I am so thankful for all these posts! I decided to contact NYS attorney general who is now handling this for me. I filed a complaint with them, as I received a call from a Melissa advising it was a verbal notification before being served with a summons, advising me I owe for a pay day loan from that I received over a year ago.She said I was going to get served with a summons and be arrested for check fraud and other charges if I didn't set up payment arrangement..and I was in no position to set the terms!  The phn #'s 1-877-287-0344 and 1-877-287-0863
I then read all these reviews online about this company.  I also had asked this group-Johnson Walker for copy of original loan documents and received a return call from Melissa who left me message,  advising me "they obviously don't have the loan documents". Another contact was Lisa Davis. Now I can tell them-this matter has been turned over to the NYS Attorney General's office for handling.

please report any violations or threats of a lawsuit to the NYS Attorney General's office by calling 716-853-8404.  they are NOT a lawfirm, so unless they can prove they have EVER sued anyone, they are in violation of the law.  (they would have to have outsourced the debt to a real law FIRM) also, their use of the word FIRM in their name is a violation....

has anyone ever heard of a "pre-litigation" firm before?  ha ha, nothing exists....just a scare tactic.... another buffalo area debt collector trying to circumvent the law.  ask them to provide you with verified proof of the original debt, and see how fast they don't respond.... I think I will inform the authorities in NY what they are really up to..  Know an employee there who will spill everything

If you call their number 8774953750, the person that answers is Megan Lundy, previously of the Johnson Friedman firm.  She is a criminal and she will be caught.  Do not give her money, instead report her to the authorities in NY.

Yes a friend is dealing with these Johnson Walker people as well. They refuse to give their physical address as well....Hmmmmmmmm if they are legit then why would they worry about giving out THEIR address???? Our courts said to not give them any information and the steps to start suit against them.

Hi everyone I am hearing some interesting stories and some is part truth and some is not. Here it is the true facts(meaning it can be proven), Now the Company Johnson Law Firm which is the name they are giving. Simply because they are correct in trying to collect a debt but they also know they cannot collect from everyone because of the location. If you ever had a loan with getecash or loanpointe it is true you may very well owe them, now even though they were taken to court through the FTC they are still entitle to collect on a debt owed through third party( I contacted the FTC myself and it is true that they went to court but again they are allowed to collect on any debt owe) They are not allowed to garnish without someone knowing of such garnishment and there is a certain time frame, thats what they did wrong.  Heres what you should do.. First contact your State in which you reside to find out if they are License to have business in that State; in Illinois it is the IDFPR and they are not License, also they are not listed as a License Attorney in Illinois I found this out through the IFIPLBA. However, I did pay them simply because I knew I had a loan through them even they the were not license here and I did not want to go dragging through court. Now Im not telling anyone to pay them if you want to go to court thats fine; you will most likely win because  they were not license. Also they can take you to court even if they do not reside in your State they can hire what they call a Reciprocity( who will represent THEM from that state) of course this is costing them money and that why they want to make a settlement. So Good Luck to you all! Always do your research, do not be afraid to ask the right question and let them know you have done your homework that they are not legal and you don't mind going to court you might be able to sue them afterwards for harrassment and threats.  If you feel threatened or violated contact the authorities this will help you in court

I received a call on yesterday, it was actually my cousins phone that they called. I almost got scanned like this before. Now by reading these post i'm really starting to believe it is a lie. The number they left was 877-287-0861. I've been garnished before and i know how it works, they do give you time to pay before and make payment arrangments before summons or court is involved( a sign right there). Anyway i believe it is a blessing to have people reporting this type of stuff so we all stay informed.

These people called to leave a message on my phone for someone else's summons.  I contacted them in fear and instructed them on what to ask for when calling back.  After the second question, the woman got stupid and hung up in our faces.  Is this how the law acts, really?  BTW iit was a man who called but a woman answered the phone.

This is excellent information.  This company did this to me.  My human resources knew the law and told me not to worry, they cannot garnish my wages without a court order.  It was still totally humiliating though.

