Debt Collector
Got a voicemail message from a "state processor", a so-called Dominique, to call a so-called John McGuire ASAP regarding my case # or else they would file criminal charges, I would be arrested, incarcerated, etc. I read these comments on here about this being a scam, as I'm certain I don't owe anyone money, but tried to call back anyways to tell them I was reporting their fraudulent acitvity, and out of curiousity to see what other lies they would tell, but got some weird sound, then a recording saying the call did not go through because the # is not in service? I tried twice. The next message I got a few days later said they had my SS# and SS# of family members and that they would be calling my family members as well in hopes that they will be able to convince me to "do the right thing". Wow. Amazing the lengths these crooks will go to!

I live in Dallas and in Dallas county only the sheriff serves summons to appear at court and they will never call you in advance to let you know that. No collector agency or "process server" have any legal standing to enter a plea on your behalf. They are not the court systems and they need to quit with making themselves that way.

A "process server" said they would "enter a guilty plea" for the person they were trying to serve??? That's hilarious! It's a scam, but a fairly pathetic one.

Somebody from called from 877-242-3205 and said they were a process server trying to contact my brother.  They said if he didn't respond within 48 hours they would enter a guilty plea for him for not cooperating.  I called my brother and he said that he got the same call from a woman who said that there was an arrest warrant for him.  He told them that if there was an arrest warrant then the police would come to his house to arrest him - they don't call and give you notice before they come to pick you up.  I called the number back and there was a recording from John McQuire.  This must be a scam.

Received two calls yesterday from a Vanessa Paul who said she was a processor with Dallas County. She states that they have an affidavit to be served to me. Saying that John Miguire is the one filing the compliant. She left a 877 # and said I had 48 hrs to call back or a guilty plea would be entered for me for not corporating during the investagation. I just got evicted from my house yesterday & don't live any where yet to get served! I haven't called them back yet, debating if I should or not...

I was taken in by this call and gave them a card number to pay a past due bill, but come to find out if it was fraud. He was posing as a lawyer and said that I was due in court today if I didn't pay, what gets me is that they knew everything about me, my social and where I had worked. I'm just hoping the bank can help with this matter.

My father-in-law got this same call the other day. The first caller was a man named Thomas Jones who left a "docket" # in the message to make it sound official. Bottom line they made a threat that criminal or civil action would be taken if my wife didn't call back without 48 hrs. Well by making a threat that a criminal charge would occur if ahead didn't, they committed a felony. It is illegal to threaten criminal charges for unpaid debt which is a civil matter. DO NOT CALL BACK OR GIVE THEM PERSONAL INFORMATION.

My mother got a call from a man named John Maguire yesterday claiming that there was a complaint filed against me and asking her to confirm the last four digits of my social security number. She told him I hadnt lived there for over 10 years. He called her back today saying that if I didnt call him back today by the end of his buisness hours that he would take this case to court. He also said they were delivering process papers to me on this upcoming tuesday.  Still no clue as to the nature of this complaint. Called this number back and got an answering machine. Left a message with the case number he gave to my mother.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

They called me today about my dad owing money from a check he wrote back in 2006. I had a stroke in 2003 and barely could walk and he cant talk. They told me that they had him on video tape but I was living with my parents and I never took him to the place they are saying he wrote the check to. I think they try to scare you into paying it. My dad cant walk or talk and they are threatened a warrant too. When I asked for proof he said that he would have to call me back. He hasnt since.
