They just called our business and hung up. I called back and got a lady who gave me the name of the employee they were looking for. Usually, it's people that no longer work here but lo and behold, this one does. I suppose I should have transferred the call, but.....they called and hung up on me. Big no-no in my world. Be a cold day in hell before I transfer their call. You have a "personal" business problem with our employee? You call him on his "personal" line.

Got a call on my cell phone today.  A computerized voicemail was left stating that I "failed to respond" to their efforts to "amicably resolve this matter".  The message went on to say that they "had no choice but to recommend further escalation" to their clients.  I was given an 800 number to call.  Never once did they identify themselves as debt collectors.  I called the number back and was told that I had an unpaid payday loan from 2008.  They referenced a bank account that was closed 11 months prior to the date they say I took out this loan.  I told the "representative" the I had no knowledge of this alleged debt and could they please send something to me in writing.  He told me that unless I gave him "firm payment arrangements" right then, a civil suit would be filed against me and I'd be hauled into court.  I asked if I was speaking to a law firm.  He stated yes.  I then asked if I could speak to the attorney handling the case.  I was told "he's not available".  I asked what state they were in and was told Georgia. I asked for the name of the attorney handling my case.  I got an answer of Mr. Vandenburg.  I asked if Mr. Vandenburg was licensed to practice law in the State of Texas and if so, what is his Texas Bar Association number... I was told yes, he was licensed, but that they are not obligated to give out the TBA number... I asked that they email me the information on the debt so I could take it to my attorney..... "click"

Called business caller ID showed Unknown 816-559-7013.  It was a recorded voice they never asked for a person(I'm the operator)  said it involves your personal info and gave #1213392868 to ref when you return call to 888-300-9022.  Never once said this is an attempt to  collect a debt blah blah.  I'm so sick of arguing with debt collectors all day when real customers are trying to get through on the switchboard.

I keep getting calls from these peple looking for personal information and a statement from me, first i dont no whom you are , second as Judge Judy says do i have stupid wront on my forehead???

Scams are all over the place now days you give info they can wipe you clean. They dont have the right number, nor the person is at my number ,whom are you, what is your number how stupid you called my number.

Stop the calls next time a whistle will be blown in your ear, can you hear me now lol.

Is this company even legit cause they call me all the time and I have been scammed like 3 times where someone has all my personal information. They use to call me from the other number and someone actually left a message now its a recorded message. 3 times in one day.

These people have scared my poor mother (who is by the 80 years old) almost to death with their threats of criminal efforts against me.  I don't know how they live with themselves.  I know that everybody need a job, but this is one job I would not do.  I have contacted the BBB in GA, and the GA Governers Office about their tactics.  They call my cell phone, associates phones, and parents.  They give all kinds of information about the debtor, and they have even given my SS# out.  What a bunch of idiots.  Sure everyone should pay their bills, but when unforseen circumstances alter your life, the last thing you need is for people like these idiots harass you.  Lord have mercy on their souls...

I am not a resident of GA however these people have called and left messages threating me with jail and that an officer will take me out in handcuffs from my job if i dont pay them. i have requested a copy of who the debt is owed to and how much they refuse and tell me i will be seeing the officer soon.  they elude that they are a Law Firm and that you are speaking to an attorney can you help?

Just as above, recently began receiving unsolicited calls from this group regarding my grown daughter who has never utilized this landline as a source of contact.  So basically this company has violated the TCPA by calling a landline several times attempting to reach someone this phone number is not assigned to.  I will now be saving the calls and contacting my attorney.  Now it proves to be seen if it is as cost effective for a citizen to sue and recoup fees that would just end up in the pocket of their attorney or if it is worth the cause.

Yes, it is--and tell her the next time she calls you intend to sue her and her employer for violations of the TCPA and FDCPA for harassing a non-debtor:

Under the TCPA, a consumer has a right to file a lawsuit and recover $500 for each call that violates the TCPA. The TCPA can also be used in conjunction with the Fair Debt Collection Practices Act in some situations.  

Generally, the TCPA does not apply to debt collectors making collection calls to debtors. However, if you are subjected to calls from a debt collector and you are not the debtor, you may file a lawsuit against the debt collector under the Fair Debt Collection Practices Act (FDCPA) and the TCPA.

This right was recently recognized by Judge Legrome D. Davis in a case called Watson v. NCO Group, Inc.  NCO Group is a debt collector that uses automated prerecorded collection calls.  In this case, Mr. Watson alleged he was getting hundreds of calls from NCO Group after he got a new phone number. Mr. Watson claimed he owed no debt to NCO Group, Inc.  Mr. Watson filed suit under both the FDCPA and TCPA.

