Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

so today the same guy called my step-dad and asked if he had any pets and that if so he better put them away,  because he was on his way with security. My step-dad  told him to where to go in not so nice words. The guy told him that he would call all day. They hung-up and he called again and asked for my mom, my step-dad told him to f off. Then a lady called him and ask if he knows my address and that the person calling him before was someone they hired to look for me. My step-dad asked for a web address , she then said she could no longer talk to him and hung up. Well no one has shown to my house or my parents. So yeah still waiting. Thank you for the info, if this is legit they are breaking many of the rules. I also would like to add that when they called my in-laws they told my mother in law that she was on a legal doc that she signed for me... well that's bull because I haven't had any kind of loan in 7 years and I have only known my in-laws for 5.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer?s written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor."

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

  A collection agent may not threaten a consumer with arrest. It may not threaten legal action that is either not permitted or not actually contemplated. In other words, a the threat of a lawsuit may be an empty one.

Use Abusive or Threatening Language

  A debt collector may no use abusive or profane language in the course of communication related to the debt.

Publish a Bad Debt List

  Publishing the consumer?s name or address on a "bad debt" list is prohibited.

Contact By Embarrassing Media

  A debt collector may not communicate with a consumer by post card. It may not use any language or symbol, other than the debt collector?s address, on any envelope when communicating with a consumer by use of the mails or by telegram. A debt collector may use its business name if such name does not indicate it is in the debt collection business.

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

Seek Unjustifiable Amounts

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

  A collection agent may not contact a consumer after it learns the consumer is represented by a lawyer.

Communicate With a Consumer After Receiving a Validation Request

  If a consumer sends a written §1692g response within 30 days, the collection agent may not communicate with the consumer until it mails the consumer the requested verification of original creditor's name and address.

Communicate With Third Parties

  A debt collector may not reveal or discuss the nature of a consumer?s debts with third parties other than the consumer?s spouse or attorney. A collection agent may contact neighbors or co-workers only to obtain location information. It may contact a third party again if it has reason to believe the information the party provided previously is false.

Can a Collection Agent Call My Cell Phone?

  Yes. However, if you tell the debt collector it may not use that number because it is a cell phone, it may not contact you again at that number.

I Keep Receiving Dozens of Calls From Collection Agents. Is That Legal?

  No. Unscrupulous collection agents will use "block parties" or "office parties" where they contact a consumer, multiple neighbors, or co-workers telling them they need to reach the consumer on an urgent matter. This is not permitted under the FDCPA.

A Collector Says I Will Be Arrested if I Do Not Pay

I have gotten phones call from a man who says he is actively looking for me. He also has called many of my family members. saying I owe for a check? The guy who calls me and says he is looking for me sounds just like the guy I talk to when I call the 1877 number, he wont let me talk to anyone else! He is rude and threatening. Not to be racists, but he sounds African american. is this the same guy everyone else hears?  The guy who is looking for me says his name is Brian McCoy. He will not give me an address or website for "NCS Offices" He listed a few of my old addresses , plus had my social security number. I called my local sheriffs office and he said its most likely a scam and if anyone does show up at my house to call 911. He also said anyone can pay a small amount of money and get anyone's info. I have also put in a complaint with the Attorney generals office. Collection agency's have to give an address. Also after having a few choice words with him, he told me not to call anymore...that i was "finished."

I also just got a call from these folks and had the exact same thing happen to me. I called back because I wanted to let them know they had the wrong number, the person they were looking for was not myself. I did not want to give them anything but the case number, the dude insisted I give him my name and the number that was called. When I refused to do so AT THAT MOMENT (wanting to make sure they were alegitamte collection agency) he said, "How do I know you are who you say you are?" Of course the case number wasn't correct and they couldn't locate it. When I refused to give him my name or my phone number he got very angry with me and told me I was wasting his time and my minutes then hung up on me. I did not call them from my phone but called from my office, now they are calling me and harassing me at work, all because I was trying to be a nice person. Wow. I feel sorry for folks who owe money to these guys. According to the previous comments I can expect this again tomorrow, joy. :o(

This is a legitamate SCAM!!  They make it sound urgent and say whatever they can to get you to pay money you don't owe.  Be aware of your credit report.  I have an attorney who has checked case number left in voicemail, NOTHING!!  I have also talked with local law enforcement who hace said the same thing.  I have been instructed to NOT answer these calls or return a call.  I made this mistake once only to be chewed out by the person on the other end (which is a HUGE CLUE OF SCAM).

Got a call from this place aboslutley rude. Told me they were going to serve me. PLEASE DO! I told them I do not do business over the phone or email. If you can mail me any information I will give you a call back. They refused. They said information had already been mailed, gave me the address. I said that is not my address. If you can mail me information to MY address I will call you back. They refused again. I said multiple times the address on the account was not mine. AND the contact on file were not mine. AND the occupation they had on file was not my current occupation. You're going to serve me, but you have no idea what my address is, no idea was my place of employment is, no idea what my current phone number is? This place is a joke. I welcome them to "serve" me, I would love my day in court. It's against the law to give out certain information when it comes to these situations, information they gave out to the multiple people they called trying to contact me.

All who know them are aware of what kind of person they truly are. They will never again know respect. They'll never respect themselves & they'll never garner respect from others. Legitimate debt collectors adhere to the FDCPA. It's as simple as that. If a collector is not adhering to the FDCPA, he's a fraud. Pay him nothing. Case closed!

I received a few calls from this number as well. Cannot think of who they would be, All they say is the case number and its an important legal matter. Well I would rather be served and have a day in court than to talk to someone who is probably trying to get me to pay for something I never did or something that was paid eons ago. I HATE these people. Just say who you are and what its for or stop calling.

My mother-in-law got a called looking for my husband saying her number was the contact number he left with this company....which they would not say who they were juat that it is very very important and here is his case number. First of all, there is no reason my husband would give out his mom's number as contact information, she doesn't live nearby and it just doesn't make sense here. Second she has only had this number for a year and I cannot think of one thing he would have outstanding debt with in the last year.  I called the number they left and the automated answering system said it was NCS offices working to collect debts.

It doesn't make any sense. I will have him call to see what they say to him but after reading everyone else's posts, I am also thinking SCAM!!!!

Guy claiming to be with NCS Legal Services.  Wants me to call the legal department to clear up a claim or they will serve me papers.  That's insane!  I hung up on him.  He called back, told me where in the building I am.  I told him to go ahead and come serve me.  I highly doubt anyone is coming.  If they are, great.  I'll have my attorney deal with them.

Got a call from an unlisted number on my cell phone and work #. Female l/m that this was her last attempt to contact me and would locate available (tried to sound like she would use the cops to find me) to bring charges. She provided the 877 # to call back. I believe this to be a payday loan co collector that I owe money to. I would like to have a day in court as her voicemail suggests but I suspect that will not happen. Based on prior pattern, I should receive about 3-4 calls to each telephone number today then another series tomorrow in an attempt to scare me in to calling back.
