Debt Collector
Just received another call from this number again asking for someone who does not live here.  Can't tell them that the person does not live here because it is never an actual person, nor is there a number to press saying that they have the wrong number.  The man in the recording just says that his name is James Aaron from Asset Acceptance trying to collect on a debt and any information obtained would be used for that purpose.  We receive at least one call a day from this person.  I figure I can hit delete easier than going through the hassle of calling them back.

Thank you...I have the last recorded message, I signed up for Do-Not-Call several years ago & re-registered this year; so,  now I look for  a lawyer who we work on a contingency basis? correct?

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.  

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

So what can you do if you receive "wrong number" calls from debt collectors?

1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

Well Jim Fisher why do you keep calling for Josh A Willis at my home tele when I have informed the brain dead idiots that work for your slimy bucket of bolts that Josh A Willis does not live here on multiple occasions, nor has ever lived here and that it sound to me as if the slime man has been flim flammed!

they called my aunts house and left a message for me i haven't lived there since 8 years ago and can not think of anything i owe should i just ignore them she also is recieving different 800 calls for my cousin who lives there that doesn't owe anything wonder if it just a scam

Debt Collector
They are a dirt bag collection company.  They buy debts that are so old they should not even be collectible.  They call anyone they think might even possibly know the person they are looking for.  In my case I have never heard of the person.

Since they do not seem to want to follow my instructions to never call again, I have turned it over to my attorney to deal with.
