A person called identifying themself as a legal counselor on behalf of JD Mitchell & Associates. The person left a message instructing me to contact them or I would be summoned by deputies to appear in court. They left a case number and a call back number 1-855-271-0502. I can tell you all it is kinda like I was left an ultimatum by the individual, with the style of a clerk of the court. They did not tell what the purpose of their call was, and sounded like a police secretary. I thought there might have been a misunderstanding so I did not hesitate to call back immediately. I was transfered by the operator to speak to a Josh Summers. I found out that he was calling from a small collections firm. Can someone tell me if this company has been flagged by the FTC? I don't owe the amount the individual had on file ($900-$1000). It was maybe 10 times the amount I borrowed from a small merchant over a decade ago. I think this business is violating Title 15 USC 1692e- False or misleading representations. Which states: A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:
(1) The false representation or implication that the debt collector is vouched for, bonded by, or affiliated with the United States or any State, including the use of any badge, uniform, or facsimile thereof.
(2) The false representation of?
(A) the character, amount, or legal status of any debt; or
(B) any services rendered or compensation which may be lawfully received by any debt collector for the collection of a debt.
(3) The false representation or implication that any individual is an attorney or that any communication is from an attorney.
(4) The representation or implication that nonpayment of any debt will result in the arrest or imprisonment of any person or the seizure, garnishment, attachment, or sale of any property or wages of any person unless such action is lawful and the debt collector or creditor intends to take such action.
(5) The threat to take any action that cannot legally be taken or that is not intended to be taken.
(6) The false representation or implication that a sale, referral, or other transfer of any interest in a debt shall cause the consumer to?
(A) lose any claim or defense to payment of the debt; or
(B) become subject to any practice prohibited by this subchapter.
(7) The false representation or implication that the consumer committed any crime or other conduct in order to disgrace the consumer.
(8) Communicating or threatening to communicate to any person credit information which is known or which should be known to be false, including the failure to communicate that a disputed debt is disputed.
(9) The use or distribution of any written communication which simulates or is falsely represented to be a document authorized, issued, or approved by any court, official, or agency of the United States or any State, or which creates a false impression as to its source, authorization, or approval.
(10) The use of any false representation or deceptive means to collect or attempt to collect any debt or to obtain information concerning a consumer.
(11) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action.
(12) The false representation or implication that accounts have been turned over to innocent purchasers for value.
(13) The false representation or implication that documents are legal process.
(14) The use of any business, company, or organization name other than the true name of the debt collector?s business, company, or organization.
(15) The false representation or implication that documents are not legal process forms or do not require action by the consumer.
(16) The false representation or implication that a debt collector operates or is employed by a consumer reporting agency as defined by section 1681a (f) of this title.

If I owed a debt, I would pay it.  But this company is a joke, they called my parents twice in another state asking for me.  When I called them back both times with a "case number" they told me the same as they tell everyone else.  That I owed a credit card debt of 1400, from a card I never had.  And I know I didn't have said card because I don't use credit cards.  Have not had a card in over 10 years!! So what do they have to say now??

I don't owe a debt, but I got a call regarding a family that has already passed. I know she probably did owe money true to medical problems. But is it my problem? No. Am I responsible to pay off the debt? No. When I looked up these firm, I found this page, and found so many people denying any debt. "it wasn't me! It wasn't me!" When you know IT IS you. Just pay what you already owe. Not a hard concept to grasp. Shill? Afraid not. Honest? Indeed. Upsetting to those who don't want to face the reality of having to put on your big-boy pants and just pay the s*** off already? MOST DEFINITELY.

I got a call about a week ago from this so called server and said he had documents to serve me but I had no clue for what!! I questioned him and he gave me this number to call for JD Mitchell and assoc.The number they gave me was 855-271-0502. So I called and they gave me this case number and the guy which now I can't remember his name said I had owed on an old credit card and they where going to sue me for the money well I was on my way out of town when they called me and I got so stressed out over this!! They also said they were going to email me some documents which I never received!! I had then talked to a few people and they said it was a BIG SCAM!!! And they tried to call me today and I totally went off on this guy!!! And told him never to call me again and I was contacting the police!!! I hope I never get another call again!!!!!

