I do not think you guys follow the FDCPA rules 100%. I received a call from your company threatening that they were going to send a Sheriff over to serve papers and that it was my responsibility to contact you guys with a claim number. You never addressed who you were on the message nor did you say who you were looking for (both violations of FDCPA rules). Since I have no bad debt or had any inclinations about what the call was about, I called you guys back. Again, you guys did not address you company name and only asked for the claim number. I gave you guys the number left on my machine and asked who you guys were and it was then I was told you guys were Goldberg and Asscoiates trying to collect a debt. The person you guys were looking for was not me nor did I know who they were. I asked you guys to remove my number from your system and you said you would. I got a call the next three days in a row to the point I had to send a letter to your company to stop and that if you didn't, I would take legal action. So while I agree that people do need to own up to the responsibilities, there are times they can't and I think communication is key at the very least. However the tactics and attitude you company uses, also plays an important role. I also think you guys should be ashamed of yourselves as well. There are always two sides to every story.

Recieved a voicemail from Goldberg and Associates.  Called back and asked for mailing address so I could send a letter telling them to only contact me in writing.  Was told "we don't have a mailing adddress".  Total scam.

I have been contacted by this company closing on a dozen times.  At one point I had their number blocked through my cell provider, and the block apparent expired.  I got another call from them today, from an automated system, indicating that I would be "forfeiting my rights" and they would be "contacting your human resources department" to "serve you papers".  This is all for a payday loan taking out in 2007 originating from the website 1000easypaydayloans.com, financed by a company called Bahama Marketing Group.  Admittedly, I defaulted on the loan because I didn't have the money to pay it.  I attempted making contact with the company, which was later known as Hushak Group, and could never get anyone on the phone.  A few years went by without any word from anyone, until I got a call from Bayview Solutions, the first debt collector to contact me.  They sent me out verification, and I I paid the debt off completely in 2010.  Since 2012 I have received hundreds of calls about this debt from dozens of collection agencies, all claiming various amounts.  Now, back to Goldberg and Associates.

The woman on the recording, who when you speak to her claims to work for a law office, is completely clueless about the law.  First, I was accused of check fraud for an ACH transaction.  The problem with this particular claim is that the loan originated in Texas, and the contract signed pursuant to Texas law, which means that I had to physically write a check in order to be guilty of check fraud.  The second claim, when I shut her down about that, was that I attempted to defraud a financial institution because I took a load out with no intention of paying it back.  The unfortunately reality here is that you have to be able to prove intent to be charged with a crime centered around intent, and since I paid the loan back, obviously I had no intention of defrauding anyone.  Third, she indicates that if I do not handle the issue immediately I will lose all rights, and will be forced to appear in court.  There are a laundry list of falsities contained in that little nugget, not the least of which is attempt to assert that I will lose any right to contest the debt or otherwise defend myself in a court of law.  

For those of you dealing with these people, let me make a few things clear:

First, there is never an instance where the FDCPA does not apply to someone calling you regarding a debt.  This company claims to be a law firm, and therefore claims to be immune to those particular statutes.  Under the law, they conduct the business of collecting debt, so how they categorize their business is of no consequence, as they are debt collectors.

Second, this company is going to start spewing a laundry list of generic legal terms at you in an attempt to scare you to death, many of which are misrepresentations.  The laws that apply to your particular situation are the laws of the state you reside in.  If you state requires a physical banking instrument (paper check with your signature on it) to constitute check fraud, and you did not write a check, then you have not committed check fraud.  

Third, there is a statute of limitations on the majority of debts, payday loans notwithstanding.  If you took a payday loan out 12 years ago and missed a payment, these vultures have absolutely no legal recourse to collect the money you allegedly owe.  

I am of course not insinuating that you should fail to resolve any debts you might owe, but knowledge is power in this instance.

To Goldberg and Associates:

I was licensed private investigator in the state of Texas who was engaged in physical assets recovery, and had to be well versed in the nuances of the FDCPA as such.  

I have been studying the law since I was a sophomore in high school, well over a decade ago, and am particularly well versed in Texas statutes (I have the entire code on my bookshelf), so don't call me attempting to misrepresent the law because you think you will scare me.  

The debt you are attempting to collect was paid-off four years ago, so it's not my fault you got screwed buying a bad portfolio, but then it seems like poetic justice since you sold debt portfolios you had not title to sell (Public records, aren't they awesome?  Did I mention I was formerly a private investigator?).

