the BBB info doesnt totally match. the License # in BBB and letter dont match.  also it is illegal in the state of CAL to collect money ahead of time on modificaitons etc....

I got a letter from these folks too. Called them and talked it through. Same deal as all of you above, letter listed my initial loan company who later sold the loan. The fellow I spoke with said they use the courts to pursue a loan modification. I would have to pay $3500 but they have some plans to make the payments. The "package" they send you is 360 pages long. You have to send them last years taxes, a copy of your lender's contract and hardship statements about why you need this. The process takes 90 days according to them and they would be able to get me into a 2% 30 year fixed which basically cuts my mortgage payments in half. He also said you have to make $120,000 or less per year and said never to stop making your mortgage payments.

Miguel here was a bit to salesmany for me, kept asking Now Shannon does this sound like something you would want to do today. Plus, what sounds too good to be true usually is. From reading all your posts, thank you so much! I think if you are truly facing foreclosure and can avoid paying up front this might be worth it to pursue. But I am throwing it away. Sounds very suspicious to me. I have a friend going through this the proper way with a local company and it is a long process and hasn't cost him a dime so far.

Here's another scam for troubled homeowners to avoid: forensic loan audits.

These are the loan-modification industry's latest "phony foreclosure-relief service," in which homeowners pay up-front fees for a forensic review of their lender's practices, but are provided no actual foreclosure relief.

"Forensic loan audits are yet another phony foreclosure-relief service hawked by loan-modification consultants trying to cash in on the desperation of homeowners facing foreclosure," said California Attorney General Edmund G. Brown Jr. "The foreclosure-relief industry continues to be long on promises, but short on results."

Those who offer forensic loan audits use inflated and misleading claims to persuade homeowners to pay up-front fees for services that produce no actual foreclosure relief.

Homeowners are encouraged to pay for an audit of their mortgage loan file to determine their lender's compliance with state and federal mortgage-lending laws. This audit is pitched to homeowners as a tool they can use to gain leverage and speed up the loan-modification process.
In truth, there is no evidence or statistical data to support claims that forensic loan audits -- even if performed by a licensed, legitimate and trained auditor, mortgage professional or lawyer -- will help homeowners get loan modifications or provide any other foreclosure relief.

Already bitten

Jack of San Jose, CA, is among those who claim to have been bitten. "The Mortgage Relief Law Center (MRLC) company cashed my check of $2,795.00 even thought they already know that our application is not qualified at the beginning," he wrote in a complaint to ConsumerAffairs.com. "They knew that we would not able to qualify, but never informed us and let us wait for six months without any status result from the mortgage company.

Finally, after almost seven months hoping, we received a letter from our mortgage company (CitiMortgage), which states that we are not qualified for a loan modification." MRLC, he says, refused his request for a refund.


"The State Bar is committed to dealing with all aspects of loan foreclosure fraud involving attorneys," said State Bar of California President Howard Miller. "We will continue to work with all the other government agencies to prevent fraud and to move for disciplinary sanctions against attorneys who violate their obligations to their clients."


By law, all individuals and businesses offering mortgage-foreclosure consulting, loan-modification and foreclosure-assistance services must register with Brown's office and post a $100,000 bond. It is also illegal for loan-modification consultants and businesses to charge up-front fees for their services.
Brown has sought court orders to shut down more than 30 fraudulent foreclosure-relief companies and has brought criminal charges and obtained lengthy prison sentences for dozens of deceptive loan-modification consultants.

In 2009, California investigated more than 2,000 complaints involving loan-modification scams. Nearly 350 individuals and companies received a Desist and Refrain Order to stop illegal activity.

"The DRE (California Department of Real Estate) has aggressively pursued loan-modification scammers who prey on vulnerable and financially stressed homeowners, and those peddling false hope by promising mortgage relief with a forensic audit will be scrutinized," noted DRE Commissioner Jeff Davi. "With consumer education efforts and warnings, we hope to keep consumers from falling victim in the first place."

Tips to homeowners

As part of the consumer alert, Brown offered the following tips to homeowners:

? Don't pay up-front fees. Foreclosure consultants are prohibited by law from collecting money before services are performed.

? Don't ignore letters from your lender or loan servicer. Responding to those letters is your best bet for saving your house.

? Don't transfer title or sell your house to a "foreclosure rescuer." Beware! This is a scam to convince homeowners they can stay in the home as renters and buy their home back later. It could also be part of a fraudulent bankruptcy filing. Either way, a scammer can then evict you and take your home.

? Don't pay your mortgage payments to anyone other than your lender or loan servicer. Mortgage consultants often keep the money for themselves.

? Never sign any documents without reading them first. Many homeowners think that they are signing documents for a loan modification or for a new loan to pay off their delinquent mortgage. Later, they discover that they actually transferred ownership of their home to someone who is now trying to evict them.

California is not alone in its battle against these loan modification scams. Both the state of Florida and the Federal Trade Commission (FTC) have initiated crackdown on these so-called foreclosure rescue specialists.

Same as everybody else as far as the letter I found in my mail box.  Checked the BBB and the comments seem odd, and very recent.  They have no comments before early December.  I would bet the $800 upfront fee that this is a scam before I would send them any money.  The people you talk to on the phone sound very uneducated and young.
I will not be sending them in moneys!

lawyers are never supposed to make cold calls to drum up business, this is an ethics violation in every U.S. state and any lawyer who violates it can and should get their license revoked.

My husband called this number and thought it was from our lender to assist us in lowering out payment. When I came home my husband was so excited and he said he was told to go out bank for the forms for we can upload the forms on the computer and send in.  THANK GOD I READ THE FINE PRINT!