David Israel, defense lawyer for NCO, argued that the TCPA should not apply to debt collectors.  Judge Davis rejected the argument made by David Israel. The judge ruled that Mr. Watson had a right to sue NCO Group Inc under the TCPA for $500 for each call.  Judge Davis wrote;

[The] Court is convinced that a non-debtor's rights are in fact violated when he is subjected to repeated annoying and abusive debt collection calls that he remains powerless to stop.

Judge Davis' ruling was based upon his interpretation that collection calls to non-debtors violate the privacy rights provided by the TCPA.  

So what can you do if you receive "wrong number" calls from debt collectors?

1. Sign up for the Do-Not-Call registry.
2. Save the calls captured by your voice mail or answering machine.
3. Contact a consumer lawyer.

TCPA: What Is It & How Does It Affect You?

The Telephone Consumer Protection Act of 1991 (TCPA) does many things - including prohibiting debt collectors from calling your cell phone without your permission. Each unauthorized call could result in the debt collector paying you up to $1,500. Here's some helpful information on the Act and how it might affect you.
What is the TCPA?

The TCPA, which was signed into law in 1991 under the first Bush Administration and codified under 47 U.S.C. 227, prohibits calls using any automatic telephone dialing system or artificial or prerecorded voices to:

?Emergency telephone lines
?Telephone lines of any guest room or patient room at a hospital, health care facility, elderly home or similar establishment
?Telephone numbers assigned to paging services, cellular telephone services, specialized mobile radio services, other radio common carrier services or any service for which the called party is charged for the call
?Any telephone call to a residential telephone line
?Send unauthorized faxes
The only way that a caller won't violate the statute is if express consent has been given - and violations of the TCPA are steep. An unintentional call carries a damage amount of $500; an intentional call carries a damage amount of $1,500. That's per call and regardless of the purpose of the call. In other words, if they call you using an automated dialing system without your consent, they've violated the Act and you are entitled to damages.

How does it affect you?

Most debt collectors use automatic telephone dialing systems to contact debtors. You'll recognize this when you go to pick up the phone and there is a slight hesitation on the other end. In fact, most debt collectors are calling nearly 100 people at a time just waiting for someone to answer. Although many have stopped calling landlines, cell phones are another story. Since more and more people are using cell phones either instead of, or in addition to, traditional landlines, debt collectors are finding their cell phone numbers using skip tracers, calling them and hoping that they don't realize that the TCPA has been violated.

The average consumer debt collector employee places 200 collection calls per day or 50,000 calls per year!  How do they make so many calls?  Most use a technology known as autodialing, even though the use of an autodialer by a collector often violates the Telephone Consumer Protection Act (TCPA).
The penalty for violating the TCPA is HUGE ? Every illegal phone call carries with it a $500 penalty, and if the collector knows he is violating the Act, the penalty is tripled!

As the name implies, an auto-dialer is a sophisticated computer system that constantly and continuously dials numbers on collection accounts.  When someone answers the phone, the computer immediately delivers the call to a collector, and the account pops up on the collector?s monitor.  So, if you are behind in your bills, you (and your family and your employer) are getting calls from your debt collectors ? a lot of calls!

Not every call using an autodialer is illegal.  Most notably, a consumer debt collector can call a debtor at home using an autodialer.  However, the following two acts violate the TCPA if an autodialer is used:

Making a collection call to a cell phone belonging to the debtor or any third party
Making a collection call to any telephone number not belonging to the debtor

Like every rule, there is an exception.  If the debt collector has the prior written consent of the recipient, then there is NO VIOLATION.  For instance, if the debtor gives the debt collector permission to call his cell number, or if that?s the only number the debtor provided his creditor, there is no violation.  However, the debtor can revoke that consent by advising the collector that he has reached a cell phone and that he does not have permission to call that number again.

TCPA violations often occur when consumer collectors contact the debtor?s family members or coworker looking for the debtor.  If an autodialer is used to place the call, there is an immediate violation of $500.  If the collector KNOWS that the number he is dialing belongs to debtor?s family members or coworker, the fine is $1,500 for a single call.  So, if the debtor?s parents get 100 calls from a harassing collector, the statutory fine is as high as $150,000!

How do you know if an autodialer is being used to make calls to you or your friends, family and coworkers?  You don?t, but it is safe to assume that every collection call is using the technology.  An attorney familiar with the TCPA can subpoena the collection agency and acquire account notes generated by the computer system.

Why would a collection agency employ a technology that exposes the agency to huge civil penalties?  The enormous profits generated by autodialing far outweigh the potential penalty when caught.  In other words, it is just the cost of doing business.
