I also received a phone call from someone called Jay Rodriguez who works for Atkins and Jacobs and they are ruthless debt collectors.  My daughter filed a bankruptcy and had it discharged.  Part of this was an over-drafted account with US Bank.  I explained this and they said that this can't be included in bankruptcy and that they have the District Attorney's Office ready to file charges and she will have to face a judge for check fraud.  I called her attorney who did the bankruptcy and he said that is absolute BS.  Tell them to serve her and be done with it.  He said she no longer owes this debt and they are lying.  He also said it's common for people in foreign countries who try this same tactic.  So just letting you know, they are some of the most ruthless debt collectors and it sounds like they use scare tactics to get you to pay.  Be aware!

this suposed lawfirm has been calling several.of.my family members looking for me regarding a us bank account as well. They sold me some BS story about how the bank sold my account to a collection agency and then a brokerage firm purchased it from the collection agency and now the brokerage firm is sueing me. he even said that the brokerage firm wanted to press charges on me which absolutely made no sense at all when there was no criminal charges involved. the whole thing sounded like a big joke. I contacted the court house and they told me that law firms do not make phone calls they will only serve you papers and that if I hadn't been served any papers to not even worry about it they then advised me to call the bar association who can tell you if this is even a real law firm and I did they could not find any law firm by the name of atkins & jacobs they didn't have any law firm in their database that even had Atkins in the name. This is deffinitley a scam and the Bar Association advised me to report them to the attorney general's office which I did and the rest of you should as well.

i spoke to us bank and informed me the sold my debt i didnt know they can do that but i did paid less with them than what us bank was charging only thing is who takes it off my check systems?  plus reading these blogs are discouraging i do see the rights we all have but man why are some yall telling us how to avoid it.  dont get me wrong i used some of it and thank yall but thats messed up.   peace yall

The only thing that will happen is your credit will get dinged, it may be a terrible credit score, forget about it!  They will charge it off and in 7 years it will go away!

You could declare bankruptcy which is TOTALLY LEGITIMATE!  Not hard and not expensive.  You will feel better.

These collectors are NOT CALM!  :)  THEY lie and are rude.  They probably get paid minimum wage and ony make any extra $ when they bully you into paying.

I spoke to Frank He informed me of my debt i remembered my son did this and left it alone (im not gonna press charges on my son for the fraud he did) and i spoke to a lawyer  he informed me to pay fortynine cents on the dollar and he took it. My only issue is these blogs.

Yea i just got off the phone with the guy. He claimed i was 1065 in debt with US BANK and he even said that he could negotiate the price for me. He brough it down to 600 even but i only owed them 493.99 from the beginning but he claims i had a tone of overdraft charges. I was going to send him the money tomorrow good thing i came across this forum. He also said that this debt would be in public records and that i would be followed for 15years if this debt wasnt taken care of...smh i just hope you guys are right and that this isnt a legit company

Some lady left a message on my phone said they  tried to serve the papers but couldnt get him and wanted to know how I wanted to continue.  I was clueless because I havent filed papers on anyone, so I called the number back only to speak with some idiot man who was looking for someone else ( yes I knew who he was looking for ) but because he didnt seem legit I wouldnt give him any information. Someone called my father from an unavailable number looking for me regarding a legal matter and wanting to know where I might be found so that their process server might serve me papers on a private matter. The caller would not give any information and gave the name of what they said was a legal firm called "Atkins & Jacobs" and they gave me a "case number" along with a telephone number 1-877-686-0619 where I might call and speak to them regarding the matter.

So, after receiving the message from my father, I called, the man who answered said that his name was "Mr Cruz" with "Atkins & Jacobs", he asked how he could help me and I proceeded to tell him someone called and urged me to call, I gave him the "case" number which was provided, which after several minutes, he could not find, he asked for my name again and a few minutes later said that I had written the number down wrong. He tells me that they are attempting to collect a debt on behalf of their clients "RM Funding & US Bank" regarding an overdraft protection issue and that I will be sued for fraud in federal court for the amount.
I explained that I am homeless and broke and have no means to pay them. He asked for the address where I would like to be served. He already had the address of my parents. I did not tell him otherwise.

He then told me that this matter can still be resolved but that it must happen soon or they will have to proceed with legal matters. He gave me 48 hours to come up with a settlement offer. I told him that I will try and see what I can come up with to try and resolve the matter.

Mr Cruz then gave me his personal number to contact him in order to resolve the matter.

The number he gave me was 909-303-7040.

I do not know what to do.