My suggestion to you is to get your act together before you wind up facing a class action lawsuit (there appears to be a class here as a matter of fact), which will in turn trigger a federal investigation that is likely to leave your collective colon cleaner than box of cookies in front of a toddler.

this place represented themselves as lawyers working for the das office trying to keep me from going to jail for some unknown unpaid bill or bad check my chick is on ssi and not exactly hip to the game so she gave these a***oles her bank no. unbeknownst to me to help her clear this matter up without getting the courts involved bulllshitted her into beliving he was going to help with her credit and all kinds of other b***s***. now theres been all kinds of fraudulent charges on her card and no money left for rent this place is the worst kind of scumbags golberg harris and asociates are preying on those who dont know what kind of crap to look out for

Watch out for these people. They are using numbers from different states. The latest was from Greensboro, NC 336-790-1790

I have had quite a few calls from this so called "Brian Ross" myself. Same scenario as everyone else with the threats etc... Only looking for my brother who lives over 200 miles from me. Fortunately, my phone provider allows me to block their numbers from calling upon request. I suggest anyone having issues with this scammer check with your phone companies and see what you can do to have their numbers blocked or 'blacklisted' from calling you, or maybe using their network for these illegal activities. MOST providers can and will help as much as possible. YES, I have filed a complaint with the FTC, Office of The Comptroller and a few other Federal agencies as well as my state police. Let's see "Brian Ross" worm his way out of this one. FYI, Harris Goldberg and Associates is on a Federal "Watch List" No links will be provided, but if you search a little, you just may find them.

They use the following "Names" and Numbers and I am sure this list will grow.

says it is the after hours number (yet it is 1:00 pm here in tx)  aren't business hours normally 8:00 am to

You have neglected this matter for over 3 years and when you are notified you neglect this matter and choose to make fake complaint about a scam when that's not the case. Why don't you return a phone call Michelle? How come you don't call our ask for our address we will happily provide it to you again. Just follow through on your word and your responsibilities and you will feel much better. Stop making false complaints to deflect the real issue and you not taking care of it. He also called my legally blind mother twice and asked her some personal information. I dont know what to do but I draw the line at harrassing my mother. I called back to see if someone else would answer the phone but instead of answering the phone professionally stating where ur calling from he said, IS THIS (KAYNICK)....my actual name. Im starting to wonder. I will call back and ask cld some paperwork or evidence of proof of this loan be sent to me before I make any arrangements to pay on a loan that I DIDNT TAKE OUT.

I recieved a call from a brian guy from a 2818237068 and he stated the call was a debt in regards to my social. As I started explaing to him tht at the time I was in the military and applied for a loan...but never recieved and I also told him tht later that year I got a letter from my bank stating that my account was compromised he began to over talk me and said tht he deals with PEOPLE LIKE ME ON A DAILY BASIS....i was offended because I have made mistakes in the past but swear tht I NEVER RECIEVED A LOAN FROM THE SAID COMPANY...REGARDLESS IM OBLIGATED TO PAY.

really you say debtors are irrisponsable,  ever thaught why in the first place they got into trouble ??? ilness,  loss of jobs,  bereivment the list is endless.  These companies and lenders when people  get into trouble refuse to help,  make rediculous repayment plans that cannot be kept,  sell it onto your companies for peanuts who chase it for the full amount,    zombie debts I beleive.

Our Company has a license to collect debt and follows the FDCPA. I feel bad for you that you feel the need to lie and make fake complaints instead of taking responsibility for your actions. The worst part about your complaint is that everything you are stating is incorrect and You are the person scamming companies, banks, lenders, and people. It is amazing that people with multiple judgements against their name and who have a history of default on multiple loans have the audacity to blame legitimate hard working people for doing there job, because you choose not to deal with your past faults, neglect, lack of self respect, honesty, responsibility, lack of accountability, following through on your word. Wait you dont take care you something your required to and then you make threats and complaints to AG's. Terrible you should be ashamed of your self.

Unfortunately Many people like this choose blame others and make up lies and excuses for their wrong acts and neglect, instead of admitting they were wrong and taking care of the responsibilities. If they did the matter would go away quickly and easily. It is amazing how many debtors these days are quit to make threats and  towards honest hard worker people with a legitimate job and reason to be calling them. Especially when theses debtors are in the wrong. The reason the people received phone calls is because you haven't taken care of your responsibilities and continue to ignore them. At some point you need to start taking responsibility for your actions. Its not right to make someone else out to be wrong as a tactic to neglect  taking care of your own unresolved matters and it will not help you in the long run.

