FTC Goes After Credit Card Robocall Scammers

The Federal Trade Commission just announced its second major law enforcement effort this year targeting telemarketers who violated the Do Not Call Rule and other laws by making hundreds of thousands or even millions of pre-recorded robocalls to consumers. The cases announced target three groups that allegedly made robocalls to sell worthless credit-card interest-rate reduction programs for hefty up-front fees of as much as $1,495. At the FTC’s request, in each case, the court has issued an order temporarily halting the robocalls pending trial.

The three complaints announced today follow two filed in May that led to court orders stopping other telemarketers from using robocalls with deceptive claims about extended auto warranties.

According to the FTC complaints, Economic Relief Technologies, LLC, Dynamic Financial Group (U.S.A.) Inc., and JPM Accelerated Services (JPM) and related defendants made illegal pre-recorded robocalls to consumers, using names like “card services,” “credit card services” or “account services.” The robocalls allegedly claimed the defendants’ services could lower the interest rate on consumers’ credit cards.

In each case, consumers who pressed 1 after hearing the automated call were transferred to live telemarketers who allegedly misrepresented that consumers could dramatically lower the rates on their credit card. The telemarketers also said consumers would save thousands of dollars in a short period of time by lowering their interest rates and would be able to pay off their debts faster – for an up-front fee ranging from $495 to $1,495.

The defendants then falsely stated that if consumers did not save a “guaranteed” amount – typically $2,500 or more – they could get a full refund of the up-front fee. However, after securing the fee, the defendants allegedly did not negotiate lower rates on behalf of consumers and provided few refunds to those who were dissatisfied with the service.

The Economic Relief Technologies defendants also allegedly operated a related scam: using names like “Auto Protection Center” and “Warranty Services,” they tricked consumers into believing they were affiliated with their vehicle manufacturer or dealership, and falsely stated that the consumers’ vehicles’ warranties were about to expire.

The lawsuits allege the defendants broke the law by making illegal robocalls to consumers, and that their deceptive sales pitches violated the FTC Act and the FTC’s Telemarketing Sales Rule.

Additional charges include: 1) calling consumers whose phone numbers are on the National Do Not Call Registry; 2) calling consumers who had previously asked not to be called; 3) failing to transmit their caller ID information, as required; 4) “spoofing” or masking their caller ID information; 5) failing to promptly identify themselves, the purpose of their call, and/or the nature of the goods or services they were selling; 6) improperly abandoning calls; and 7) failing to make required disclosures in their robocalls.

Rating: +1 born yesterday - 13 Dec 2009I've had a dozen or more calls from "Card Services", and often press '1' just to waste their time.  I played 'stupid' with one guy until he caught on I was just stringing out the call - then he just cursed and hung up.  On another one, I asked the 'telemarketer' if she thought I was born yesterday and she replied "day before yesterday" and hung up. I continue to be amazed at how low some people can go chasing a buck. Reply

Rating: 0 Tim Fitzpatrick - 15 Dec 2009Let's hope this actually works.  I just got another call from them 5 minutes ago.  I was given the option to press "6" to be removed from their call list, but, when I pressed "6", nothing happened.  I get calls from them about once a month, on my "do-not-call-registered" cell phone.  My kids get the calls too.  They always preface the pre-recorded message with "President Obama...." making is sound more official.  REALLY annoying and deceptive practices.  I really hope they not only shut these people down, but give them jail time for fraud. Rating: +1 stevenw - 19 Dec 2009So not only are these guys being sued for blatantly committing  pretty much every possible violation of the law a telemarketer can commit, there are actually federal court orders restraining them from making further robo calls as well, yet they are still doing it!    They don't care they're breaking the law; they don't care they're violating court orders and they don't care if the FTC is suing them.  Why?   Because the worst they face is a series of fines that are so miniscule compared to what they are making it's more of a joke than a punishment.    These crooks have to be prosecuted criminally and be subject to serious jail time or they will never stop.    Nothing else will have any impact on these sociopaths. This is so annoying. I'm about a week late with my GMAC payment and I've spoken to them and have an agreed-upon arrangement to pay in another week. Yet they're still calling me over and over and over and over. When I call the my GMAC contact she tells me collection efforts should stop. Yet they just keep calling and calling -- from 8 a.m. until 9 p.m. and from all different numbers. I realize I'm late on a payment and that's my fault, but when you've spoken to the company and are working with them, doesn't the repeated calls break the harassment law? The FTC's website (http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre18.shtm) says they can't "repeatedly use the phone to annoy someone."

