Got a call from this number asking for my brother. I told them he doesn't live with me or live in this state. I asked them how they knew it was my brother since it is a very common name. They wouldn't tell me. The man was very rude and was asking me why I was so defiant and "don't you want to help your brother?". I told them again they don't know it's my brother. When I asked what it was about they said it was paperwork that needed his social security number to verify.

C.R.A./Consumer Recovery Associates/CR & A - they'll say anything to keep you from figuring out it is Consumer Recovery Associates-because if you research CRA you'll find that you should NEVER pay these fools one red cent. IF you have already paid them or have payment arrangements secured you need to call them and cancel them or cancel your checking account so that they can take no more. They've jacked up your principle balance to an amount that you have NEVER owed & told you it was late fees/penalties and interest haven't they? Then they scared you by either using the excuse 1099C IRS filing or a lawsuit, wage garnishments, etc. It's ok to want to settle your debts, and if these fools offered to settle something for me at literally $1000's under what I owed I'd wait til it got sold to a different company because these people don't deserve it. They lie to debtors, threaten lawsuits, threaten to come to their house or place of business, they make people cry and think it's funny, they use racial slurs & curse. I'm telling you, if you have an arrangement set up with them, cancel it NOW. Good luck trying to get through to talk to someone that will actually tell you their name which usually isn't their real name anyway - and then they're going to scream at you when you tell them to cancel the arrangement-might be better to cancel the checking account actually. They're collecting on 1998 to current debt. If your account is in stat they're going to threaten you with a civil lawsuit which they do NOT file which is in violation of FDCPA for threatening you with action that they do not take! If it's out of stat they'll say they're going to file a 1099C IRS filing on the fully inflated principle balance to make it seem like you're going to be responsible for this exorbitant amount of tax.They won't tell you where you've called when you call in, they won't give you a company name, they'll say CRA-it's not an acronym. There's one lady that answered the phone like she was a redneck from hell, yelling into the phone with a gruff voice-CRA we process paperwork, all kinds of paperwork..If you have to hide what you're doing & embarrassed to say what your company does that is a pretty SAD statement. I was told how to deal with this by "someone on the inside" that's been there over a year or so, why she sells herself out like this for a bunch of scumbag junk debt buyers I'll never know.

Got a call from Casey fifteen minutes ago for my son who hasn't lived here for 15 years.  She demanded that he or his attorney return her call within 24 hours or "it would be my fault."  Gave a case number for reference and said he gave this number 2 months ago as a contact number.  Rude, belligerent liar. What an awful way to make a living, even in tough times.

I got call from them and they had my previous last name from like 10 years ago stating I owed 658.00 from a creditor 17 years ago.  I have a pre paid cell phone and asked them how they got my number.  He was real blunt and gave me no answer.  He tried to tell me the IRS is going to take the amount out of my taxes.  I told him they could not do that since this is not a goverment loan or taxes.  He was rude and said I had 24 hours to respond or further legal action will be taken.  For one, I paid this off years ago, and two I did not appreciate the threatening tone in his voice.

BE SURE TO INCLUDE THE URL TO THIS THREAD AS WELL.  I'm quite sure that the AG's will be quite interested in their 1099c scam as well as the IRS.

FACT IS - they cannot validate the debt as yours - so they cannot file 1099c on invalid debt.  Make sure you read and follow the dealing with debt collectors, statute of limitations and recording calls links and demand debt validation certified mail - return receipt.

1-866-857-3916 is one of those irritating numbers that show up on your caller ID that can never seem to be identified.   When you return the call, you get the ominous "Can I help you?" or "Case number please."  They refuse to identify who they are when questioned, will not state they are debt collectors, and by tone imply you have committed some illegal act and are in great trouble or they would not have called you.  It is a violation of FDCPA.  It took quite a bit of research and cunning to discover whom the voices were behind the lawbreaking 866 number were...but it's coming together now and they are without excuse.

Give us your stories on CRA and let's put together some useful information to bring these folks down.  Record their calls where legal and save the tapes for future use.  We'll post 'em here if you have something of interest.

In the meantime, hold them to the law; make them put everything in writing, validate the debt.  Use the cease-communication letter.  Violations of the law should be pointed out to the Virginia Attorney General.

Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.
The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.
Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.
Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
    use threats of violence or harm;
    publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
    use obscene or profane language; or
    repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives;
    falsely claim that you have committed a crime;
    falsely represent that they operate or work for a credit reporting company;
    misrepresent the amount you owe;
    indicate that papers they send you are legal forms if they aren?t; or
    indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
    you will be arrested if you don?t pay your debt;
    they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
    legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
    give false credit information about you to anyone, including a credit reporting company;
    send you anything that looks like an official document from a court or government agency if it isn?t; or
    use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
    try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
    deposit a post-dated check early;
    take or threaten to take your property unless it can be done legally; or
    contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
    Social Security Benefits
    Supplemental Security Income (SSI) Benefits
    Veterans? Benefits
    Civil Service and Federal Retirement and Disability Benefits
    Service Members? Pay
    Military Annuities and Survivors? Benefits
    Student Assistance
    Railroad Retirement Benefits
    Merchant Seamen Wages
    Longshoremen?s and Harbor Workers? Death and Disability Benefits
    Foreign Service Retirement and Disability Benefits
    Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
    Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

Same as all above received a voice mail Stating that I needed to call CR Associates today for to handle a matter. The caller ID was 310-601-7357 with  the callback number of 877-219-4760I called and the lady that answered wanted to know if I was recording the call. I told her no I had it on speaker phone. She said there was too much echo so I turned off the speaker. She then told me I needed to get paper and pencil to take down so very important information as this matter had to be cleared up today. I told her I was outside at work and she told me to go inside. I asked what the matter pretained to, she wouldn't say. Finally she said I have the last four of your Soc Sec Number as and I told that was incorrect. She got rude said well I hope that's right and hung up.
I am aware that collection compamies will contact anyone with the same name(or one that's close) and make them an offer to clear an outstanding bill at a lower price hope to have anyone just pay it. These people must be the bottom rung of the collection ladder.

Clark Howard says to tell 'em to "pound sand!" Even if you really owed the money 10 years ago, it's outside the Statue of Limitations for collections. (They called me at work, which was a big mistake! Trust me! LOL)

Female named Casey called me from C R Associates lookingfor my adult son. Gave me a case number,877-219-4760 as a call back number and asked for his work number. I told her I would be happy to give him her number, but since I had no idea who she was I was not comfortable giving her his number. She stated that since I was being "evasive" my son or his attorney had 2 hours to contact her and hung up. I know everyone needs a job, but I'd starve before I worked for a company that condones treating people so rudely.

A person by the name of "Al Cole" from CR Associates called my house saying that someone put our family name down as an emergency contact for a person who was my father-in-law over twenty years ago.  Whatever!  They said they call back number was 877-219-4760. I am not going to give them the time of day. I have searched for people on the internet and I have a strong suspicion that they started doing searches for this person via Intellius or 123people and all they have to get is "possible" relatives and then start calling those listed.  My home phone number is listed so of course they are going to find me easily under a previous married name.  How desperate and stupid.

its funny becasue I received this call too from a Natalie stating that it was urgent and she had ran across some paperwork that was sitting on her desk and that i needed to return the call, that this was serious stuff and since I worked at this doctors office that I would know how to  help her. left a number to call...stupid me called and some jerk answered and said his name was i think archie with the same company and it was about a loan from like 8 years ago....and if i wanted to work something out i then told him im unemployed ive been unemployed for 8 months now and then a** wipe said fine then I will serve you with papers for court....I told him you do what the f**k you have to do a**hole and hung up...

Received an "urgent" call from this number, which I stupidly returned. They never answer the phone by stating the business name and the nature of the business.  Of course, this was an urgent legal matter concerning my husband, and though I stated I was his wife and wanted specific details as to what the matter was regarding to pass on to my husband, IF she expected him to call back.  She said CRA is a company that deals with "very urgent legal matters", and that it would be "against the law" for her to give this information to me, but that if my husband wanted to avoid a  federal investigation, he better call now and sign a letter.  I said that he would not call back without additional information and she screamed at me that she was a "professional representative" (of what?)and that it would be a violation if she gave me any information. Then she hung up.  These people tried this 6 months ago, and the only difference is that it was a man who decided that the way to get to me was to tell me that my " petty female brain" would not understand the urgent "legal" nature of the call, and that all of my questions about (again) what the matter whas about and the name and function of the organization he was with, made him suspect that I was covering something up on behalf of my husband.  Then he hung up.  Do these people ever go away?  Thanks

These people called my sister after she moved here from another state looking for me.  They told her it was a very important legal matter concerning me and I should call them immediately before the paperwork was filed and pushed through.  I called and it was about a credit card I filed in a bankruptcy case ten years ago and they said I could pay the balance in full today.  When i told him i would look into it he stated that "that was bull".  Then he remained ugly  I told him to F**K Himself and he hung up on me....  don't fall for these people. All of their info wasn't even right on me.

Very rude. The man tried to tell me he was from the federal government and my brother owes money since 2001. My brother has been in a nursing home for 4 years.  They didn't care and said that we had to give them a copy of his power of Attorney in 24 hours or he would be in big trouble. He told me since I wouldn't give him any information that I lived my life not living by the law and my mother was committing an illegal action by not cooperating with them.  This man started yelling at me and then hung up on me.
Obviously this would not be someone from the Federal Gov't with that attitude , demanding and hanging up .