This company just called my work.  I told them that I would get back with them and "Joe Davis" just started YELLING at me.  Yeah, that makes me want to pay this illegitimate place.  He then called my coworker who stated he was rude to her.  I called him and recorded the call stating that this is his notice that he is not to call my work anymore.  He then stated, "I can call whoever I want to, I'm the law."  This made me actually laugh out loud.  You would think the "law" would actually know the laws, right?  If he calls my work again, he will be sued.

GeteCash been investigated and sued by the Federal Trade Commission and has been barred from illegally garnishing wages and other illegal debt collection practices:

Payday Loan Defendant Settles FTC Charges; Illegally Tried to Garnish Borrowers' Wages

One of the owners of a payday loan and debt collection operation has agreed to settle Federal Trade Commission charges for his role in a scheme that illegally tried to garnish borrowers? wages and used other illegal debt-collection practices.

According to the FTC?s complaint, the defendants, doing business as Ecash and GeteCash, offered loans to be repaid from borrowers? upcoming paychecks. Online loan applicants checked a box indicating their agreement with loan terms, including an inconspicuous ?wage assignment? clause that said that their wages would be garnished to cover delinquent loan payments. Then, using the name LoanPointe, the defendants attempted to collect on the offered payday loans.

Federal law allows federal agencies to require employers to garnish employees? wages without a court order when the employees owe the government money. According to the complaint, in letters to employers that sought garnishment of their employees? wages, GeteCash and LoanPointe tried to pass themselves off as having the same collection rights as the government. The FTC?s complaint also alleges that GeteCash and LoanPointe falsely stated that consumers knew their pay would be garnished and had an opportunity to dispute the debt. In addition, GeteCash and LoanPointe allegedly violated the law when they told employers and co-workers about consumers? debts without their consent. Under the settlement order, Mark S. Lofgren is banned from collecting debts through wage assignment. He is also permanently prohibited from misrepresenting facts in order to collect a debt; contacting a consumer?s employer in trying to collect a debt, unless he is seeking location information or has a valid court order of garnishment; and disclosing a debt to any third party. In addition, Lofgren is barred from violating the Credit Practices Rule and the Fair Debt Collection Practices Act, selling or otherwise benefitting from customers? personal or financial information, and failing to properly dispose of customer information. The order imposes a $38,133 judgment that is suspended based on his inability pay. The full judgment will become due immediately if he is found to have misrepresented his financial condition.

I have recieved messages from a Megan Lundy she states she is a pre- litigation for Johnson and Freedman She said i have outstanding payday loan with Get-E-Cash i don't remenber it but i am trying to clear up my debt so i asked her to send me a copy of the contract she E-mailed me the copy of the contract and i still did not remember it she said they wanted 2,000 to 3,000 dollars but they would settle for 700.00 like a dummy i gave them 600.00 and i wanted them to send me a copy in writing from the originan creditor and they have not sent me anything i still owe 100.00 she said they will accept anything by mail they need my credit card i also heard that Get-E-Cash was under investigation is that true.

Oh BTW, the person that called me was Bill Nelson and he said I was going to be served and that I should contact the party at 877-285-7706 (the call came in as a Private Caller).  When I called the number and asked what firm it was, it was Johnson Walker.  Should I just wait and see if I get served or would the county already have a record of the summons even though it hasn't been served yet?  Thanks again.

I received a call today stating I was going to be served with a summons.  The company was a payday loan company, E-Cash.  They are supposedly suing me for over $4000.  I did have a payday loan about 2 years ago, but have really had some financial strains over the last 2 years and was not able to pay it back.  Is this something that could get me arrested?  (They said it was because of a bad check and even stated the name of my old bank.)  Can I file bankruptcy to get rid of it?  Payday loans are no longer available in my state.  I was just wondering if this was a last ditch effort to get as much money as they can. I am really nervous right now.  I am having to support my two sons and a daughter-in-law right now and really can't afford to give them $800 or even $400 (which were some of the amounts thrown out at me).  I also do not feel comfortable giving them any kind of credit card or bank information.  I'd really appreciate any advice I can get.  Thanks.