It is GMAC.  I was first late a few days, and the calls started.   All day long.  I never give my work number.  Now, I intentially pay 29 days late every month.  They can't report it to the Credit Agencies until it's 30 days late.

Just to help out, you legally have the right to tell them never to call you at work!
You can also send them a cease and desist letter to stop calling you completely and to only contact you by mail, it has to be sent certified with a return receipt. And it includes their collectors or any one else they want to have call you. Just check the laws where you live.

It IS GMAC, they have call centers all over the place, YES even in other countries!! This has been done for years!! My b/f was in an accident and couldn't pay his bill for a couple of months and they hounded us day and night calling every 20 minutes for 3 hours on a few days. So after going over everything with them several times and them telling us ok with a payment arrangement they still kept calling... bunch of jerks!!!! I could see it if you are constantly late but not when something happens and you speak to them and they make arrangements with you for that. Totally unprofessional.  They won't leave messages because it is illegal for any debt collector to give out any information about what any one person owes to anyone else. If they cannot speak to that person they don't want to risk leaving that information for someone else to listen, it leaves them wide open for a lawsuit. And most of the idiots at the call centers are lucky if they can read the computer screen prompts in front of them, just like calling Dell!!

I haven't been late on a frickin' car payment in 3 years, I am late by two days and these harassing idiots will not let up!  Just to be a beeotch, I am NEVER going to answer and I'll hold my money for a few more days!  Who cares about a credit rating.  It doesn't matter if you have perfect credit, bad credit or NO credit, NO ONE is giving out loans for cars (unless you want to pay 30% interest)...so I will hold my payment and use the money for maintenance and repairs on my older car.  GMAC has obviously 'oursourced' their collection department.  Outsourcing is what contributed to their bankruptcy in the first place!  Use my tax dollars to make my payment...instead of toward your bailout!

These people are calling for GMAC or are GMAC debt collectors.  They call from 3 different 800#, and yes starting as early as 8:10 am in the morning and calling non-stop until quite late in the evening.  GMAC is awful, I will never finance a vehicle with them again!  If they don't have your payment the day it's due or the day after the calls start coming.  Even if you've made the payment and give them the info. they won't stop calling until it gets to them.  I think they are worse than some credit card debt collectors.  I realize they want their money, but give me a break.  Sometimes the payment might be 1-2 days late.

they have called me more times than I can call in one day. It starts at 8 am and continues until 9 pm. I also have been getting calls from GMAC but they always leave a message saying to call them back and when I do it is them. I have been late on a couple car payments by a couple weeks and when you call them back they ask if they can leave messages, this number never does.

They call every morning at 8:30. They seem to hae switched to 10:30 recently, however.
The caller will not provide a company name to anyone other than the intended recipient of the call. They will say, "It's a personal matter between us and [name]."
I Googled information on this and found that the company is claiming to be GMAC.
However, I called GMAC and they do not have 1-888-213-0451 anywhere in their contacts.

I feel that it should be made a felony and the responsible parties jailed for making these illegal calls. I am also on the do not call list. The prerecorded voice was sara. I keep receiving these calls and am tired of them. Reply

I agree. These people should be locked away with the key thrown away. I honestly don't think the calls will stop. They will just get new numbers and continue on with their scam. Reply

I have tracked down the Company today providing the Caller Id for these numbers and they are working with the FCC to stop them. They need our help as well to let them know the time and date and number that called you.

Rating: +1 stevenw - 19 Dec 2009So not only are these guys being sued for blatantly committing  pretty much every possible violation of the law a telemarketer can commit, there are actually federal court orders restraining them from making further robo calls as well, yet they are still doing it!    They don't care they're breaking the law; they don't care they're violating court orders and they don't care if the FTC is suing them.  Why?   Because the worst they face is a series of fines that are so miniscule compared to what they are making it's more of a joke than a punishment.    These crooks have to be prosecuted criminally and be subject to serious jail time or they will never stop.    Nothing else will have any impact on these sociopaths.
