They called and said owed money for a previous payday loan dated back to 2008.  When I asked all sorts of questions they had to keep putting me on hold.  I refused to pay and they told me good luck.

These people got me.  I am recovering from major spine surgery and I answered their call.  I thought they were representing a current card I had got behind on.  The Company is Capitol One and I have a card with Credit One.  So I thought I was setting up a temporary arrangement to pay $50.00 a month until Feburary and then I would pay off with Income tax.  Well I did not pay attention to my account balance last month and they hit me for 159.90.  I was able to dig into my bills this month and saw the hit to my account again for 159.90 which put me into overdraft.  I called them and asked what they were hitting me for they said I agreed and that I gave them my card info.  I explained that I did not remember authorizing this.  So the guy went all attorney and started saying that they had my agreement on tape because they tape all their calls for protection,  So I asked to hear the call and he said I could in County court.  He said if I stop pay on the card they will take me to county court and prosecute me for check fraud.  But if I could pay them $250.00 right now it could go away.  So it is either $250.00 right now or they will hit my account for the next 4 months.  So I have already been out $380 that I can't get back because I "Authorized it" and they will get over another $600.  So I don't know to settle now or try to just stop the BS.  But since I paid a collector on a very old debt from at least 1998 from what I remember, I have to pay it off now don't I?

I did not get a call from this company.  However my checking account got hit for 151.97 yesterday,  The reference on my online banking info show this number 877-720-6428.  I have no idea who this is and when I called the phone number it went to a voice mail. So I can't even call and verify this,  So I will be at the bank Monday to have this stopped and reversed.  The stop fee is way better than paying some one 151.97.

If I'm reading this correctly, you want Capital One to assume responsibility for illegal third party collection phone calls Cap One *did not make*? Have you thought about how that sounds? By your story, Cap One never issued you the credit, making your demand more absurd.

On its face the claim may be for phantom debt. However, Cap One bought the majority of credit card accounts from HSBC a couple years back, and either one could be underwriting a store card or card brand you once held. Where this falls down is in the hostile collection method. The crap about "fraud" implies criminal offense, which is not how American consumer debt is classified. The lawsuit threat was empty, and the "mediation" story is to fool you into thinking the collector is not a collector but some innocent middleman.

That's all fodder for a fine FDCPA suit, not a "character defamation" complaint. This isn't a personal insult, it's just dirty business.

Recvd call with a company web address that is overseas law firm.  Collecting on a dedt from Capital One from 2001...I did not have Card.  But they had my SS#, previous address, dob. Said I was being sued for fraud & 2 other charges.  Said I could settle thru mediation for a ¼ of the total amount I was to have owed with 11 yrs of interest.  After the shock of fraud & not knowing anything about this I started to come out of it & threw some  qustions at them that I knew would deflate their claim. They went as far as asking if I had dogs or guns on site so deputy could serve.  I live in small town and have for 13 yrs.  I know all the deputies & they know me as I instructed.  They went from representing them to me pro bono but I had to agree to that ¼ amount right then.  My proof should have been a simple I do not owe but they went back to representing them.  We lost connection and he called back on a 202-733-&%$# .............Being accused of Fraud is a defamation of character and using a cc company that is legit should fall under their responsibilities to stop the calls..would it not?

I'm having the same exact problem with this company. But I sought legal representation who explained they have to validate that I owe the debt and he would be happy to send them a letter. They can't even tell me who I owe. So I call them back and ask for their address and he flat out refused to give it to me. He was real argumentative and pretty much on the defensive. He has been telling me they are seeking legal action. At this point my attorney and I are waiting to receive the papers.

Got a call from this number today.  A lady named Victoria Carrington with the Offices of MCI.  She left a message saying that she wasn't sure if I knew I had a claim against me and that if I would call back to 877-720-6428 ext 10023 (I think)...she would be glad to assist me.

I too have gotten this call before and it started with the dishonored check explanation and when I said that wasn't possible, the fishing expedition began...maybe it was a payday loan, etc.  I did not give any information and asked that that I receive a letter with any information that they had.  Of course I never received anything!

Not even going to waste my time calling back....

I got a call from Jennifer Taylor (877-720-6428) ext 1002, Incoming # shows as 202-733-6716.  It was a very professional sounding letter, however, it was for my ex.  Our divorce was FINAL almost 4 years ago, so their record-keeping is obviously not very good.  I called her back from an untraceable number & left her a voice mail saying 'good luck, everyone is trying to get a hold of him & you're all barking up the wrong tree, he's never even been in this state, divorce was final almost 4 years ago.'  If she's SMART, she won't call back.

What a comedian. What's he got on his "stack of papers", Chinese take-out menus? Flyers for the garage sale he's holding back home because his job as a fraud jockey is paying dirt? He can fold paper airplanes with those "complaints" for what they're worth, if they even exist, which they don't.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

I received a call this morning from this number. They stated that I had a payday loan dated back from June 15, 2011 for $300. They had all of my information and bank information. The funny part is that during that time frame, I wasn't working and was going through a divorce. So, do I ignore it and take my chances?

Getting voice messages from "Chad" saying he has an URGENT message about a complaint filed by MCI.  Today he left another one saying that he is going to leave "this stack of papers on my desk as long as I can" until I call him back.

I have gotten scam calls so many times now I wouldn't know a legit call if it happened.  I'm glad to read everyone else's posts.  It helps.

Take care, everyone.  What a drag this can be.

Empty threats of a creditor suit are illegal. When you get the hurry-up settlement offer to supposedly placate the "legal department", that's a pretty good sign of fraudulent debt collection.

.  .  .  .  .  .  .  .  .  .  .  .  .  .
Whether you are called a debtor or some collector thinks you can flush one out, you have rights and options. Many are simple to exercise if you only learn how. You are granted control of how you are contacted, the right to dispute debt claims, and the means to sue violators at low cost. The FTC and the CFPB can start you on your homework. See also if your state laws grant additional or stronger rights.

you've missed the many voices who tell you that consumer debt in America is *not a crime*. Some thug on the phone telling you otherwise creates the fundamental flaw which destroys his entire false debt claim. The threat is illegal and the "collector" is an extortionist whom you should sue if you can find him. (Until Gujarat Province is made the 51st State, you might be out of luck.)

You're still owed a dunning letter on paper, to be sent shortly after first contact. At a guess, nothing went out two months ago and the collector wants to fool you into not invoking your right to dispute claim.

I received a call from this number from 877-720-6428, the caller was Christine. I need to call in reference to some file number, I don't think so. It is sad that people are so heartless to call and prey on others this way. Valid collection companies must let you know "they are attempting to collect a debt."

rec'd a call from "Chad"  on 877-720-6428- told me I am going to be served today for a dishonored check to a cash advance company.  I told him that was impossible and hung up on him.  He called me back on 202-733-6717 and said sorry we had been disconnected.  I again told him that I did not have a dishonored check.  He asked me if I wanted to speak to their "legal" dept, and I said please mail me the information so I can verify it, and hung up.  He called back again on the 202 number and left a message that he needed to verify my address (which he read to me - but is NOT my current address - many years ago - prior to marriage) and email.  He asked me to call him back on the 877 number so we could take care of this before they serve me.    I called back and told him again, I did not have any dishonored checks and they need to remove my phone number from their scammer list.  He asked if I wanted to speak to his supervisor and I said sure, if he'll remove my number from their call list.  "Chad" chuckled and said hold on.  Then I was disconnected.  A few minutes later I received another call from the 202 number which I ignored.  He did not leave another message.  I reported this to the FCC.