Everyone who is contacted by this company needs to do one major thing; record the call you need to inform them with using this exact statement, "This call is being recorded if you CONTINUE to speak that is your acceptance." These bill collectors are dumb, their highest education level is high school or equivalent they will continue to talk and argue that they do not give consent. Once they say that you are being served call the courts verify that information THEN call you state attorney general's office to lodge a complaint for false and misleading information.

Also, hire an attorney or file a claim in your local small claims courts with your recording for an FDCPA violation. It would be better to hire an attorney and try to get this classified for a class action. Then sue for disgorgement for all payments that have been received since they started using these deceptive practices. Disgorgement will bankrupt the company and put all the thug bill collectors out of a job.

Received a call again today from  a Mary James...ironically she does not leave the name of the office she is representing, nor a contact number for herself, merely states the summons in my county but again, does not state anything else solid to confirm her identity or firm she is representing.  It's funny how she tries very hard to sound professional yet I can here numerous operators in the back ground which is common for bill collectors.  As I stated before, if in fact she is filing a legitimate claim, summons or whatever, they must first send notice via USPS mail notifying you in writing allowing you a specific time frame to respond.  Secondly, any court or law office will be up front of who they are, who they represent and by the way, a court case number is very specific in number sequence...check out local case filings in your county to see how the numeration runs and you'll understand where I'm coming from.  So if this Mary James has a true claim on me, why won't she mail me a notice instead of calling with an UNKNOWN number?  See my point.

I too received a call this morning from this female individual claiming this.  First of all, when someone has a legitimate claim against you of any debt they are to notify you by writing with a letter acknowledging the debt.  I have yet to receive such a thing.  The other, an attorney of any kind or any type of legal office being a court or such would give you a return call back number and additional information to help you verify this so called claim against you.  Many people are unaware as to how the law works in their state especially with pay day loans of any kind.  If this person truly has a claim against me, I should expect to receive something in the mail with verifiable information.  Why wasn't a collections company handed this?  Why did the caller not leave a court # to call?  Why didn't she even state who the debt was for?  What company is filing against me?  See these are all questions to be asked when you do get them on the phone and plus, why do they call from an  UNKNOWN number...last time I dealt with the court which I do often for work, I see their number on caller ID and it's a city number not an outside of state or unknown number...now keep in mind if the debt was in your state and it's a honorable company then yes you do owe and they will work with you...Any true collections will always work with you to collect their money and never give info over phone...never confirm info either.

Shannon - just out of curiosity - which law firm contacted you?  What payday loan company was it for?  

Im sorry, I just find it odd that they would have a summons for me in my county (which they are unable to pronounce) and yet the county courts know nothing about it.  The courts verified - that is not how they do business.  I have gotten a summons before on a motion to move out of the state with my son - and they never called from an 800 number.  They let me know they were holding it at the court and I could pick it up since I was not home.  They deliver the summons - not someone from a third party.

However, you have given me the great idea to talk to my ex-father in law - he is an attorney.  Thanks!

I got a call from them yesterday, I requested a letter and took it to my dad's friend who is a attorney and close friend they are a legitemit  company and it is verified through the  NY state limited liabilities sight for a llc. I know I took out some payday loans a few  years ago and my account got closed so I did not  have a dispute with the loans I freaked out when they told me how much money they wanted and thought they were out of there minds. Then the  lady I spoke with Megan told me she could send me  a copy of the  original application through email . When I got that I called my dad's friend and had him review  it  and  he  said it is legal and  binding because it is a contract i agreed to  and  it  was  my fault  because  i defaulted on this  loan when my checking account was closed . So I just  paid  a settlement for 1200.00 and got  a receipt sent to my email .I feel I did  the right thing I knew I had outstanding  payday loans i fell behind on so atleast  I don't have to  worry about  getting sued  now....good luck
