However that was a week ago and i called the original people i owed and they are saying i still owe them and gave me a diff collection agency number. I had to leave a message for them to call me back and let me know if they are affiliated. Im on the phone with them right now waiting for them to send me an email showing Im paid. I dont even know if thats good enough and at first she was like oh yeah ill get that sent and im like no ill wait on phone! So far its been ten minutes still holding.- oh and supposedly they dont make outbound calls someone else called and left their number for me to call

I received a voicemail message stating that legal paperwork had just been received by him, David Cole and that I was about to be sued for check fraud by Bank of America.  I have never had an account with BOA and I definitely do not have any bad check out there.  I called BOA to first determine if my ex-husband had possibly opened an account in my name.  They have nothing for me in their system.  I then call the number that was left for me to call.  The person answering the phone did not even know who David Cole was, but mysteriously enough he could pull up my information with the docket number that was provided.  So now Mr. Jason Thomas is on the phone and telling me that I have a defaulted loan with CashnetUSA from August 2008 that was deposited into a BOA account.  He provided an email address that was not mine, an address for me that was from another state and he was using my maiden name.  He could not tell me what the BOA account number was that the funds were allegedly deposited into.  They are FRAUDS.  I have even called CashnetUSA and they don't have my name in their system.

CHECK RESOLUTION keeps calling and leavingthreatening messages saying that I have a bad check out there, that needs to be paid immediately or I will be served a summons at my home or place of employment. Call was made by a Seth. Even gave a case number, but mumbled the name of the company making the claim, so I could never understand. My phone is unlisted, and i know 100% that i do not have bad checks out there. NO WAY! Please i wish there was a way to stop these criminals and scammers.

i took out a loan in october 2007 unfortunately i lost my job and couldnt make the payment, i was then contacted almost 2 years later about this and now that i work i happily paid it because i did take this out and felt bad the whole time about not paying it. i agree their method is out right ridiculous and they can be considered scammers but what do u consider someone who took a loan out and bounced a check paying them back?? for whatever reason it doesnt matter but i feel this page is an escapegoat for people who just dont want to pay back the loan they took out and to me that makes both parties scammers so stop crying and take responsibility after all these people wouldnt be calling you if you didnt fail to pay back the loan YOU TOOK!!

I got a call from this person today, who somehow got my AUNT's number.  I called back and didn't get anyone and he promptly called back from a private number leaving a harassing message.  I called back and they said there was no Seth, then they transferred me and I told him that I worked nights and the next time he woke me up, I was going to report him for harassment.  Then hung up on him...freak

The people from this number have called before and I checked their story out and found out it was BS.  I called the courthouse myself and gave them the numbers I was given and nothing.  They had my husband's cellphone, my parents, sister n law and even the mother of my husband's exwife (wrap your mind around that).  Today they called back after being told to cease and desist last time.  They called my parents and my husband at work.  Same story.  That I wrote a bad check and was going to be served.  Last time I asked for validation of the debt in writing and gave them all of my contact info. and still they're using the same underhanded techniques and I've yet to receive anything in the mail.  What can I do?  I reported them to the FTC last time.

A woman called my husbands cell phone, left a message for another family member who is not in our immediate family.  (All of our numbers are unlisted, how did they get the numbers?).  She left a message on the cell phone then turned around and called our landline which again is unlisted...  I picked up, she asked for the family member I asked her to repeat it, said that person does not live here, then asked for my husband by name and is he the son of the said family member I said no, a nephew, she then said is he the son of used my husbands fathers name (where do they get all this info.) none of us even live in the same state.  I asked where she was calling from, she kept repeating from a processing agency that received a fax in regards to a bad check on said family members name and to call this number 888-513-7944.  Unfortunantely for her my husband and I had just seen a report on such scams and new there was something up.  I called the 888 number and this is how they answered "check processing, how may I help you."  Big Red Flag!!!

To Mike Samuels

You fail to understand - its not that the loan was not paid back - it PROBABLY WAS- long ago.

there is an ongoing fraud case with FAKE DEBT COLLECTORS targeting those who at one time had a payday loan and paid it off YEARS AGO..

These hackers stole the info - and now terrorize those who info they stole to pay up...

Dear {insert name of collector or company},

I am writing in response to your (letter or phone call) dated {insert date}, (copy enclosed) because I do not believe I owe what you say I owe.

This is the first I've heard from you, or any other company on this matter therefore, in accordance with the Fair Debt Collection Practices Act, Section 809(b): Validating Debts:

(b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

I respectfully request that you provide me with the following information:

(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) Provide a verification or copy of any judgment (if applicable);
(4) Proof that you are licensed to collect debts in (insert name of your state).

Be advised that I am fully aware of my rights under the Fair Debt Collection Practices Act and the Fair Credit Reporting Act. For instance, I know that:

because I have disputed this debt in writing within 30 days of receipt of your dunning notice, you must obtain verification of the debt or a copy of the judgment against me and mail these items to me at your expense;
you cannot add interest or fees except those allowed by the original contract or state law.

you do not have to respond to this dispute but if you do, any attempt to collect this debt without validating it, violates the FDCPA;
Also be advised that I am keeping very accurate records of all correspondence from you and your company including recording all phone calls and I will not hesitate to report violations of the law to my State Attorney General, the Federal Trade Commission and the Better Business Bureau.

I have disputed this debt; therefore, until validated you know your information concerning this debt is inaccurate. Thus, if you have already reported this debt to any credit-reporting agency (CRA) or Credit Bureau (CB) then, you must immediately inform them of my dispute with this debt. Reporting information that you know to be inaccurate or failing to report information correctly violates the Fair Credit Reporting Act § 1681s-2. Should you pursue a judgment without validating this debt, I will inform the judge and request the case be dismissed based on your failure to comply with the FDCPA.

Finally, if you do not own this debt, I demand that you immediately send a copy of this dispute letter to the original creditor so they are also aware of my dispute with this debt.

It's amazing what these "people" and I use the word loosely, can get away with. I just got 3 messages fro a Seth who mumbled the name of the company that I supposedly owe money too, and in a really threatening tone said i would be summoned. I wish we could turn the tables on creeps like this.

Beware!

Don't be afraid of these crooks.  They are a collection agency and just trying to scare you into paying.  They can not serve you with a summons.  I got a call from the same people and I know their tactics.
