All these tactics are illegal.  They are in violation of the FDCPA.  I easily found a lawyer that would take my case.  If you sue and win, National Capital Management is responsible for your attorney fees plus damages.  If you feel that you have been violated, then sue this company.

Thanks for all the info.  The new number is 866-931-5788.  They called me and left this very threatening message about a complaint and lawsuit and about my property.  I called back because I had no clue what this was about, but concerned if there was some complaint against me.  Turns out they were not even looking for me.  They think it is my daughter-in-law or son they are looking for and wanted me to give them contact info.  I asked what it was about, but they would not give me any other info, so I did not give them any info. I told him that I am no9t involved in any lawsuits and to stop calling me.  Then, James tried to make me feel guilty that I was not helping my son!!!!!

I happen to be one of those people who actually pay my debts.  But, if I did have an outstanding debt and it was bought by this company, I definitely would NOT pay it!!!  Let them eat it.  They are total scumbags and liars.  If they continue to call and harass me, then I WILL be involved in a lawsuit, because I will SUE THEM!

In addition.  When you call back the process server, it rings to National Captal Management.  When the answer their phone, it is always "Corporate Office".  They don't answer with the company name.  You have to ask.  When I asked for the mailing address, they had to put me on hold to look it up.

Anybody that comes to this site should file a complaint with the Federal Trade Commission and your State's Attorney General.  I have done both.  This company tried to con my wife into paying an old debt of mine.  They illegally pulled a credit report on her.  They lied to her about her being responsible because we live in a community property state.  However, we don't.  They told her she needed to pull out her credit card and settle this debt on the spot.  She new nothing about it.  It was not joint and she was not an authorized signer.  Since they pulled a credit report on her, they would know that.  When I called Torrey Stevens about this situation he said he was looking at Oklahoma.  Oklahoma is not a community property state either. They said they were going to serve her with papers for the debt and have her wages garnished.  When I explained it was not her debt, they didn't care and still demanded that she was responsible. I explained that I am now disabled and I may have to declare bankruptcy, Torrey Stevens response was that this debt could not be discharged in bankruptcy.  Total lie.   I was then turned over to Leo.  Leo couldn't come up with an explanation for why Torrey lied to me.  Torrey also said he had been doing this type of work for more than 30 years.  Shocking that he could make mistakes like that with all that experience.  After consulting with an attorney, she said it was a fear tactic.  No papers were served.  However, 2 months later National Capital Management called my wife again at work, threatening to serve her with papers.  I called them and they said they don't make outbound calls from their office.  However, I eventually got them to tell me the Process Server had called.  I spoke with James Howlett.  He is a real gem.  I explained that I had previously asked that my wife not be bothered at work.  His response was that he "didn't care what I want".  I explained that I am disabled.  He said, "I don't care".  He proceeded to chastise me and suggested that I was lying.  He made disparaging remarks about me and my wife.  Stated that I am "not a decent person".  Said he knows my "type".  My type is a person that is now disabled and collecting disabilty after being in 2 auto accidents that weren't my fault and being one step away from being paralyzed.  Living with constant chronic pain in which 5 surgical procedures couldn't relieve my symptons or condition.  I have a rebuilt completely fused neck that has permanently swollen nerve roots. My neck is supported by metal brackets and cages and has enough scar tissue to make a football player cringe.  Not to mention the arthritus affiliction as well.  I don't think he knows my type. I wake up in pain and go to sleep in pain.  He can judge me when the same has happened to him.  Knowing the conversation was going the wrong way, I was ending it and still said, "Have a good day".  His response was, "Coward" and he hung up.  He then immediately called my wife at work and left a voice messaging stating that he wanted to talk her and her boss about my debt.  This company has scam written all over it.  I spoke with Roxana at the Federal Trade Commission who said the tactics are illegal (even if they not the origial creditor and buy old debt to collect) and it sounds like a scam.  She advised writing a cease and desist letter and filing a complaint with the Attorney General of our state (I did both).  When I spoke with them on the phone, they told me they have had dealings with them before. While he wasn't able to go into details, their computer found the company instantly.  Also, I was never sent a letter to validate or dispute the debt by this company.  Neither was my wife.  This is also illegal.  The fact is the debt was purchased by this company and they use strong arm tactics to collect.  When I tole James Howlett that they were upsetting my wife, his response was, "Thank you for letting us know it's working".  They can get away with this crap, because people either give in or they don't file a complaint.  Please everyone out there, file a complaint with the Federal Trade Commission and your State Attorney General.  If enough complaints get filed with the FTC, then an investigation will follow.  The Attorney General will contact National Capital Management on your behalf.   This company should be shut down.

