NEVER pay any caller who says you owe money - unless they MAIL proof that the debt is yours and that they have the legal right to collect said debt.  The burden of proof is on the caller to prove that you actually do owe this debt to them.  Refusal to mail this proof is a direct violation of the FDCPA (Fair Debt Collection Practices Act).  And, per the FDCPA, refusal to mail proof of debt also means that you owe them nothing.

Please do report your callers to the FTC, FBI, Dept of Justice and your state's Attorney General.  
If you ever hear from them again, - or receive similar calls - remember that the caller has to mail proof that you owe money to them and that they can collect  - you don't have to prove anything, per the FDCPA.

The people calling from this number are liars and the whole thing is a huge scam. I had a man named Nicholas McCarter calling me about a pay day loan that I had taken out in 2010 and paid off shortly after. The company I had gotten the loan from is no longer in business as they were dealing illegally on the internet, which I had later found out, after doing some research of my own.

Anyway, this Nicholas contacted me at my place of employment and kept me on the phone for more than a half hour, insisting that if I didn't give him my information for this loan that I would be served with court documents and the like. At that time I was terrified of ever dealing with the court system so I immediately gave him my bank information so he could take care of the supposed cost I hadn't paid off. Unfortunately for me at that moment I hadn't been keeping records of my paid off debt for more than a few months, so I had no proof on my end that I had paid the entire loan off.

After I gave my information and ended the call, this nagging feeling came over me that I should do a bit of a google search on the phone number he had called me from. I immediately began to panic because there were a lot of scam claims from a lot of people. Now, I don't usually go off what I read on the internet because there are a lot of people out there who bi*** about debt collectors when in reality, they owe what the debt collectors are trying to collect and are just pissed off that they have to potentially pay back what they should pay off.

Upon finishing with google, I called my bank and explained the situation to them and they advised me to without a doubt cancel the card...so I did. That Friday, which is when the charge should have occured, I got several calls from Nicholas McCarter and then calls from an unknown number who stupidly left a voicemail claiming to be a process server with my county court house threatening that if I hadn't contacted Nicholas within 48 hours she would be serving me and if she couldn't find me she'd show up at my place of employment(yes, this is actually what she said).

At this point I'm pissed off because now they start to contact my mother and try using these scare tactics on her, so she's calling me every five minutes in a panic because she assumes I'm going to jail. It was then that I decided to get real legal advice. I was told to send an email to the company asking them to mail me a registered letter of the proof of my debt. This email PISSED Nicholas off. He called my phone and left a message that I "BEST CONTACT HIM IMMEDIATELY" and at the end of the call he said "GOOD LUCK", his words, not mine.

I contacted my lawyer once again and he had had enough of their b***s***. He took their phone number and contacted them, demanding information. Even though a few phone calls prior, Nicholas wanted my lawyer's information because he was filing suit against me, he refused to speak to him. He transfered the lawyer over to the "law dept" where the law dept explained to the lawyer that they couldn't speak with him until he sent over his letter of representation and they were quick to get off the phone with the lawyer. Real quick.

My lawyer took care of the situation, told the so called debt collector that if they needed to get in contact with me further they were to contact him at his law firm and he would pass along the information. Lets just say that after that, i never heard from these people again.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

Can a Collection Agent Call My Cell Phone?

Shes been calling we exchanged a few words and then all these threats and lies came up and it did terrify me cause she had got my mother ivoled so i was like ya to payment plans i gave her a pre paid card # im actually up late googling my rights and j google 877-2538240 and they say this # is a scam smh.she has my ss# d.o.b and shs also said shs was going to make sure i was prosecuted to the fullest like wtf  ughhhh!!!!!

