To address widespread debt collection and debt buying abuses, the report by Consumers Union and the East Bay Community Law Center urged courts, states and federal regulators to enact a number of reforms, including:

End robo-signing and attempts to collect without proper documentation: Debt collectors should be required to document that they are attempting to collect from the right person, for the right amount, and on a debt that they can lawfully recover.

Establish a sell by date for all debt: It should be illegal to sell or attempt to collect debt that is more than seven years old, which is too old to be reported on a credit report under the federal Fair Credit Reporting Act.

Require debt collectors to provide more information to consumers: All debt collectors, including debt buyers, should be required to identify the name of the original creditor and to provide an itemized record of the total principal, interest, fees, and other charges that have been added to the debt, and to provide detailed records about the debt to consumers within five days after the first notification.

Require debt collectors to submit more detailed information when filing suit: Debt collectors should be required to submit basic information about the debt, including the name of the original creditor and an itemized record of the total principal, interest, fees, and other charges that have been added to the debt, when they sue over a debt, so that the consumer can see if it is his or her debt, and in the right amount.

Increase oversight to ensure consumers are properly notified of lawsuits: Courts should be required to provide supplemental notice of all filed debt collection lawsuits to debtors and default judgments should be prohibited if the notice is returned to the court as undeliverable.

I keep getting a call from a Mr. Burns at 888-283-5495.  This man has called my job and told my supervisor that I was involved in a fradulent bank transaction and that he needs to get intouch with me immediately.  My job has a zero tolerance for this type of mess.  I have been called in and counseled by my supervisor and if that doesn't add insult to injury, he has also called my elderly mother telling her that he was with a locating firm and that he was trying to serve me paper work and that I could call back and talk to his prosecutor.  Isn't this against the law for them to be calling me on my job harassing me?

Got a call from Richard Barnes with Transit Capital ( or NCO Financial)( T&G Associates) (or whoever they want to be this week). Wants me to call back to schedule a time with one of their agents to serve me??? I Texas the only one who can serve you is a member of law enforcement. Dumb yankees!!!!!

This company will also call from a local (disconnected) number (changes Caller ID) to make you believe they are trying to serve you.  When I called the number back to call their bluff (I am pretty sure the FBI would be involved if there was bank fraud and they wouldn 't call first) it was a local disconnected number.

Same message scam.  If you listen close they try to scare you with buzz words and alarming phrases.  They sound like they are trying to serve you with a summons and if they can't reach you at home they'll serve you at work and to call to prevent further actions.  Nonsense, cops and process servers "serve" papers, not collection agencies or whatever this is.  I owe nothing to anybody from my past so they don't fool me easy.  

Script:

"We received a fax order in our office regarding an investigation where there is reason to believe you were involved in possible bank fraud.  We've been ordered to serve your court summons to your residence.  If no one is available to receive the documentation, someone will be escorted to your place of employment.  If you have any questions I'd advise you to contact the mediating firm handling your case to prevent further action at 888-283-5495"  

Oh no!  "fax orders", "investigations", "serve" "fraud" "escorted to my place of employment"

I just received the same phone call as a message.  I have no intention of calling the number back.  If it was legitimate I think they would at least to have the nerve to state "what" company they are calling from, and "what" county they are actually filing this supposed case in.  Instead she states her name as Christina Phillips, states a case number and tries to sound threatening about how I better call and state my intentions before they file this "bank fraud" case with "my" county.

I got a call today stating the same thing.  Said that I was wanted for bank fraud and that I keep ignoring their attempts to contact me.  (First time he called was today at 1:39pm.)  I wish there was a way to block all this crap without having to change my number.  It is frustrating.

Just received a call from a Jessica Reed (Reid) supposedly from a company called TCG & Associates claiming that I am being investigated for bank fraud and that I should call immediately to settle the case before it is sent out for filing.  Yesterday a man from the same number called with a different case number and said it was a wage garnishment, this is ridiculous.  TCG & Associates is listed as a CPA firm, the phone number comes up to a company in Illinois by the name Liberty Auto.   Anyone have any idea who they really are.  I am reporting them to California Attorney General's office.
