bad things about this company and though "oh s**t, I just washed $940 down the toilet. But I pulled my credit report and lo and behold they werent' bullshitting that credit card had the same unpaid balance they originally said I charged off but I was still suspicious. I called them back and requested a copy of the letter they said they'd send to the credit bureuas to clear up my credit score they said they couldn't give it to me blah blah blah I was getting really scared now but a few days later the same credit reporting company had a paid in full note next to the credit card and now my credit score increased.

bottom line it looks like they pull some shady bu***hit but they probably legitimately own the debt. now I can get a new car

"they" got your cell # because it came with your debt that they bought. they look like they legitimatelly own the debt but they use illegitamet methods to get it

i got a call on my cell phone tell me i had 2hr to respond or they were taking me to the sheff.office they did not tell me what it was about an i do not no how they got my cell number because i do not give it out

OMG same thing only they did not call my place of employment however I disputed surcharges ...and paid them.  The same story ....this is so bad!! They called me yesterday which was 8/10/2010 with the same story ..left a message on my machine and said that here is a court Cause No. refer to this when calling and call back within 3 hours or we are having Uniformed Officers arrest you.  OK!!  I am getting a lawyer and if I can't find one to handle this I am going to pound the crap out of them ...I am going to go down every legal avenue to stop this ....it is a "Mission" now.  I am sick and tired of this ..not only for myself but for you and others it is against the law .....it is criminal and breaks all the Credit and Collection laws on a Federal level why the heck don't we all band together ....together and fight ...this is a voilation of our rights as consumers ....it is !!

Just did a reverse number search on them (paid for it) and apparently they are using a throw away phone and the company info require some research to find.  Without a business address you cannot send them a cease and desist or report them in any meaningful way to the Attroney General's office but I will keep researching and report back.

"I received a call from an attorney’s office who want to serve you with some documentation.  I told them I would rather have you call them and straighten this rather than coming out to your employment which for some people can be embarrassing.  Please call 866-990-2990 refer to doc. If they don’t hear from you in the next couple of hours they will send a sheriff to serve you the documents."
How embarassing is that. I called back they told me i had a bill from 2004 on a credit card and i was being brought to court after court fees n interest i owed them $5500. If I paid them $700 down and $300 a month for six months they wouldnt bring me to court and i had 24 hours to come up with the money. Then i got a voice mail that night asking what my decision is court or payment. Im not paying and im going to wait to see what happens.
