This is a long summary, but you need to read it carefully if you think you are being threatened by a debt collector.

The Fair Debt Collection Practices Act (FDCPA) includes statements such as this:

* Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.   ["Written" means snailmailed ... not emailed or texted]

* Debt collectors may NOT
- repeatedly use the phone to annoy someone.
- falsely claim that they are attorneys or government representatives
- falsely claim that you have committed a crime
- falsely represent that they operate or work for a credit reporting company
- say you will be arrested if you don?t pay your debt
- say they?ll seize, garnish, attach, or sell your property or wages unless they are permitted by law to take the action and intend to do so
- communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.
- say that legal action will be taken against you, if doing so would be illegal or if they don?t intend to take the action
- use a false company name
- take or threaten to take your property unless it can be done legally;

The debt collector may not garnish your wages unless there is a court order to do so.
+ Many Federal benefits (including Social Security Benefits) are exempt from garnishment

You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000,

Report any problems you have with a debt collector to your state Attorney General?s office, the Federal Trade Commission, and the Consumer Financial Protection Bureau.

Got a called with a message from the  company name KR Capital. Saying that they need a verbal statement from me before they place a judgment on me. I am confused no more information was given. I get a little nervous . Not sure if it is a scam??

I get this jerk calling at least once a week. It's a taped voice saying they are looking for a person that does not live here nor do I know. I finally called the number back and the a** who answered said I had the wrong number. It WAS the same voice on the taped calls and I told him so but he kept saying I had wrong number but NO I didn't. Stupid !

I am getting calls from this number telling me about some bank problem that I am unaware of. They somehow got a hold of my father's number and are calling him asking for me. Is this legal and who are they. I think it is some sort of scam. Am I right.

This number called my husbands work and said that if he doesn't contact their arbertration for a bad ck. which we don't use ck's. Haven't used ck's for years so have no idea what this is about. The company calls themselves K R Capital 1, never heard of them.

Any body that calls you without sending a letter of intent of owing is a scam.  If they threaten to go to your work.  A summons depending on your county and state will be issued through a sheriff to appear in court for a warrant in debt for example in VA.  you show up and tell your side and a judge decides judgement.  A judgement can not be made against you unless you don't appear.  You have to be notified throug proper channels.  There are laws in collection that they have to follow or can be fined.  This particular company is in violation and you should keep notes and records of this and file against them through the FTC, I believe this is who you should contact with grievance.

We had the same call from the same person and it appears that they live and and have a law firm that they are calling from in our area.

This is a scam. If they really had something you would not be warned about the service. Your would be served and have either a certain amount of time to respond or a court date. As a private investigation firm we serve papers like this all the time and we do not warn the recipient

I received a call from Adam Green as well stating the same thing about being served at my job or home. And for me to call Ken Morgan when I called I spoke with a Bob Peters I thought it was about a bank I owed money to but it was a long I had with someone else. I made arrangements with him but now I don't know if I am paying the real creditor back. please someone advise.

Received call from a relative said for me to call Stephanie Valentine when called had a hard time getting the name of the company.  Male started reciting my whole ssn# with me verifying who I was, then got mad at me because I wanted more info tole me to pay over 400.00 don't know to who and why.  Called back female did same thing and they both hung up on me and I still don't know how I got involve in this!!!!!!  Plus they have called everyone from California to New York telling them I have a bad check, but wont give the info I need to find out what going on!!!!!!!1

I just received the exact same call as COS word for word but about a relative.  Call came from a private number with the same names and all.

i just got this same call, from Adam Green from a law office in my county.  a courtesy call before they served me.  wanted me to call Paul Stevens or Kenneth Morgan. When I called he 800 number the person that answered sounded exactly like the adam greeen that left the message.

I received a call from this number and they said that they were a representative here in leon county, Kenneth Morgan gave a case number and a number to call they were going to serve me a summons and I have been notified.  Said this is a bank issue.  I returned the call and got no answer.

Caller id said Private Number.  Caller stated their name as Andre Bownan.  Got a call stating they were from a legal firm regarding a summons that we were going to receive.  Said the call was a "courtesy" call prior to being served.  Caller's voice was garbled.  Left the phone number and a case number.  Said it was a "bank issue", but didn't have the details.
