Talk to a lawyer. In Louisiana if you send a post-dated check to someone it clears you of fraud/felony charges because they knew that there was not enough money to cover the check when written. Mostly that is to deter payday loans. It gets complicated so talk to a lawyer.

I continue to get calls from this number as well as others looking for my ex-husband who I have been divorced from for close to 20 years now. I am left a recording and call them back and request they stop calling. This is NOT a debt I owe with him, my credit is excellant. I live in NY state which he has never lived. I am tired of these calls!

I filled online complaints yesterday to both the Florida State's Attorney and Texas State's Attorney offices.  No calls or emails back from either office as of yet, but assume that will take more time.  I also may contact a law firm Khons & Moss that specifically go after collection agencies.  I spoke with them before but they didn't recognize CRS, but said if I can verify it is a legitimate collection agency (meaning it's not completely made up company/fraud) then they may be able to do something.  I just want them out of my life, and if a phone call, letter or inquiry from either the law firm or attorney's office does the trick, I'm happy.  This guy is a sneaky, deceptive, and cold SOB!

I just recieved the same call from the same person (888-241-7827) claiming to be an "investigator" (misleading to infer an officer of the court or law enforcement) and that he was verfifying employment to garnish my wages.  When i explained that I had not recieved any court documents, he claimed that they didn't need a court order to garnish my wages (this 100% NOT TRUE).  Both of these comments alone violate the FDCPA 559.715!  These guys should be shut down!  If anybody knows who or where I can file a compliant I will certainly do so!  Collecting a debt is one thing, lying, misleading and using harsh fear tactics is another not to mention he was quite rude!

I received a call from 888 214 7827  The man said he was a Mr Greg Wallace and he wanted to talk to a Mr. G. Allen .  He said he was with CRS and it was about a case #3638532 that he need to make a decision on  what to do on  it within the next 24 hours  I told him no one by that name lived hear and never heard of that person before.  He said thank you and we hung up.

He did say it was about a fraud case

I rec'd several calls from reps from Commercial Recovery Systems - last set of calls came from a Mr. Clock (1-800-214-7875)     Was told that I had a judgement coming to me due to repo of my car in 2008.    Kept calling me about the judgement - I told him fine - send it to me - then he came back and said they would settle the account for $3700 - I told him I do not have that kind of money but that I would try and borrow money.   Around Christmas he told me the only way to "hold" this $3700 amt for me was for me to FAX him a check made out to CITI for the amount.   I asked him "what if I can't get the money - will the check be held against me?   His answer was no - it will not.  I did as he requested (Yes, I Know, STUPID, STUPID, STUPID)  I tried to come up with money but could not - so I closed my account and called him and told him I could not get money - I then was told "you have given a fradulent check - and since it was over $1,000 it will be a felony - I am going to turn this over to District Attorney in Texas and you will be arrested.    I told him I had $500 I would Western Union him on check and the balance would come in increments - I was told "NO - must have ALL $3700)   The last time I spoke with him was last Thursday morning - I placed two calls to him to advise I could not get the money - he called back and said I had until 1:00 to wire him the $3700.  I called him back and advised I could not wire him the money - I did not have it - but did have $500 I could Western Union him)    He called back and said "NO - you will be arrested and I will have papers served on your for judgement, and then he hung up on me.    (He did tell me in one of those phone calls that he would tell the District Attorney that I did not "intentionally" give them a bad check.  (Faxed Check to them.)   I have been calling my sheriff's office 3 times a day since last Friday to see if any papers are being served.    Last night he calls and speaks to my sister (she did not know about any of this)    I was at my nephews baby-sitting his son.    He tells her EVERYTHING about my situation and leads her to believe he is sheriff. Tells her he is sending my "bad check" to district attorney then.  I was frantic when she told me and I called our local sheriff last night and was told "No papers are here, and no one from our dept. calls to tell you about papers."    I called sheriff again this morning and was told "no papers are here" - I spoke to sheriff that serves the papers and he advised "no papers are here."        

Yes, I know it was stupid to fax the check (he said he could use that as Automatic Draft from my account) but - does anyone know if what he said is correct about me being arrested?????    Please Help Me.    I am a wreck - have had to contact a therapist because frankly I could jump off a cliff and never feel the pain.

There is a statute of limitation on debt and if you paid without validating it - you were pretty stupid and did not HANDLE IT CORRECTLY

What types of debts are covered?

Can a debt collector contact me any time or any place?
No. A debt collector may not contact you at inconvenient times or places, such as before 8 in the morning or after 9 at night, unless you agree to it. And collectors may not contact you at work if they?re told (orally or in writing) that you?re not allowed to get calls there.


How can I stop a debt collector from contacting me?

If a collector contacts you about a debt, you may want to talk to them at least once to see if you can resolve the matter ? even if you don?t think you owe the debt, can?t repay it immediately, or think that the collector is contacting you by mistake. If you decide after contacting the debt collector that you don?t want the collector to contact you again, tell the collector ? in writing ? to stop contacting you. Here?s how to do that:

Make a copy of your letter. Send the original by certified mail, and pay for a ?return receipt? so you?ll be able to document what the collector received. Once the collector receives your letter, they may not contact you again, with two exceptions: a collector can contact you to tell you there will be no further contact or to let you know that they or the creditor intend to take a specific action, like filing a lawsuit. Sending such a letter to a debt collector you owe money to does not get rid of the debt, but it should stop the contact. The creditor or the debt collector still can sue you to collect the debt.

