Lady called my job saying they were going to serve me and she would speak to my supervisor. She was a bit rude when I explained that my supervisors would not speak with her even if she asked. She then went on to say that they were going to contact my HR department to schedule a time for me to be served. LOL. ok  i let 10 mintues pass by I googled her number and this thread popped up then I called her and told her I needed to set up a time to be served she ten said I needed to speak with the "attorney" Jonathan Daniels, I said can you put him on the line she then went on to say that he was not at his desk and to call back in 20 mintues I told her I owuld and we hung up

MORAL OF THIS STORY:

This company is fraud and I am going to sue the hell out of them.

I have also received calls only now the name is Melissa Sanderswh AttorneyJonathon Davis.  Saying if I do not call back today and am unvailable to receive the summons I will miss my court date and should turn myself in.  Also said she would be contacting my HR dept and boss.  No clue what it is about - no bad checks in my past.  Sounds so much like  scam.  Feel like callingback and harass them with the law.

I received a call from this Sharron Daniels person 12 times at my job today and she stated that by the end of the day, I would be served and possibly arrested. I told her not to call and so did my supervisor and she stated, " I will call all day and everyday until you pay or go to jail. When my supervisor called the above number, she doesnt state what law fir she is calling from, she just says, "this is Sharron". We asked to speak with Attorney McAuthor and she said she will give him the message to call us later. I called the Attorney Generals office and the Rep stated that this sounded like a scam. At first Sharron said that I wrote a bad check in 2009 so I am being charged with fraud and then she left a message at my job to say that I was being served for a hearing concerning my children. Beware! Also, she has called from this number 716-418-8652. BTW, no one showed up at my job!

Consumers across the country report that they're getting telephone calls from people trying to collect on loans the consumers never received or on loans they did receive but for amounts they do not owe. Others are receiving calls from people seeking to recover on loans consumers received but where the creditors never authorized the callers to collect for them. So what's the story?

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

You are absolutely right that bad checks are a different situation not to be confused with simply a debt situation i work for an attorneys office in new york and many people get the two confused they often forget bad checks are against the law and feel like they are being wronged when in fact it is totally different ball game and bad checks hold different consequences then debt and unfortunately it is too late by the time they learn the difference pay your bad cks!!!!

The caller has violated your rights under the Fair Debt Collection Practices Act. A debt collector (even an alleged attorney) cannot threaten criminal charges for failure to pay debt (bad checks are little different, so call a lawyer immediately).  Also, pay day loans are illegal in Pennsylvania.  In addition, a debt collector may not say that they have initiated a lawsuit against you, unless she/he/it in fact initiated the suit.  It sounds to me that you should talk to an attorney about suing the attorney/debt collector for violation of the law.  You could be entitled to money damages. David and Erica, you should contact a criminal attorney.  Good luck.