You are correct...if you have a legitimate debt and you default you should pay. However if the company in question is harassing your parents or siblings trying to get information out of them that they are not going to give them then they are in the wrong. It is illegal to do so and is punishable by law and or fines from the FCC. These companies need to stop taking the easy way out by trying to threaten people who were only used as personal references and have in no way any legal obligation to give up any personal information about the debtor or themselves for that matter. Threatening to jail or sue someone for not cooperating when they have no legal obligation to do so is no better than the strong-arm tactics the Good Fellows used back in the day. Collection agencies will lie, cheat, threaten, and even use foul and intimidating language to get what they want.  Just hang up, contact your lawyer, and file a complaint with the FCC.

The guy is Brian Ross and he works for a company in Chicago, Harris Goldberg & Associates. This is a legitimate dept collection company even though they have no company website.  They are calling from a very large call center by the river. I have no idea what the actual street address is of this company because there is no listing, only a domain name and no website.
Your best bet is to call them and get it over with. They will not stop until you do. You apparently defaulted on a debt, they purchased the debt and now are trying to collect.

Okay here's the deal. I purchased a car in Tennessee some years ago and went through a second chance finance company out of Texas for the loan at an outrageous interest rate. I was working two jobs to make the payments for almost two years. I was hurt on the job and was forced to quit one job, thus cutting my income in half. I lost my home and had to move in with a friend. I called the finance company to try to get them to extend my payments so I could catch up, they refused, so I returned the vehicle. The finance company sold the car at auction for $1000.00 and sent me a bill for the remaining $7,000.00. I could not pay the bill, so it went to collections. My mother has been harassed for a good pat of 3 years for my dept.  Brian Ross and another young lady has been calling constantly, making threats and being very rude to my parents.  Everyone I put down on the loan application as a reference has been harassed over the years for my debt. I am filing an FCC complaint against this company, Harris Goldberg & A**. based out of Chicago IL. on behalf of my elderly parents.  If you want to contact me you need to do your home work and stop harassing my 70+ year old parents to do your dirty work. File a claim in Tennessee court and get your judgement for crying out loud. I will live with the bad credit, but be aware that I am in debt for student loans and they come first regardless. I returned the property and it was sold at auction for thousands under the blue book value and you expect me to pay off the rest? I may be a deadbeat but you guys are idiots if you think I am going to pay you one cent after I returned the property in good faith because the finance company would not work out something with me to allow me to keep the vehicle and pay off the loan. You know who I am, now get on with the suite and get it over with, you will win easily because I plan not to dispute the claim. I am just an honest guy who fell victim to predatory lending, simple as that. Yeah I am stupid and shame on me.

This guy has called me from several different numbers. He will not give his address or any info. Only a completely naive person would send money to someone without verification. If you owe a company money and the account has been turned over to a collection agency the initial company should be able to tell you who that collection agency happens to be.

I have to say, I am very surprised to hear this; I, on the other hand had a different experience. To make  a long story short; I was called by a rep from this number, he explained to me that they were contacting me in regards to a loan I took out (which i did) two years ago. The gentleman was very professional and understanding to my situation ( I graduated college and could not find a job). I told him i could not pay the amount in full right now. The gentlemen explained that if a full payment wasnt possible,  i could pay it off in payments; 3 months later and Im debt free!! Oh! and my credit score is better... Nothing negative to report on this end.. It was a win, win for me!

This is not a scam...Proper documentation was provided to Haas. The bottom line is a loan was granted, but never repaid. Denial does not excuse your responsibility to the debt. If you are experiencing hardship we will be happy to accommodate your current situation, but this debt will not go away...  Take responsibility for YOUR action...

This is a legitimate company that follows through on there word. All the information they confirmed with me was accurate and I got a letter in the mailed after I paid my balance.
I spoke with Brian Ross and Tommy Siegel from this company. Both where very polite and helpful in resolving the account.

My advice to people like me
If you want to borrow more money
pay back the money you borrowed. simply as that

Brian keeps leaving messages to return his call but never states what the issue is. He has been leaving messages with family members stating that it is about allegations pending about my SSN # so I need to contact him. If he had any business with me, which he does not, he should not be giving any info to anyone about it at all and harrassing people doesnt make them call you back any faster. I dont own anything, I have no money and im unemployed. I dont have anything to give.
