I have had the same happen to me today, but from a company called Ashton Check Processing.  I told the guy that I have paid off the loan and I have the paperwork to prove it.  He said his client will be subpinaing me in 72 hours

These people keep calling my job daily non stop once or twice... the number is 855-326-2536 some lady called Long .... insist that they will pursue legal action in court for fraud and that my bank account will be frozen also mentioned about a deposition.... Whoa! these are legal terms and I'm pretty sure they are far from a legal firm... debt collectors should not represent them selves that way... am I wrong? ... need some advice ...anyone can please help?

Elements of Wire Fraud with advance or payday loans:

Wire fraud is very similar to regular fraud, except that it takes place over phone lines or involves electronic communications. The legal definition of wire fraud has four elements:

The defendant created or participated in a scheme to defraud another out of money;
The defendant did so with intent to defraud;

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. This lady named Ms.Miller called my place of employment and stated on a voicemail that is streamlined that she needs an deposition from me for a legal case the number is 1-877-905-8771, I do not know this company and refuse to be harassed, I let my supervisor hear the message also, i work for the state and our phones are for our clients only, very unprofessional and sloppy of this woman

The debt was taken out under you name with your ssn and bank checking account number. bottom line is you received your funds when you were in needed to borrow. The banks looking to recollect the money you still have...  Bottom line if you can't pay in full tell them what you can pay, work out the plan to pay and dont default.. The collection calls will stop... I had a few of these calls in the past I paid because i borrowed and wanted to be done with them. offer a settlement most of those people will take the settlemnt to close the acct... LOL dont pay in full...

this is a scam as I have an article  f5rom the Daily Review newspaper from Oakland, ca. Wish I could scan it for everyone. It said collection agency shut down     lots of people were duped  some for a lot of money.   Big ring and some worked out of India. All about payday loans. See your info is never safe anywhere with anyone. some people were able to get their money back.

They never got any money from me and im glad I wasnt pressured into giving them money when they first made contact with me. The same company contacted me, and the name of the company is STP and Associates. The company is out of Houston Texas. They also use the name STP Processing. It is a company with a bad rating from the Better Business Bureau. The lady that talked to me is A.L. Jackson. They have two numbers also 1-877-394-1304 and 1-866-849-7259

I got a call from this same # at my work today. my coworker told him to go take a hike. i got home same message. i called the # back no one answered so i left a message to contact my attorney and told them all calls are being recorded at work and i was going to sue the crap out of them if they tried to contact me again.

Hi Dennis,
I'm curious...did the person say what company s/he was calling from?  Of all of us who received this call, I don't think anyone was given a business name.  And I'm sure giving out bank acct info is a mistake we've all made at some point.  I hope you're able to stop whatever withdrawal these people try to make on your account.  Threatening (or lying) to someone about an impending lawsuit to get a person to pay up should be illegal. And there are so many people still out of work and just trying to make it...most people are trying to just keep their heads above water and food on the table...not pay some outrageous fee on an outdated debt.

This is highly likely a scam because no legit process server calls targets up to tell them they will be served because targets can run away! If you have internet access to your bank, I suggest you login *NOW* and see if there is a way to lock your account or look for a fraud hotline that your bank may have set up (which may be answered 24 hours). I fear they've already placed a ACH funds transfer that will run overnight tonight so you gotta try to see if you can block your account before it runs tonight. Best of luck.

I got the call from the 1-877-1304 number today march 6th. Was told they had a suppeanea that is going to be served today. This was from an old payday loan. Thought this was for real and they got my acct. info. now I have to contact my bank and go check on my money. Both my wife and I are unemployed right now so there is very little money. Wish we would of checked this sooner.

I haven't heard from them again either...no phone calls and no service.  I agree that a lot of agencies, especially those that try to collect very old (beyond statute of limitations old), often use fear and intimidation to get payment.  I had someone once tell me he was contracted with the state Attorney General's office to find me so that I could be served. I called the AG office and explained the situation--I had to wait for the rep to stop laughing...then she asked for his name and phone number (he refused to give me an address).  Haven't heard from him again.

thank you so much for the info alfalfa, very help ful, they wanted me to call the -1304 number as well, but i never did and just ignored it, that was almost 2 weeks ago, and I havent heard from them any either.. In no way am I wanting to send them any money..fear tactics is one way people try to scare others into giving them money..Remaining calm and asking them questions is key dont let anyone on the end of a phone intimidate you, there are laws in place to help protect the consumers from scamming calls..

Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

Got a private call today. VM from someone who barely spoke english said they were going to serve me papers at my home or workplace and wanted me to call back and set up a time to meet. Nope. Not going to happen. The message said if i had questions i could call this 877# and talk to Dorothy and gave a case #. I have no legal issues pending and i will not be calling Dorothy. I don't believe this is legal. Collection agents are leeches on society and have no souls.

They called me asking me for 450 from an old pay day loan that I didn't even have so i called the pay day loan company direct and they said my account was good.  They weren't on the better business bureau they didn't even have a website.  Every time i asked a question they had their dancing shoes on. So I told them if they don't leave me alone I was going to call the cops