This company does not use the government "Making Housing Affordable" program to lower your payments - they conduct an audit on your loan to determine if there are any legal violations, which apparently has happened a great deal in the last 10-12 years.  If they find evidence of legal violations in the loan documents, this provides leverage for their attorney to negotiate a mortgage modification to save you money.  Here's a good, detailes explanation: http://iamfacingforeclosure.com/blog/2009/09/ ... ed-demystified/

I recieved a letter that appeared to be from my mortgage lender that I could refinance my mortgage with some pretty incredible terms. But I used to be a personal banker and I have a pretty good idea how the financial network works, especially mortgages. So here is the deal with this company: its not necessarily a scam. They do try to trick you into thinking their letter is from your current lender by listing the name of your mortgage comapany and not listing the name of their company (This is a common trick, there are many others out there). It does say in the fine print that they are not in anyway affiliated with your mortgage lender, so the letter is not illegal. The next thing I discovered was that the amazing terms they offer for a refinance are based on whether or not they can get you approved for the Making Homes Affordable government lending program. It seems this company focuses on just trying to get you qualified for this government program the hitch is though you have to pay them. It seems that if you dont get qualified they give your money back but you have to pay up front to get the process started. So here is the deal you can go strait to the Making Homes Affordable government website to determine if your eligible or not. If you need further counseling please see a free HUD - approved housing counselor. In conclusion yes this company may be legit but after they tried to trick you into calling them in the first place do you really want to put home financing at their mercy? I dont. Just go to any government approved website and they will help you find the proper avenues to get help. Dont let companies like this exploit your financial distress for a profit.

I am in the same boat.  I called and they stated that they will send me a letter of guarantee of the money back if the loan does not go through.  Here is the link to the company as well.  I am concerned that it is a scam, a lot of research will need to be completed to identify if this is the case or not.  I guess we will find out if they are legit or not sooner or later.  If anything you can dispute your cc charge if you do pay for anything.

I recieved a letter, same as everyone else and called their phone line it was hard to hear and had static, there wasn't one time he stated who he was with and he asked how long my mortgage had been with Community Lending, I told him never! I think this is a scam they want $300 upfront and during the modification process want $800 and then $1200, they did say I could make payments and 100% money back if they did not approve your modification, yeah in a perfect world.

I received a letter from these guys with 1-877-215-0981.  So decided to call.  My wife was in the shower and both my kids are sleeping, nothing on tv, nor has my netflix came in today. What do I have to loose?

I picked up the phone to see if they can really lower my payments.  And it sounded pretty good.  Actually, too good to be true.  They stated they had a "100% money back guarantee" and I can cancel any time and get my money back.

So, I asked to see if I can get that notorized.  And the notorized guanrantee letter just came in the mail today.

They may be legit!

this is a scam! I just recieved a letter in the mail and I called the number, I even told him " this sounds too good to be true" and he was like "yeah well we are a legitimate company".  When I asked him if I can meet up in person from the " interview" he said we are located in California and that he doesn't think we want to travel that far. It was also suspicious when I asked him questions considering I'm not even the home owner, he didn't ask me for my name, verify anything so that was a RED FLAG! Ah damn scammers..

I too received this letter, and called to see what they had to say.

First, the individual I spoke with seemed to know what he was talking about.  When I asked the name of the business, he told me it was Christian & Associates with no beating around the bush.

He explained that over 80% of all loans in the last 10 years have had violations, and having had some experience in the industry, I believe him.  Without reviewing my loan, doing a forensic loan audit, he could not be sure whether or not my loan had violations.

There is a fee, based on the amount of the mortgage so it varies.

By showing violations in the mortgage, coupled with the prequalifications set by the government, it seems that Christian & Associates tries wedge a homeowner into the Making Homes Affordable program.

If they fail, you get your money back.

I called this number today: 1-877-215-0981 Mitigation Department

The letter was labeled - RE:[LENDER] Where [LENDER] was my old mortgage lender from a couple of years ago. Since then the load has been picked up by another bank.

The fine print at the bottom does read "nor associated with [LENDER]", but I figured I call as see what this was all about.

Total scam from the moment I spoke with someone. The young woman on the phone didn't seem educated by the way she spoke. She quickly let me know that I was pre-qualified for a 2% fixed rate for 30-years. Sounds great! Then she said I had to pay several thousand dollars up front to get this rate. But they offer payment plans, and can take about $1000 now and some more in two weeks, and so on.

Nah...

BEWARE, this is a scam.

I received a very misleading letter from this company. It appeared to be from the mortgage company that originally did my home loan. However, with some careful questioning when I called, I discovered it was not the mortgage company but instead this "Christian & Associates". The person I spoke to said they were a "forensic loan audit company" and implied that based on the time frame of my loan and the mortgage company they sent me this letter because they believe that there are violations on my loan committed by the mortgage company. I explained my loan had been sold and I wasn't even with the original company and was told it didn't matter that the liability is sold with the loan. I asked if they did this for profit or were a non profit and was told they did this for a fee which would be based upon our income. I am already working with a non profit counselor who I was referred to by the government run website:

So I told him I would speak to my counselor about it and call back if the counselor thought it was a good idea.

I then called the makinghomeaffordable.gov hotline number and was told this is likely a scam. He said anyone needing help can get the same help from non profit companies and that this was likely a for profit company, one of many, praying on people who need help.

Do yourself a favor and call 1-888-995-HOPE instead and get a non profit organization approved by the government program.
