You absolutely CANNOT talk to a spouse until they too are on the actual account as a signer.  If you are talking to spouses that are not signers, then you are breaking the law.  Honestly, how stupid do you think we are?

If you work for Midland Credit Management, then you most likely have enough funds to take a decent English language class.  Please learn how to write properly, speak properly and use proper punctuation.  A company that is operating under proper legal guidelines hires only those employees who know how to answer questions, explain the situation in a simple manner and are reasonable people.  The people I have dealt with at your "company" either do not know how to transfer a call to a manager, hang up when a question is too difficult to respond to and are completely illiterate.  I am being accused of taking out a credit card several years ago and when I asked MCM who the original creditor was and to please provide copies of the supposed charges, I was told that "we don't have to do this".  I was also informed that MCM has "no idea" where the original charges stemmed from.  This is crazy!!!!  MCM is constantly harassing my housemates and refuses to provide back-up documentation.  Until you provide what I need, you obviously will receive nothing. When I write a letter asking you to provide proof, you have to submit it. If not, well, I guess YOU are out of luck!!

they keep calling my phone all hours. i called back they pulled my number and was looking for some maria and carlos. then asked them to take my number off the list. they said ok then 10 mins later called back and asked fro me they have pulled my info from years ago and tried to get more info. I told them that they just calle me and that they were looking for someone else so they need to get their s*** togeather and stop harrasing me and hung up.

Section 809 of the FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf requires 3rd-party debt collectors to give debtors written notice of debt (the key word is *shall*) :
"§ 809. Validation of debts
(a) Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing?

A Collection Agent May Not?

Here are the top 11 actions prohibited by the The Fair Debt Collection Practices Act:

Misrepresent Him or Herself

  A debt collector may not misrepresent himself as an attorney or law enforcement officer.

Use the Telephone to Annoy or Harass

  A collection agent may not cause a telephone to ring or engage any person in telephone conversation repeatedly or continuously with an intent to annoy, abuse, or harass anyone at the called number.

Threaten Arrest or Lawsuit

Contact a Consumer at Work

  A collection agent may not communicate with consumers at their place of employment after being told this is unacceptable or prohibited by the employer.

  A debt collector may not demand any amounts not permitted under an applicable contract or as provided under law.

Contact a Consumer Represented by an Attorney

Private number, only allowing me to know the company name as MCM. Spoke in broken english and refused to give the full company name. He stated that once the party he was requesting to speak to, only then he would give the full name of the company. I have never heard of this person and have had this number for over a year. Such BS that upsets our day to have our phones continue to ring and with little information for an unknown person.

check the statute of limitations in your state.  I got burned by midland recently on a debt from 1997.  
The limit in Florida is 5 years on credit cards and open ended accounts.

Don't let this happen to you.  Ask about the date of last activity on the account.  

They buy old accounts for pennies on the dollar and try to collect 1/2 of it.  

They called me a week later for another account and I offered them 1/3 of the original amount owed,  which I feel is fair because the original creditor wrote it off,  the lady said she didnt know where I got my info,  so I
told her I knew all her tricks and would give her 1/3 only,  take it or leave it.

I get 3 or 4 calls everyday which show up as "out of area" and when I answer they always ask for someone else.  The last call I answered, I asked who was calling and the woman said "MCM' when I asked what they wanted with 'John' she said it was personal business so I don't know if it was for debt collection.  I informed her that I was on the do not call list and that I was tired of getting calls everyday asking for someone else and that I wanted my number taken off the list and that I was going to report them.  Apparently she didn't know that I didn't even have the number and she hung up immediately and (so far) I haven't received any more calls today.

I recently read a great way to stop these idiotic calls. I've had calls from every bank, CU, visa, MC etc asking for some woman named "Tina Fox" and they never stop. (apparently she's using my telephone number)

So I hunted for other peoples solutions.

The best was "I bought an airhorn at the sporting goods store, and now every time these duma**es call me, I blow the air horn into the phone. They didn't stop all at once, but eventually they all stopped calling me!!"