Just found out the address is a UPS store mailbox.  Guess that definitely speaks to a business that is not very legit.  And some of the phone numbers they have used with me are 951-547-5936 and 866-390-6364 and another number that just comes up as Blocked.  Can't wait until tomorrow when I call them and confront them with what I found out.

I am so glad I found this website!  I recently got a call from my dad saying a process server called looking for me for a past debt.  He gave me a number to call and I did.  First of all they did not answer the phone with a company name, just a personal name.  In this case a Sam ---. I was confused as he was explaining why they were calling because right off the bat they had the wrong address linked to my name.  Then I thought I had already taken care of this debt they were talking about over three years ago.  I got an email from them when I asked for proof of this debt.  It was just a letter w/34145 Pacific Coast Highway #346, Dana Point, CA  92629.  It comes up as a Settlement template.docm.  Just a lot of suspicious stuff.  But, they still had me wondering if I really did owe this.  So I have been trying to confirm who these people were by checking online, thru BBB, etc.  Not really finding anything that confirms they are a legitimate company.  Unfortunately, I had already given them my debit card number so now I have to find out how to block it so they cannot charge anything on it. Just withdrew all my money out of my account until I can get this straightened out.  Wish there were instructions on how to confirm a biz is legit.

She told him that wasn't her debt and he called her a sick old lady, and she had to change her medication. She wouldn't comply so he called her a dead beat and hung up the phone on her. Don't be worried. It's a scam. They buy up old debts, even ones that have been paid off, trying to get you to pay up. I kept them going long enough to know they're not legit. I called them on their BS lawsuit. They threatened me with a lawsuit back in August and here we are in October and I have yet to receive one legitimate letter in the mail. The only letter I received was a fax with intructions on where to send a payment. Upon investigating the address in turned out to be a private PO type box at a UPS store in Corona CA. If they dont give you a direct mailing address that is a clear sign they are full of sh**. Don't do anything except tell them you will not pay anything and if they want to pursue the lawsuit go right ahead. Trust me they will not do anything. I called their bluff and their so called associate Tim Washington became very agitated and began calling me a dead beat who doesnt pay his bills. Per the Fair Debt Collection Practices Act he violated a statute of name calling, he also refused to stop calling when I asked him not to. They are required through this act to not call you at home or at work if you ask them not to especially if they are a 3rd party debt collector which they clearly are. The most obvious part is if you google their name National Capital Management, they fail to exist in Corona where they say they're located. BOGUS!!! Don't pay them a dime, please!!!!

You can't block them because they'll just get a new number. Just ask them not to call you anymore per the Fair Debt Collection Practices Act http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre27.pdf
They have to comply per this Act which states any 3rd party debt collector cannot harass you if you ask them to stop calling you.

These people are crazy!  This complaint is for someone else and they keep calling me and threatening to serve me at work!  When I called to explain that they have the wrong contact information, the "lawyer" at the firm in california told me to shut up and get an attorney.  Are you kidding me?  Complete scam.  I filed a formal complaint with the Attny General today

I live in DC.  The company in National Capital Management. Tom Watson said he tried to serve me papers for a lawsuit and that after 3 attempts I would be in default.  He gave me a court docket number.

Said they were with the local county court about a debt that they have not been bale to serve papers on.

i got a call from the county processing department. They gave  me this same number, but I never called back. About a week later the process server arrived at my house with a sum-100 Summons to appear in court. I had no idea what this was so I googled it, and I came across something that says it is a lawsuit or something....probably some stupid credit card. So, finally I called the number that was given to me, and I was able to avoid the lawsuit that was on the papers delivered to my house. I just had to pay for the card that I bought my car stereo with. =)

The company is National Capital Management. Not sure but think they are a debt collection agency. I have gotten the same calls. They have even called several of my relatives trying to contact me so that they can process some kind of papers through a sheriff dept. I have blocked my # when I called them to see what it was about but all I get is a voicemail saying leave your name and number. All I can say to them is I will not leave them this information just so they can harrass me.
