Debt Collector
I have been receiving blocked calls from someone who gave me this number to call him back. The person I spoke with was very rude. I was going through some domestic issues and was told that maybe the reason that was happening was because I was as smart with my spouse as I was with him. I looked in my email inbox and spam and did not find anything from these people that stated who they were or what the debt was from. Well they sure do stop call you and also tell you to cease and desist calling them, when you repeatedly call them asking for the email information. I had already looked up the number and the "law office" as they could not tell me on my original call what lawyers were in the "law office". They think they are dealing with idiots who will just get scared and pay.

DO NOT PAY THESE PEOPLE. CALL YOUR CREDITOR DIRECTLY. If you can figure out who it is, if anyone at all!

I received a call from this company today. RUDE and OBNOXIOUS were the man's first and last name.
Seriously his name was something DUKE. I eventually told me he had the wrong number after he insulted me and called me names. And he told me not to call him again. I didn't call this man to begin with. He called me by the wrong name and my husband by the wrong name. Now who was wrong.

It's amazing how these people get away with harassing individuals. They call my jib and family as well leaving stupid threatening messages that should be private, because we do have a privacy act that is LAW. They never want to give you information on who they are or the name of their company, and they want to make sure you are who you say you are, go figure. I asked that they send something by mail and they said no.But you are willing to come out and serve papers, really?

The FDCPA http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf treats the INITIAL CONTACT between collector and debtor (first call, first letter, first whatever) as a special event. Legit collectors per section 809 of the FDCPA *must* tell you at initial contact, or send you paperwork within 5 days of initial contact, the following:
1. $amount of debt,
2. name of the current creditor (which may differ from the original creditor who might have sold your debt),
3. a statement that that debt will be assumed to be valid unless you dispute in writing within 30 days,
4. a statement that that if you do dispute in writing within 30 days, the collector must mail you written verification of the debt,
5. a statement that if you ask the collector in writing within 30 days, the collector must send you the name and address of the original creditor if it's different from the current creditor.
If you don't get the 5 disclosures, orally or in writing (you do not have to ask for them, the FDCPA requires collectors to provide them), treat the collector like you would any SCAMMER.
Note that 3,4,5 must be done *IN WRITING* so you will need to ask an address from your collector. If s/he refuses to give you one for any reason, treat the collector like a SCAMMER.
The collector can threaten court action at initial contact but the FDCPA requires that the collector actually take you to court if the collector threatens it. Threatening court and not going through with it (coercion) is illegal.
If they say the FDCPA does not apply to them because they own your debt, the debt-owner exemption only applies to the original owner. A 3rd party who buys the debt for the purpose of collecting debt is treated as a debt collector and not an owner and must obey the FDCPA as explained in this FTC Staff Opinion letter here http://www.ftc.gov/os/statutes/fdcpa/letters/arbuckle.htm
You can tape phone calls per your state law described here http://www.fairdebtforconsumers.com/Recording-Laws-Summaries.html
You can tape, then sue collectors (google "fdcpa attorney") for violations described in sections 805, 806, and 807, per section 813 of the FDCPA.
Has the statute of limitations for your state http://www.fair-debt-collection.com/SOL-by-State.html expired on your debt? If expired, don't pay.
Collectors generally have to be licensed by your state to practise (collect debt) in your state and you can find out by calling your state Attorney Generals Office. Ask if a license is required and does this collector have one. If not licensed, don't pay and file a complaint with your state AG.

Mr. Duke is a scammer and did not serve you any papers and you did not have to go to court. This was probably posted by the man that claims to be Mr. Duke. He keeps calling my work and family too. Today he told my HR Manager he would be here in an hour to pick me up. My manager freeked out pulled me out of a very important meeting to tell me. I have filed a police report and the office told me this is common practice of firms that are trying to collect on depts that have went past the statue of limitations and these comments are considered a threat and against the law. The man on phone wont give you an address for you to send a do not communicate because he is a fraud.

The above statement is interesting to me.... can anyone tell me the name of this "law firm" because the harrassing calls i have been receiving sounds nothing like a law firm.... They have contacted my employer telling them that if i do not return their calls they will come up here to find me, they call my house saying they need my address so they can serve me, etc... if you are a law firm, wouldnt you already have that information? STOP CALLING MY WORK AND FAMILY!!!!!  The worse part is when i ask them what the charges are, they tell me that they don't know, that they have been hired buy another firm. If you ask them what law firm they are with they do not answer...... Sounds fishy to me!

Non-profit Organization
This is a law office which contacted me about a debt, a man by the name of Mr. Duke said i owed 1000 to him, and i assumed it was fraud and hung up. Later that month i was served and had to appear in court on an unpaid balance and ended up paying $3400 in fee's. I suggest working with this office, it will save you the court fee's.