Can a debt collector contact anyone else about my debt?
If an attorney is representing you about the debt, the debt collector must contact the attorney, rather than you. If you don?t have an attorney, a collector may contact other people ? but only to find out your address, your home phone number, and where you work. Collectors usually are prohibited from contacting third parties more than once. Other than to obtain this location information about you, a debt collector generally is not permitted to discuss your debt with anyone other than you, your spouse, or your attorney.

What does the debt collector have to tell me about the debt?
Every collector must send you a written ?validation notice? telling you how much money you owe within five days after they first contact you. This notice also must include the name of the creditor to whom you owe the money, and how to proceed if you don?t think you owe the money.

Can a debt collector keep contacting me if I don?t think I owe any money?
If you send the debt collector a letter stating that you don?t owe any or all of the money, or asking for verification of the debt, that collector must stop contacting you. You have to send that letter within 30 days after you receive the validation notice. But a collector can begin contacting you again if it sends you written verification of the debt, like a copy of a bill for the amount you owe.


What practices are off limits for debt collectors?

Harassment. Debt collectors may not harass, oppress, or abuse you or any third parties they contact. For example, they may not:

use threats of violence or harm;
publish a list of names of people who refuse to pay their debts (but they can give this information to the credit reporting companies);
use obscene or profane language; or
repeatedly use the phone to annoy someone.
False statements. Debt collectors may not lie when they are trying to collect a debt. For example, they may not:

falsely claim that they are attorneys or government representatives;
falsely claim that you have committed a crime;
falsely represent that they operate or work for a credit reporting company;
misrepresent the amount you owe;
indicate that papers they send you are legal forms if they aren?t; or

Unfair practices. Debt collectors may not engage in unfair practices when they try to collect a debt. For example, they may not:

try to collect any interest, fee, or other charge on top of the amount you owe unless the contract that created your debt ? or your state law ? allows the charge;
deposit a post-dated check early;
take or threaten to take your property unless it can be done legally; or
contact you by postcard.
Can I control which debts my payments apply to?
Yes. If a debt collector is trying to collect more than one debt from you, the collector must apply any payment you make to the debt you select. Equally important, a debt collector may not apply a payment to a debt you don?t think you owe.

Can a debt collector garnish my bank account or my wages?
If you don?t pay a debt, a creditor or its debt collector generally can sue you to collect. If they win, the court will enter a judgment against you. The judgment states the amount of money you owe, and allows the creditor or collector to get a garnishment order against you, directing a third party, like your bank, to turn over funds from your account to pay the debt.

Wage garnishment happens when your employer withholds part of your compensation to pay your debts. Your wages usually can be garnished only as the result of a court order. Don?t ignore a lawsuit summons. If you do, you lose the opportunity to fight a wage garnishment.

Can federal benefits be garnished?
Many federal benefits are exempt from garnishment, including:

Civil Service and Federal Retirement and Disability Benefits

Military Annuities and Survivors? Benefits

But federal benefits may be garnished under certain circumstances, including to pay delinquent taxes, alimony, child support, or student loans.

Do I have any recourse if I think a debt collector has violated the law?
You have the right to sue a collector in a state or federal court within one year from the date the law was violated. If you win, the judge can require the collector to pay you for any damages you can prove you suffered because of the illegal collection practices, like lost wages and medical bills. The judge can require the debt collector to pay you up to $1,000, even if you can?t prove that you suffered actual damages. You also can be reimbursed for your attorney?s fees and court costs. A group of people also may sue a debt collector as part of a class action lawsuit and recover money for damages up to $500,000, or one percent of the collector?s net worth, whichever amount is lower. Even if a debt collector violates the FDCPA in trying to collect a debt, the debt does not go away if you owe it.

What should I do if a debt collector sues me?
If a debt collector files a lawsuit against you to collect a debt, respond to the lawsuit, either personally or through your lawyer, by the date specified in the court papers to preserve your rights.

Where do I report a debt collector for an alleged violation?
Report any problems you have with a debt collector to your state Attorney General?s office (www.naag.org) and the Federal Trade Commission (www.ftc.gov). Many states have their own debt collection laws that are different from the federal Fair Debt Collection Practices Act. I received a message from a Ms. White at 888-214-7827. She said she was from Broward County Courts, in South Florida. I saw the above from sky1. I called Commercial Recovery Systems. The receptionist verified that the number was one of theirs and that the extension was for Ms. White. I explained the misleading information she left on the message. She left me on hold for quite some time trying to get someone to talk to me. She transferred me to a gentleman who could not find any information and asked for my phone number to call me back. At this point I am very suspicious. Mostly because she is calling from a Collections Agency but saying she is from Broward County Courts. This is false information!! I will post a follow-up when I know more.

I have found out that this is a legit call from Commercial Recovery Systems (www.crsresults.com), a debt collection agency in Dallas, TX. After "Ms. White" claimed to be a rep for them, I called the company directly via number on their site. I spoke with Jack Cecil, he verified all of the information that White had discussed with me. It was a matter involving an old credit card in which the bank (Bank of America) ceased contact with me years ago. I somehow managed to forget that I still had a balance with them, so the debt was turned over to collections...etc. etc. It turned out to be a good thing for me because this company negotiated a settlement payoff that was about 1/4 of what I actually owed with tons of interest and fees. This call may seem strange at first, but my advice is to speak with them when they call. You may be in same boat I was in and have some old debt out there that is dragging your credit score down. I should also say that both people that I spoke with were very friendly and patient...something that I did not expect.

got the same call.....anything come up from it??  I am located in Texas, are you as well?   Before a Ms. White called, kept getting calls from a Mr. Morgan.....never left a company name!  I called number back and he answered, also WITHOUT a company name....  do you think it's legit???