I'm so tired of them calling my phone! I don't even answer my calls anymore.  If it's a number I don't know then I won't answer it.  The crazy messages this woman keeps living me and the type of threats  they issue me is plan stupid. I paid all but like $200 of the debt which was because I was laid off from my prior employer.  You attend to forget about those type of bills when unemployment doens't even cover your cost of living for your family.  It's on my credit, I don't care about it, plus it's been on my credit for so long now that if I did pay it off now, it would actually harm my scores more then cause any good.  It's one of those cases damn if you damn if you don't things. I have lived at the same address for many years.  It's scary that bi*** has my SS# but that's okay, it's protected and been flagged for identity theft.  Send me something in the mail, don't call me.  I will not listen to your pathetic threats so go get a real job!

OK i dug up my paper file. My records confirm that I made 3 payments -i was actually more than a full payment ahead on my payment schedule because I was trying to avoid accruing further interest. After i had to change my banking information they defaulted my account even though I called in to make a payment on-time, They said all of my previous payments had bounced (which is a blatant lie and I have the information to prove that),  Their "customer service" would not allow me to pay by phone even though the loan terms specified i could do so.  They said there was literally NOTHING i could do or that they could do for me.  Completely illegitimate scam operation. and BTW, this all started through a lender recommended to by by moneymutual.com.  BEWARE CONSUMERS.  Just because Montel Williams is plugging it doesn't mean it's legit.

These jerks have been contacting my family as "NCS", and now they're contacting me with the same caller ID as "NorthWest Legal"  couldn't even figure out my phone number which is readily available if you're a valid creditor and can pull a credit report.  Its from a lender from those EZ Loan, Cash-Call places. I took a $400 loan to fix my car and they charged me almost 50% interest.  Then they said they didn't receive my first $200 payment, which is BS.  They also leaked my bank info (which they got from that first payment) to some monthly account charge for random amounts like $25 and $32 dollars here and there (and trust me, I went over all the fine print, I never signed up for anything and I never authorized release of my bank info).  It was a complete nightmare, I had to get a new account with my bank (who immediately recognized the random debits as fraudulent because I kept good records). Re-setup my automatic bill-pays and direct deposit from work...  Now these a***oles are calling me because their statute of limitations is about to expire and threatening arbitration and that this is attached to my "social security number" and "headed to court"... it's already on my credit report, so this is old news. The people they represent were fraudulent, they can all go climb a tree.

Strange message from a Kathy James claiming she needs to get a "final statement" from me before she files against my social security number (whtever that means) with the county regarding the fraud allegations and bad check?? This is how collectors get a reaction and a call back..make a claim so absurd that it's bound to get a call-back. That's their goal.

I contacted NCS regarding my nephews dad's account. He cld and gave permission for me to speak on his behalf. We came to a settlement amount but since the call was middle of last week, I was told the offer was only good til Friday June 28th. On Monday I recieved a call from the same collector..note neither time was I given the mini miranda, as I proceeded to explain we were under the impression the debt settlement offer was only valid until June 28th, that we had since found out his social  security can not be garnished and that the actual debtor was 73 yrs old. She immediately turned over 360 degrees!..As I had witness's listening to my end of the conversation, the message left on my cell phone was so nasty you could not even imagine. This collector turned our conversation from exactly what I just stated to" Im sorry that your mom is a crackhead and using other drugs, she also went on to say my mom was a prostitute and a lesibian and that she was a Christen and she will pray for my mom and me since I was raped as a child and I needed to see someone regarding the issues I have!"  Wow I could not believe as I replayed in front of the persons who heard the true phone call!...I am currently looking for a legal representative to retain for a case against the debtor and the company..I have the voice mail saved and can be played for phone for proof!  All I was trying to do was have them remove my cell phone number from their data base and this is how I was treated.....

Arbitration firm for EZ Money pay day loan. Mrs Castleman was very nice. I hate rude debt collectors and ones that try to threaten you. I was shocked when she wasnt like at all. My debt was for $520 and they settled for $320 to close, even let me make it in  pymts and they'll report to my credit also as paid and no longer a legal obligation to the debt. I wish others, trying to settle a debt, would learn that being rude, just pisses people off!! Treating me like a human being will work everytime!
