Debt Collector
I got a call from KAM about a supposedly returned check from 2010 to my vet, except that's not possible, because a) I don't owe my vet then or now. I talked to them about and they were wheezing from laughing so hard. Then I called my bank and they're on a list of  suspected fraudulent phone scammers they keep. The third thing is that I have overdraft coverage, so I wouldn't have any returned checks. Three strikes and you're out.

If you receive a call from a debt collector threatening to sue or states that you will receive a summons in an attempt to collect a debt you have damages.  It is a violation of the FDCPA to make such threats attempting to collect a debt.

You can sue them.

I too, received a call from a "process server" saying they needed to set up a time to deliver legal documents (summons to court). They gave me a case #  and a phone number to call (1-866-431-2963) which was to KAM Inc. It turns out I have the same name as the person they are looking for, but they fail to take my phone number off their list. This is the 2nd time they have contacted me and my grandmother answered the phone. They basically told her that I'm in legal trouble and I need to contact them within 2 hours. Again, I called and told them that it was not me they are looking for. They wanted to verify this by the last 4 digits of my SS#. I asked them to provide the last 4 of the person they were looking for and I would tell them if it was me or not. And guess what, not me. I wonder how they get away with calling people and scaring them to death just because a listed name in the phone book is the same as the person they are trying to serve legal documents to.

These people are a SCAM...... talked to Riley Jaxson today...... Funny.... he couldn't provide any of the legal info he should be gladly  giving out.......Every time I asked for the Case Number and Filing Number..( by law, those numbers exist, or it just proves they're trying to scam you )... He kept asking if I was drunk.....
Do what I did..... file a complaint with both your states Attorney General and the AG in Florida also..... eventually they'll face criminal charges..... Yes Mr. Jaxson..( he's being investigated by the Florida State Bar for impersonating a Lawyer )..... Debra..... all of the rest of you.... Extortion is against the law and punishable by such laws......
You think you'll intimidate people and they'll be so scared..... all they'll want to know is "How Much Can I pay Today"..... please don't serve me, you BAD man.....
Get a life..... get off the bottom of the pond......
PS. its funny how many coments have been posted here acting like we're all scum and should pay our bills..... Gee, I wonder who could be making all those posts????
PSS. they also use the phone number 800-707-2318

Jim Jones may be on to something because I seem to get these calls when I'm out for lunch or whatever and furthermore messages are delivered thru coworkers who have previously been identified to be working with the county so claim that it's all part of a larger harrassment campaign is not too far fetched.

I'm a gang stalking target in Gwinnett County, GA, whose co-workers have received 3 such calls over the past 2 months which provides a phone # 1-877-458-9074 to call and a file or case #. Gang stalking is a harrassment campaign organized by your local sheriff or police department ("The Good Guys" of public TV), who use their civilian and corporate posse mostly for personal or political reasons. However, to everyone around you, it's presented as a legitimate "investigation". For example, Maricopa County, AZ's infamous Sheriff Joe Arapio has a legal force of only 160 deputies but his civilian posse numbers 3,000, 500 of whom are armed. Before long just about everyone around you becomes part of the "investigation" or harrassment and the target becomes increasingly paranoid and mistrusting. Different individuals exhibit different reactions. Between 60 to 70% of the targets are women living alone who leave job and even relocate within the first couple of months. Look up "gang stalking TV", "gang stalking survivor", "virtual prisons in America", "cell phone stalking", "Dr Hall gang stalking" and "Monarch II (pt twelve)" videos on YouTube for further. This company appears to be one of their corporate posse. Ignore all calls.

You are probably correct in this company being a scam!
But Riley Jaxon, (current company KAM Financial) spelling of last name confirmed by Mr. JAXON is now posing as an attorney in the State of Florida. His exact words to us was that he was an attorney licenced in the state of Florida.  According to The Florida Bar there is no attorney with that name or any other spelling of the name legally practicing law in the state of Florida.
He and his company has been reported to the Unlicensed Practice of Law Complaint department of The Florida Bar. The state of Florida will be investigating his current company and the previous company he used for debit collection purposes.
The state bar of Florida treats complaints for non lawyers who say they are lawyers as bad faith or malice and those who do so are subject to civil and/or criminal liability.
Furthermore, when a collection agency has purchased, your debt, Which Mr. Jaxon claims he has, they are NOT the creditor. They are the debt collector and the actions they take are all governed by the FDCPA.
Therefore, they need to VALIDATE your debit by:
1.  Proof that the collection company owns the debt/or has been assigned the debt. This is basic contract law. It is very difficult to get a judgment without a direct contract between collection agency and the original creditor. In other words, the debit collector must show proof (or validate) that he owns the debt.
At a minimum, they must show some account statements from the original creditor. If you really want to get sticky, you can pin them down on the amount of the debt by requiring complete payment history, starting with the original creditor along with all fees and interest the debt collector is claiming you owe.
2.  Copy of the original signed loan agreement or credit card application.

If they do purchase the debt, this does not make them the original creditor. They are still a debt collector and covered by the FDCPA.

Continue to treat any collection agency, junk debt buyer or law firm who says they own the debt as a collection agency subject to the FDCPA. You can still request validation and proof of the purchase, because if they can't validate it, the collection agency can't prove you owe the debt. Often a JDB (junk debt buyer) will tell a consumer that since they purchased the debt, they are not subject the the FDCPA. It's simply not true.
Under the FDCPA, you are allowed to validate this debt, and the creditor (in this case, the collection agency) must show you proof that you owe the debt to the collection agency (not to the original creditor.)  as shown below under the FDCPA laws.

FDCPA Section 809. Validation of debts [15 USC 1692g]
(b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

Finally, a debt collection agency will not send out a process server to your house or place of business and then "Call Them Off" if you agree to pay.  In order to serve papers you must file a court order first.

It is so unfortunate that someone would go as far as to make up negative things about a company to try and hinder their progress. For myself, it is very easy to spot a comment in these places from someone who has a personal problem. ANYONE can place ANYTHING about a company here. Hopefully others are just as smart.

I had these people call me also, asking me if I was going to be home the next day, so that they could serve me with papers to appear in court.  I asked many questions and eventually asked for the Name of the "Attorney" who was on the phone with me, the law firm name and mailing address.  They mumbled something and I could not make out what he said.  So asked him to repeat himself and he became quite aggressive and refused to repeat the information.
So I contacted my attorney, and they said that it was a scam and that they were trying to use intimidation tactics to make people pay, even though the statued of limitation has expired.

PS:  No one will call you beforehand asking if you will be home in order to get court papers served to them!!!

And if you are not sure about the statued of limitation in your state, there is plenty of information out there in the web.

We as consumers have rights too!

Diane, YOU ARE WRONG!! Debt collectors DO NOT HAVE A LEGAL RIGHT TO HARASS a person forever!. And for your information, my observation has been that most of these people making these calls to people and harassing them regarding debts are threatening them with LEGAL ACTION!!! Which is definitely against the law in MOST if not ALL STATES, when the statute of limitations has passed! GET YOUR FACTS STRAIGHT!!! I worked as an accounts receivable representative and had to make calls to collect or resolve debts and WE DID NOT VIOLATE THE LAW, when I did!
