I received a call from Drake & Assoc about 30 min ago. I go a voice mail stating I missed a telephone deposition or arbitration. They left me a # 347-480-9117 a man named Greg Franks answered. He said I was mailed a packet of info...which I never got...he said it was from a credit card I had in 2008 and owe $2300. He asked me is this the 4 digits of your SS...I said yes but never had a card opened in 08 that I only paid 2 yrs on.. He said they would garnish my paycheck..I replied I am unemployed..He got upset, I could tell by his voice, I asked several times what CC company, he would not give an answer, finally he said....I'll make it a surprise and when you have to go to court you will know. He then proceeded to hang up the phone. I have had collections call me before and never did they behave like that. I went to BBB they have had numerous  complaints made on them and never would respond to the BBB to answer any questions SHAME ON HIM & THEM at this fake DRAKE & ASSOCIATES!

  Let me give everyone the low-down on these people. These are nothing more than collection companies that collect on outstanding payday loans. Some of these collection companies go so far as to call  themselves 'firms' in order to sound like a legitimate law firm. I know this because I briefly worked for one of these type companies a few yrs ago.
  They use numerous tactics in an attempt to scare you into paying up.  For example, they will say things like "youre going to be served' or 'there are charges pending against you', etc, etc.  Last time I checked only law enforcement agencies or the State Attorney's office can file charges against you. What they are calling 'charges' are nothing more than accusations from the payday loan company they are collecting for.

My favorite line they use is when they call you up to tell you that they are a process server w/documents to appear in court then give you an #800 if you want to 'clear up the matter' beforehand.

Think about it, since when do actual process servers call you beforehand to give you a heads up about being served?

I've gotten calls from 877-522-5275 and a few others about a payday loan I never had. Everytime they call I have a little fun with them by calling their bluff. As soon as I start questioning them in detail they quickly get irritated and end up hanging up on me when they realize theyre not fooling me w/their b.s.

P.s. If after you read this, you are still worried then go online to your Clerk of Court and you can find out if you have any pending action against you concerning this.  99.9% of the time you wont.

I received a call from some woman from telephone number 877-522-5275 stating my personal information regarding my previous employer, family names, n bank name. She then told me I had an outstanding online payday loan from 2007 for $800.00 including interest for original loan amt. of $400.00 from 1000payday loans. I don't recall having a payday loan from that company and yes I did have online payday loans but I have since paid them off from that time period. She then threatened me with legal action including intent to defraud if I didn't resolve this matter soon. I then told her I was undergoing Chapter 7 Bankruptcy and that she was not allowed to contact me and threaten me with any arrest charges. She then insisted that I am still obligated to repay the debt and wanted my attorney's number and then told her I didn't have an attorney and she said 'Fine well see you in court."

Got a call from this number a few min. ago.  It was a recording claiming there are pending allegations about bounced checks and an attempt to defraud a financial institution.  Yeah sure.

From what I have read and learned, any legitimate debt collector has your mailing address and will send mail advising of debts.   They never left a company name, just the 877 number.

I have gotten a call from this number several times on my cell phone. They were looking for someone named Rosie. I have had the same cell number for over 4 years now and my name is NOT Rosie so I politely called them back to let them know they had the wrong number. I Spoke to some lady named Miranda. I asked her very nicely to remove my number from whoevers case they have and not to call me again. She stated she could not do that. I need to pay my debt! I told her I am not who they are asking for and I do not know anyone by that name. She got very rude and stated to prove it! So I told her I could. She hung up on me!

Several days later I got a call on my house phone which i had just got installed 2 hours before hand from the same company asking for a roger. I again said noone lives here by that name and again was demanded to pay someones debt! REALLY?? I HAD ENOUGH AND SAID FINE IF U BELEIVE I AM WHO YOUR LOOKING FOR THEN MAIL ME PAPERWORK STATING I OWE THIS DEBT AND ILL MAIL U BACK PROOF I AM NOT WHO YOUR LOOKING FOR! This woman Miranda threatened me with the police being at my door.. Its been a week and im still waiting!

This company calls my mother-in-law and gives her all the information about what the debt is, that they are going to have us sent to jail for fraud against a banking institution and check fraud cases they have in office if she doesn't give them the contact information they need to serve the papers, she will be also held legally responsible. I have had the same home address and phone number for over 12 years now, if they have to information on the debt then it wouldn't be so hard to find out the phone number and home address to send the papers to. Yet they have not sent us anything and have never been served with any type of court case.
Statues of limition for fraud is 2 yrs in my state and they told my mother-in-law that this was 5 yrs ago. Class action suit should be brought against companies like this.

I have received numerous calls from this company. They are calling on a debt that I have already been making payments to a different legitimate company. I was told they are just trying to get my banking information and to not give any personal information to them. They tell me everyday they are going to serve me papers. They call my mother everyday and I feel bad that I can't get them to stop.

This is a SCAM! They try to get people to pay them to avoid being taken to court. If you are really being taken to court you will be served papers not threatened over the phone to buy out. They take honest people's money. These people need to be stopped. They are pathetic, they sit there all day everyday trying to scam innocent people out of money they earn honestly putting in a hard day's work. I hope they all burn for this someday.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

I have experienced the same approach for an alleged debt with this agency. PLEASE REPORT any calls and or emails like this to the Better Business Bureau (main webpage), click on "USA" in the center log-in box and in the right-hand column in blue in "For the Consumer" there is an option to "Report a Scam." Please use this initiative so these agencies are forced to follow the Fair Debt Practices Act. Do not worry if you feel you do not have enough information to provide the BBB; I have reported only facts of which I am aware In addition, these practices are in direct violation of any FDCPA laws.

I keep getting calls from these folks too.  I called the Comsumer Affairs Office, part of the ATG, in my state and was told they are a scam and not to contact them.  If I choose to call them to tell them until I receive a validation of debt via U.S.Mail, not to contact me any more.  I tried calling them back one day at 5:30am, and got a computer generated voice mail that the person you are calling is not available.  I know the computer generated voice, because I have the same voice mail system on my home phone.  The ATG office said if they were legit they would have a real offce, and have contacted me via U.S. Mail  DO NOT accept anything via email either, not considered valid unless it comes U.S. Mail.  If they are not legit, it becomes a federal case for Fraud.
