These people called trying to collect on my dead mother's debt from 2009...the statute of limitations for credit card debt is 4 years in the State of California.  They told me there were other ways to find her (my mother) when I refused to tell them anything.  I then told them that she would be hard to contact as there are no phones where she is located.  They jumped all over that and said where is she...I told them 6 feet under and hung up.  I am having my attorney call them and I am reporting them to the FCC.

Received a call from "Erica" at ESM...made it sound like an emergency (I have 2 daughters), scared me to death because I thought I had heard wrong and it was 'EMS'.  Nothing stated about what it was about; then, when I googled the company, found soooo many people with complaints against this collection agency and their practices and Erica in particlar.  I WILL NOT put up with any CRAP.  I am an RN with a Masters' Degree...currently of disability, 61 y/o, currently filing for Bankruptsy. And I WILL NOT be BULLIED!!!

I am an RN who has always had a good credit score (a still do), but due to a recent disability and forced time off from work, I have gotten behind in a couple of bills. I would like to think bill collectors would give people the benefit of the doubt in this rotten economy and say to themselves, "There but for the grace of God go I"...
But instead, like you, all they want to do is YELLLLLLLLLLLLLLLLL and CALL NAMES and HARASSSSSSSSSSSSSSSSSSS (as you do on the phone!!!!!).  And I agree with previous writers who said you all obviously have less than an eighth grade education because you can't spell worth a Damn, nor can you punctuate or use proper grammar...you're probably all illegal immigrants who are part of the reason for our bad economy and growing drug problems.

Your first sentence describes yourself perfectly.
How long ago the debt was incurred does matter - there are statutes of limitations but clearly you've never heard of that.
Further, how do you explain all the countless people who get harassed for debt that is not theirs?
Also, it's up to the collector to provide validation of the debt when asked by the person they called; it's not the responsibilty of the alleged debtor to show proof.
I suggest you read up on debt collection laws and the FDCPA before you make yourself look like more of an idiot.

ESM/Check Assist--Some people are not educated on these companies and make themselves look like idiots.

They deal with bad checks......Once you write a bad check IT NEVER GOES AWAY.

It will eventually catch up to you.

It's not any collection agency's fault how long ago the debt was incurred, it's the time it takes the actual creditor to transfer it over.

THEY are not "calling you out on your faults", they are trying to resolve your debt with you so you won't go to jail. STOP blaming these agencies. These are people who have families and lives. They are not trolls on the other end of the line, they are just trying to earn a living.

Yes, some experience a bad time and others do not. It depends on the person.

Bottom line, it is against the law to write a bad check and you WILL GO TO JAIL......

Stop your whining if you receive a call from these places because you are the one who is in the wrong.

Shut it and pay for your bad check.

Really folks, it's not that hard.

And if you keep writing bad checks and they bounce, wait for a call from them. YOU DESERVE IT.

I take whatever I said in my previous post from September 26th, 2012 in regards to ESM Enterprises being a scammed company. My apologies.

ESM Enterprises IS a Collection Agency company located in Pensacola, FL if anyone else comes along once I post my update.

A day or two days ago, I received a letter from one of the three Credit Companies, which informed me that I supposedly owned an Acct, which wasn't paid or bounced or what not. Few years ago, my identity was stolen therefore ANY letters I received IS an automatic "RED FLAG," to me. I don't trust NO one and I am pretty much aware of most scams, which can occur any time, any minute or any second.

Anyways, after I placed my dispute against the questioned acct with the said Credit Agency, I also made my phone call to ESM Enterprises directly to dispute with them, which I spoke to a friendly Agent there and we were able to work things out,

So, reading the previous posts from others, being harassed by phone and such, .. I think it just depends by case by case situation(s).

Pay you bills on time and things like this won't happen. This is not a scam. You actually used the account one way or another. You are lucky you live in the U.S. Most countries would put you in jail and make you work it off, or more severe punishments. If you borrow money, you should pay it off period!

I also received a Collections letter from the Company: ESM Enterprises, PO Box 11128, Pensacola, FL 32524 with their Toll free number of 1-888-477-6558. It says, "All payments and Correspondence should be mailed and dealt with the above information.

For a fact, I know THIS is a scam and it's SO obvious.

