It kills me when somebody post something positive about these people that helped me with a lesser settlement and to resolve these matters then all of the sudden it becomes a scam but when all of you want to post negative stuff,then it must be the truth. Well the truth is that if they called you then you owe it.It dosent matter if the debt is from 15 years ago the truth is that you took and the company that you told that you would give it back,still wants it back even after 3,6,15,20 years. They're currently using this number, as well: 210-519-5716  They're worthless scum. They can't do anything to you. Do not let them intimidate you in any way. Most are illiterate con artist trying to hustle you out of your money. They won't follow state laws and they will use every scare tactic in the book to get you to wire funds to them immediately. They'll usually call you on a Thurs or Friday (of course before the wknd) to insist that you either send a money gram or divulge your bank acct info. Be smart people, listen closely to what the caller is saying and think about it, would you really send your money to a complete stranger without any documentation?

I have had several calls from them the last 2 days and the opening line was 'This is Amanda Grahm with Kindrick Joseph and Associates, I need you to call 877-333-0713. There are serious allegations pending against you"....people I am a best selling author and don't owe anyone anything. I found this site trying to research these people. My lawyers advice?....if they keep calling my cell phone file suit on them...personally I am not wasting my money - thank you all and this site for helping me find out who this was and what they are about. Fromwhat I d knwo about credit collection law...you have to be given it IN WRITING or is doesnt exsist.

i have the same story to tell, being harassed at place of employment, claiming I received a payday loan from 2005. I asked for some form of proof of the debt, which she could seem to supply me with. all she knew was my email address and my work #. She threathened to have me arrested, she threathened to garnish my wages, threathen to report me to the IRS for Tax fraud since I hadn't claimed the loan amount on my taxes.  This lady was so full of crap!!!  I work for an attorney, she must just be one of those stupid people.  the last conversation i had was when I informed her yet again, not to contact me at my place of emplyment, was her yelling at me that she will deal directly with my companys HR dept since I was such a rude B*itch!   these people need to be made to stop!!  I have filed a complaint with the Fair Trades Commission and my attorney will be contacting them once I can find an actual mailing address for this supposed company.

Debt Collection FAQs: A Guide for Consumers
If you?re behind in paying your bills, or a creditor?s records mistakenly make it appear that you are, a debt collector may be contacting you.
The Federal Trade Commission (FTC), the nation?s consumer protection agency, enforces the Fair Debt Collection Practices Act (FDCPA), which prohibits debt collectors from using abusive, unfair, or deceptive practices to collect from you.
Under the FDCPA, a debt collector is someone who regularly collects debts owed to others. This includes collection agencies, lawyers who collect debts on a regular basis, and companies that buy delinquent debts and then try to collect them.
Here are some questions and answers about your rights under the Act.

What types of debts are covered?
The Act covers personal, family, and household debts, including money you owe on a personal credit card account, an auto loan, a medical bill, and your mortgage. The FDCPA doesn?t cover debts you incurred to run a business.

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.

How can I stop a debt collector from contacting me?
If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:
Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.

What practices are off limits for debt collectors?
Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:
    use threats of violence or harm;
    publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
    use obscene or profane language; or
    repeatedly use the phone to annoy someone.

False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:
    falsely claim that they are attorneys or government representatives;
    falsely claim that you have committed a crime;
    falsely represent that they operate or work for a credit reporting company;
    misrepresent the amount you owe;
    indicate that papers they send you are legal forms if they aren?t; or
    indicate that papers they send to you aren?t legal forms if they are.

Debt collectors also are prohibited from saying that:
    you will be arrested if you don?t pay your debt;
    they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so; or
    legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action.

Debt collectors may not:
    give false credit information about you to anyone, including a credit reporting company;
    send you anything that looks like an official document from a court or government agency if it isn?t; or
    use a false company name.

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:
    try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
    deposit a post-dated check early;
    take or threaten to take your property unless it can be done legally; or
    contact you by postcard.

Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.
Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:
    Social Security Benefits
    Supplemental Security Income (SSI) Benefits
    Veterans? Benefits
    Civil Service and Federal Retirement and Disability Benefits
    Service Members? Pay
    Military Annuities and Survivors? Benefits
    Student Assistance
    Railroad Retirement Benefits
    Merchant Seamen Wages
    Longshoremen?s and Harbor Workers? Death and Disability Benefits
    Foreign Service Retirement and Disability Benefits
    Compensation for Injury, Death, or Detention of Employees of U.S. Contractors Outside the U.S.
    Federal Emergency Management Agency Federal Disaster Assistance
But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. Your Attorney General?s office can help you determine your rights under your state?s law.