So the next time you're at Dick's or some such place, buy an airhorn, they will stop, sooner or later.

y would anybody call you back when the information you have is either irrelavant or incomplete?? You guys are as dumb as anybody I know, MCM won't Debt validate and when we finally get something back its just a settlement offer!!  I have disputed it costantly and it always comes back verified when alll it is is just a check to see if the address is the same then its "verified", when you have to provide proper proof, signed contracts, with the persons signature with the original contract. MCM has had many lawsuits brought against them and have lost because of harrassing phone calls, threats, and having people that have no first hand knowledge of the account signing false affidavits, MCM needs to be shut down along with all the abusive collection people that call!!

Annoyed says on 2 Feb 2010 that MCM is calling about a Citibank card that her husband never had so THIS IS A SCAM. Scammers are using bought/hacked loan application data to extort payments for fictitious debts from victims and victims' families and friends.

I would call back. Midland is rated one of the highest with working with people. We have become very customer service based. Ignoring it is not going to make it go away it is only going to get worse for you. WE have several options available for payment arrangements.

For weeks I have been receiving calls looking for somebody with my relatively common name. The calls were daily and sometimes I was asked by a recording to wait for a representative. I always asked why they were calling, but they wouldn't engage unless I verified I was the person they were calling, which I would not to an inbound caller.

I contacted my carrier's Nuisance Bureau and asked if these calls, which seemed to be coming from Mumbai [India] could be blocked. The carrier said offshore calls cannot be blocked.

Out of frustration, I cursed the callers and all of their ancestors, but the calls kept coming. Next, I told them to hold while I linked in the local FBI field office, but they clicked off. They seemed to have no respect for US law. Next, I tried to make it fun to take their daily calls by activating a "fart" machine into each call, but the calls kept on coming.

Now this evening, I told the caller that I was a guest staying at the house and would tell my host of their call if could get their name and they said, "MCM." My web search on "MCM" found this forum and I am completely baffled by these calls now.

I am baffled because I have a FICO score over 800 and clearly have not ignored any debts. Yet, it appears that a listed company like Midland, a wholly owned sub of Encore Capital [Nasdaq: ECPG] can hound anyone at any time under the pretense of debt collection. I am afraid to become proactive because of my strong credit standing and reputation in the community. My lifelong policy is to not divulge any personal data on inbound calls.

It seems like I should have the right to take MCM/Encore into the low post for disrupting my household for weeks for no bona fide reason. Encore has a market capitalization of $470 million, so they would make a tasty target, but on what grounds? Any legal eagles out there?

These people start calling at 8am and don't stop till 9pm.  The calls come through as Unknown Name/Unknown Number.  Rob Hansen is the only one of them that would even bother to leave a message and he just said he could be reached at 877-864-3526 x 43544.  I had to ask what company he was calling from and all I got was MCM.  I don't know which debt they might be trying to collect on because I am not calling them back.  I have no desire to be abused or harassed or even threatened by a stranger about my financial situation, like they know more about it than I do.

I keep getting up to 5 calls a day that come through as Anonymous, Private Caller.  They ask for an old employee of mine.  When I explained she no longer worked for us that didn't seem to do the trick they keep calling.  Finally I just told them that she was with a customer and could I take a message.  Finally got given 877-864-3526 ext 43554 and her name is Carrie.  All she would say as well is MCM as the company name.  I wonder what I'm going to have to do to convince them she no longer works for us so that they quit calling!!!!

Called at 10:36am. I have got calls from them before but never answered because it come up "unavailable unknown number". I got Angie from MCM ext. 43542. I said I wasn't who she was trying to reach and she gave me the number, I then said okie, bye and hung up. She sounded confused that I didn't ask anything else. strange. I'm not calling them back.

"Josh Springer" from MCM called, asking for my landlord.  The conversation was awkward, as he didn't want to give me any information regarding his reason for calling.  He did give me a number 877-864-3526, extension 43519.
