Extortion Scam Related to Delinquent Payday Loans

The Internet Crime Complaint Center has received many complaints from victims of payday loan telephone collection scams. Callers claim the victim is delinquent in a payday loan and must repay the loan to avoid legal consequences. The callers purport to be representatives of the FBI, Federal Legislative Department, various law firms, or other legitimate-sounding agencies. They claim to be collecting debts for companies such as United Cash Advance, U.S. Cash Advance, U.S. Cash Net, and other Internet check-cashing services.

According to complaints received from the public, the callers have accurate data about victims, including Social Security numbers, dates of birth, addresses, employer information, bank account numbers, and the names and telephone numbers of relatives and friends. How the fraudsters obtained the personal information varies, but in some cases victims have reported they completed online applications for other loans or credit cards before the calls started.

The fraudsters relentlessly call the victim?s home, cell phone, and place of employment. They refuse to provide any details about the alleged payday loans and become abusive when questioned. The callers have threatened victims with legal actions, arrests, and, in some cases, physical violence if they do not pay. In many cases, the callers harass victims? relatives, friends, and employers.

Just received a message from Fitzgerald Hemingway to call 18664019455 regarding legal matter against my social security. Thank goodness for this site, sets me straight rite away!!  First off, I've never taking out a loan, I don't work and am disabled. Don't have checking account neither. No credit cards to claim... I can see immediately that this is a SCAM!! The call came in from # 1-888-330-8003.

I get these calls all day long and they tell me I need a lawyer. They never say a company name. THEY THREATEN ME BY SAYING THE SHERIFF IS ON HIS WAY AND I WILL SHOW UP IN COURT! IM SO PISSED AND READY TO CHANGE MY NUMBER! THEY CALL FROM THE 415 230 2508 NUMBER.

Look up this IP Address and do a background search on a certain individual on who lives at that address dating back to 2/1989. Ty for ur detail info I too received these same messages with a threat that they will be sending someone to my place of resident on a particular date, and as usuall the date comes and goes. Now that u provided me with their info and (suppose address) I am more aware. But today I received a call from them again but this time the message stated the account in which I owe. Its for an old BOA account I had maybe 4yrs ago. I have no need to lie to u and will admit I do recall such an account and I do owe money to BOA. I am willing to pay off the debt provided we can come to a resonalble payment schedule. But I am uncertian if I should deal with this company in particular, and u are correct in that I should of received a validation letter. Problem is I am guessing these people will more than likely try to charge me tripple my debt or threaten me with legal court papers. Any tips on what I should do? Thanks for all ur info.

Leaves a recorded message that it is "imperative we hear from you today regarding a claim that has been filed with our office.  We must hear from you before the end of business today.  Contact an associate in our pre-legal department at 888-330-8003".  They don't state a company name, but a little research indicates it's a company called ACH Recovery.

Apparantly, some conman named Tony Williamson called and left a message with my boss at my part time job. Sounded threatening-summons to appear in court. I got the message from my boss and I reassured her that this is yet another con artists. I have dealt with these scum many times and in rrecent years, I came up with a stragedy of my own: First, I call their #'s after business hours and I leave them a detailed messag-stating that if they are truely legit, they need to follow the law, by sending me an official letter on company letterhead (be it a collection agency OR law firm) explaining what they want from me. I also warn them sternly that if they fail to do so, I have already reported them and their names and numbers to my State's Attorney General COnsumber Protection Agency. This usually does scare them off!

they have called me for a week looking for someone I no longer talk to. The man I spoke with was rude and then hung up on me so I called back and talked to the alleged floor supervisor who said she would talk to him about how he acts toward references who call back and suggested I get a hold of the person they were looking for.. They said they have removed my information but will file a complaint if they call me again. If you're trying to collect money for something it might behoove you to be polite instead of a f****ard.. If they do not have a license to collect in your state, they cannot do so.  These folks change their name and phone numbers frequently due to the multitude of FCC and attorney general complaints in the states they set up shop in but their M.O. is the same.  DO NOT GIVE THEM ANY INFO!!!!! THEY WILL NOT SHOW UP AT YOUR DOOR!

Tell them that they are required by law to validate the debt by sending you the correspondence to include the original contract you signed and the amounts you owe.  They will never send it to you.

got a call from 206-219-4312.  Caller did not identify name, company but stated that if I did not call back, then legal action will be taken and to call 888-330-8003 and stated when calling to reference some number that was hard to read since it was auto robotic.  DO NOT GIVE THEM ANY INFO.  This is a third party collection agency that attempts to scare folks into paying a debt by threatening to serve you papers at home or work between the hours of 8 and noon the following day.  If you do call, tell them you will be waiting with your attorney and a police officer.  THEY WILL NOT SHOW UP.  Real legal paper service companies do not give you a heads up that they are coming.  If you call the 206 number, they answer "Pre-legal department" but never their company name.  Pre legal my a***.  
To these a**holes, eat it!!!! You are all bottom feeders so go F yourselves!!!!

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>
