I received a call from 844 6544217.  They left a message on my machine and my parents machine.  They claimed their was litigation against me and for me to call them back.  First of all, I haven't lived with my parents for 20 years.  They knew my current address and a rental property that I own.  When I called back they began asking questions.  (maiden name, address...)  They then hung up on me.  I called the number back they claimed their computer was down.  They claimed to be WBG Litigation the first time, then B&L the next time.

Under the Federal Debt Collection Practices Act, you are allowed to challenge the validity of a debt that a collection agency states you owe to them. Use this letter and the following form to make the agency verify that the debt is actually yours and owed by you. Keep a copy for your files and send the letter registered mail.

Re: Acct # XXXX-XXXX-XXXX-XXXX
To Whom It May Concern:
I am sending this letter to you in response to a notice I received from you on (date of letter). Be advised, this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.
This is NOT a request for "verification" or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your office provide me with competent evidence that I have any legal obligation to pay you.
Please provide me with the following:
What the money you say I owe is for;
Explain and show me how you calculated what you say I owe;
Provide me with copies of any papers that show I agreed to pay what you say I owe;
Provide a verification or copy of any judgment if applicable;
Identify the original creditor;
Prove the Statute of Limitations has not expired on this account;
Show me that you are licensed to collect in my state; and
Provide me with your license numbers and Registered Agent.
If your offices have reported invalidated information to any of the three major Credit Bureau's (Equifax, Experian or TransUnion), said action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you for the following:
Violation of the Fair Credit Reporting Act
Violation of the Fair Debt Collection Practices Act
Defamation of Character
If your offices are able to provide the proper documentation as requested, I will require at least 30 days to investigate this information and during such time all collection activity must cease and desist.
Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel. This includes any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.
If your offices fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately.
I would also like to request, in writing, that no telephone contact be made by your offices to my home or to my place of employment. If your offices attempt telephone communication with me, including but not limited to computer generated calls or correspondence sent to any third parties, it will be considered harassment and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter.
This is an attempt to correct your records, any information obtained shall be used for that purpose.
Best Regards,

For the last 6 months I've gotten calls from this number, Mr & Mrs Diaz, Mrs Vargas and a Asian lady I can't understand. First time Mr Vargas gave me case number and said he'd sue me and take me to court and that my fees would crazy. That was 6 months ago. Since then I've always gotten calls(very early in the morning 6am and they won't stop). They won't even give me a company name. I've been given 5 different case numbers. They get angry when I don't wanna pay. SCAM SCAM SCAM, DO NOT PAY

Ms. Gomez just called me about a case.  She asked if I knew someone from ages ago when I lived near Chicago, someone now involved in the case and my name was apparently listed as a reference..  Didn't recognize the name so Ms. Gomez said she'd take my name off the list so I wouldn't get called again.

No, using threats to sue is illegal, unless they plan to actually take you to court.  You also don't pay debts through MoneyGram, so I'm sure it's a scammer who called you.  If you actually do have a debt, they should send you a debt validation letter showing original creditor, date of debt, amount owed, date of last payment etc.  They should also give proof (license #) that they are able to claim and collect said debt in your state.

DO NOT pay them anything!  If it is a debt that is yours, then 11 years is likely (in most states, anyway) past the statute of limitations for collection.  Read up on the FDCPA and learn your rights as a consumer.  Bottom line - never pay money to anyone who calls out of the blue, unless they have sent proof that you owe this debt and that they are the ones who bought said debt.

I would tell this David that unless he sends you this information which is legally mandated under the FDCPA, you will not pay a thing.  I would also tell him that you're recording every call he makes to you (even if you're not), that his threats are in violation of the FDCPA and you will seek the help of an attorney to sue his agency for these violations.  Report the calls to the FTC and your state's Attorney General.  You may also want to put fraud alerts on all your bank accounts and with the three credit agencies (Experian, Equifax, TransUnion).

I hope you reported them to the FTC, the FBI and also your state's Attorney General.  I would also give the letter to the US Postal Service - to claim to be District Attorney's office is illegal.  If someone calls or mails with threats of charges, fraud, etc - you can be sure they are scammers!  Read about the FDCPA and know your rights as a consumer.

Bottom line - if it was a legitimate debt collector with a legitimate debt, they would send you a debt validation letter showing original creditor, date of debt, date of last payment, and also whether their agency is legally able to claim and collect said debt in your state.  DO NOT pay them a dime!

OK, shill - except most of the people posting here do NOT owe a debt.  Now are you going to insist someone pay a bogus debt?  And the previous poster is not clueless - you are!  If a debt is legitimate, sure you should pay.  But no one should be threatened and pay on a debt which is not theirs.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

?is seeking payment on a debt for a loan you do not recognize;
?refuses to give you a mailing address or phone number;
?asks you for personal financial or sensitive information; or
?exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:

?Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.?Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.
?Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.
?Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.
?Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.

I recieved a letter from Litigation Management Group, saying that they have been trying to contact me and I have been ignoring them. It also stated that I owe and amount of $3,748.96. WHAAAAAAATTTTTTTT???????? I actually just filed for bankruptcy last year but even then I didn't owe ANYONE that much money. Not even in student loans. So I knew this was BS! I immediately called the # on the letter, which was 888-245-3668 with the name Dean Lawson, Legal Administrator. No answer, left message. Today I get a private call, very very rude man by the name of Mr. Diaz if I'm not mistaken. He said I had a past account with Chase. I said yes in 2002 and it was for 800 dollars that was included in my bankruptcy. I then hung up. He called my work phone and said he would send someone to my job and take me to court, I said good, see ya there, and hung up. We'll see where it doesn't go.