1) I have NEVER heard of this company in my life until I opened a letter delivered to me, BUT, one can easily find my name and address on the internet in this age and day. lol

2) I looked up ESM Enterprises, with no available.

3) I looked up the Creditor Company listed in my letter, with no available.

4) I looked up the RE: note for clues, with no available and IF I did see a search containing key words, the site doesn't look legit at all.

With no available = the so called Companies listed in my letter = doesn't exist according to the internet searches I conducted. Again, IF, I did see a search containing key words, the site doesn't look legit.

Also, in this day and age, who still uses "Checks?" Pfft

And, it's sad to see that the "Letter" written to me does look legit AND is an unfortunate scheme for an individual or a Ring/group of scammers to lure in unsuspecting, naive individual or families relating to the people who received such phone calls or letters.

By ALL means, let whoever these people make threats about Prosecuting you and yatta, yatta, yatta. For a fact, I know it's ALL lies. Let's face it, our Economy sucks so it'd be a normal thing for a low life to come up with a scheme such as THIS in hopes of preying on unsuspecting, naive individuals hoping he/she would "fall" for threats made by these low life people who has nothing better to do with their lives than scam people. And, the only way these low life people will gain their "money" is by making threats or harassing you by phone or through mail.

I'm surprised these low life people haven't gone door to door with their scams and trying to cash in fast.

I have heard of Nigerian scams too through Emails and I have seen the Dateline NBC coverage with Chris Hansen. Pretty sad that these criminals have NO life. And, even sadder to watch people from all walks of life, some do fall for these scams, which he/she has lost out on so much money due to these scams!!

Thankfully, I looked up the Toll free number through the internet searches and I found more searches on their Toll free number as a Scam attempt than I did with any of the given Company names listed in my letter.

Perhaps, I will wait for my local Police to come pick me up for a made up Company with criminals working behind it (do you have a middle man?), trying to scam me and others listed on this page. I'm sure if you came to my door, after the local Police finds out what you are doing, I'm sure they would love to give you a free lift down to their station for some questioning.

One advice to those who work or represent ESM Enterprises or anyone affiliated with this company to: Get a life.

We received a collections letter from this complany claiming that my husband wrote a bad check and we now owe money for the return fee and the amount of the check! One, we have never written a bad check to anyone .., Ever! and 2, we have never even written a check to the company they are claiming to represent. I am writing the better business bureau and filing a formal complaint and having the company fined. I have worked in collections myself for 7 years and know all the skeptical practices these so called debt collectors use. I also tried to call the company to inform them that if we receive any more correspondance from this company I would file harrassment charges, but to my surprise... no answer! I would simply stay away from them no matter what they are just trying to make a quick dime and anyone can look up your name number and ss# online these days dont pay anything unless they provide you a copy of the check you supposedly wrote!!

Beware people - there are so many cons out there.  They call the relatives first and scare them to get them involved.  All kinds of threats (illegal) are thrown around and some even threaten to show up on your doorstep with deputies!  Always check out the phone number no matter what.  Almost ALL of these type of calls are CONS.  Don't be fooled.

Please be aware if you are speaking with someone from this firm that you are not violated by the FDCPA.  It seems as if no one in their office follows it. Plus I received a letter from the company after I paid my account in full just to find out I could have settled for lesser amount and still had it updated on my credit because they only report one way. My lost because they are not refunding my money. No one seems to be trustworthy that I have spoken too and as a company they should be shame of themselves. I don't know how much longer they will be up and running with practices like this.

I have a real life. I am the lead singer of a decently successful band and I have a very good job. Also I have a credit score of over 780. I got a call from this number this morning and somehow missed the call. I owe no one on this planet money (except uncle SAM!, he gets a portion of my check for the rest of my life because i'm an american citizen). To be honest I was taken in by the voicemail. I thought that something urgent was going on due to the demeanor of the voice on my voicemail. After calling the number back I found it strange that the voicemail sounded a bit like a tape recorder. Now I am sitting here reading these comments and I can only seem to come to 2 conclusions.
1. Don't post things online on behalf of your company if you can't spell and obviously never passed 5th grade english!
2. If you work at a place that leaves you in a position like the afformentioned comment it might be time to re-evaluate some things in your life and get a new job. Possibly dealing crack! Or a job at the local mini mart! HELL get creative! Deal crack while workin at the damn mini mart!!!!!