I used to work for these people and they don't accept anything thru moneygram or western union.  They have had the same number for years and we have never been allowed to use investigator or any of the terms you have mentioned.  I think you have mistaken them for someone else and it is trackable.  And as far as everyone goes with the complaints they do and will fax or email any debt validation or receipts you ask for and if you have a problem just ask for the manager.. Most of the complaints I see on this site are ridiculous.  Just remember if these debt were paid then these people wouldn't have a job.  So, who is truely to blame???

DON'T FALL FOR IT! These people are scam artist. "Amanda Graham", that's the name she left (actually sounded like she was reading) on my voice mail. Her enunciation of just basic words made the entire message laughable. They'll refuse to tell you the name of their company. They only want you to wire them money via moneygram by using bogus scare tactics. They'll use the following words: INVESTIGATORS, INSPECTOR, URGENT, OFFICIAL, FRAUD- ONGOING INVESTIGATION. I think you get the picture. These losers are trying to collect on old accounts that have either been paid, written off or the SOL has expired. They'll tell you they won't mail/fax proof of debt. A cease and desist letter is worthless because they won't honor it because they're crooks! They'll violate FDCPA constantly harrasing you on your job or by calling your relatives. They'll say there are "pending charges" in your local County against you. ALL UNTRUE! Please don't ever send these vultures a dime of your hard earned money. Let them know you understand the game of junk debt collectors and you're recording the call. Do not trust the number that's on your caller id because every month, it changes. They're using call spoof by using a fake caller ID number to ensure the call isn't traced and to prevent websites such as this to prevent disclosure by allowing victims to see they're not the only ones being targeted by these ruthless thugs and thugettes. Two Numbers they've used in the last few months are: (717) 889-4668 and (512) 807-7752-- Luckily I have recorded every call and I've saved every message they've left me and I'm currently working with NC Attorney General Roy Cooper's office regarding this particular group.

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.  

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

So what can you do if you receive "wrong number" calls from debt collectors?

1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

The Telephone Consumer Protection Act of 1991 (TCPA) does many things - including prohibiting debt collectors from calling your cell phone without your permission. Each unauthorized call could result in the debt collector paying you up to $1,500. Here's some helpful information on the Act and how it might affect you.
What is the TCPA?

The TCPA, which was signed into law in 1991 under the first Bush Administration and codified under 47 U.S.C. 227, prohibits calls using any automatic telephone dialing system or artificial or prerecorded voices to:

?Emergency telephone lines
?Telephone lines of any guest room or patient room at a hospital, health care facility, elderly home or similar establishment
?Telephone numbers assigned to paging services, cellular telephone services, specialized mobile radio services, other radio common carrier services or any service for which the called party is charged for the call
?Any telephone call to a residential telephone line
?Send unauthorized faxes
The only way that a caller won't violate the statute is if express consent has been given - and violations of the TCPA are steep. An unintentional call carries a damage amount of $500; an intentional call carries a damage amount of $1,500. That's per call and regardless of the purpose of the call. In other words, if they call you using an automated dialing system without your consent, they've violated the Act and you are entitled to damages.

How does it affect you?

Most debt collectors use automatic telephone dialing systems to contact debtors. You'll recognize this when you go to pick up the phone and there is a slight hesitation on the other end. In fact, most debt collectors are calling nearly 100 people at a time just waiting for someone to answer. Although many have stopped calling landlines, cell phones are another story. Since more and more people are using cell phones either instead of, or in addition to, traditional landlines, debt collectors are finding their cell phone numbers using skip tracers, calling them and hoping that they don't realize that the TCPA has been violated.

This company has called relentlessly to a public high school looking for someone who has not worked at the school for maybe 7 years.  I am constantly disturbed in my classroom with phone calls.  I have told every person that "he no longer works here, please take the number of your records"  They ignore me and call again.  The latest episode was last week when I spoke to a person.  I even gave them the phone number for personnel in the hopes that they would be able to track this person down without involving me.  They were nice and said they would, BUT, they called again yesterday.  They clearly think that I am dodging some debt of mine.  They must be idiots because I gave them my name and my position at the high school readily, not hiding anything, and still they disturb my classes.  It makes little sense to harrass an errant debtor, but it MAKES ABSOLUTELY NO SENSE to harrass an innocent bystander!