I received a call from the "process server" telling me to call JD Mitchell & Assoc as mentioned above.  Have any of you noticed that all of their fake names are actors, sports players, politicians, etc.?  I now have such names as Justin Laurer, Michael Williams, James Porter, Shawn Banks, Shawn Bradley, Heather Ryan, and Charles Widmore.......still making claims they are a legal entity.  First I was told they were a law firm.  Now, I'm being told by someone else that they aren't a law firm but a financial institution who does legal litigation.....they are all to be avoided at all costs....big scam going on here.  They were telling me I had a credit card with a company I never heard of before.  I kept denying it, and they kept saying I did and that I agreed to payment.  I never agreed to the debt, but I did stupidly agree to the payment.  The guy was that good that he had me eating out of his hands :-(  Now, I have to try to fight them to get my money back.

I recived a frantic call from my mom sayibg they called her regarding a legal issue with my husband and if it wasnt resolved there would be a warrent for his arrest. I called with the small amount of info he had given her and made the call...the process explained in a message above is exactly what happen. I was transferred to a man named Josh and was told some story full of "legal" mumbo jumbo and was told I had two payment options to resolve a loan. We never EVER did buisness with that ccompany.

Legal name of there company is JJD Collections. They buy old out of stat collections portfolios and try and scare people . Dialer is in the next room of the guy claiming to be a paralegal. I am a firm believer that people should pay there debt but if the bank was to lazy to sue you then oh well thats between you and the bank. Not 3rd party scumsuckers trying to milk people out of money they legally dont owe. Oh yea and dont be mad at the dialers. most of them are kids right out of High School or people desperate for money who they prey on to work for them. Sad part is this is just one of a few of these "companies" but they are all run by goons started with A &N Financial.

i previously worked for this company, you should contact them immediately. if thy are calling for you then there has been some kind of legal complaint filed against you and they will have the details regarding the file.

This company goes by 2 names, JD Mitchell & Associates and A&N Financial Firm.

The true names of the Owner of this company is Justin Laurer. They operate under aliases, as do all of their employees. Justin Laurer's alias is Shawn Banks. Though Shawn Banks sometimes claims to be an attorney with A&N Financial Firm, he is not an attorney. Justin Laurer, on the other hand, is a 25 year old kid who thinks that the 4th Amendment to US Constitution protects consumers against debt collectors.

When you receive a call instructing you to contact this number that caller is a JD Mitchell & Associates dialer or an A&N Financial Firm dialer pretending to be a process server named Brandon Wilson or Kimberly Scott. Any male caller will tell you he is Brandon Wilson and any Female, Kimberly Scott. When you call that number you're going to be transferred to "Claims Litigation." The person who answers in Claims Litigation is going to tell you his or her name. This is not their real name either. Nothing they tell you is the truth.

If the person you are speaking to tells you that he/she is an attorney or paralegal, don't believe them. They're just debt collectors who have had no real training. Most of them have no idea what the FDCPA says.

FACTS:
1) In most cases, They cannot sue you for this debt because it is out of stat.
2) They have NO intention of filing a lawsuit against you.
3) They do not have any of the media (documentations) associated with your Debt. They don't even have the original credit agreement.


You should do the following:

1) Send them a certified letter demanding that they send you Verification of Debt.
2) Contact your State's Attorney General's Office and file a complaint.
3) Contact the Better Business Bureau and file a complaint.
4) Contact a Consumer Advocacy Attorney

Ask for my wife, said they got the number from her mother in law. "Urgent legal matter" by some guy called James 0'Neil, gave a reference number CF1233 something and extension number 2130. First of all how could my mother give them them my phone number about my wife if my mother is deceased. That makes wonder just a little how true this phone call was. Same story as some of the other people, called back, doesn't say business but just that you have reached the Main office. Totally bogus phone call trying to scare us.
