They called my parents house last week an left a message on their answering machine ( I haven't lived there in 10 years), that was the first time anyone from that number has tried to contact me.  Now they stared calling my cell phone 3 or 4 times a day.  Today was the first time they left a message.  I am really getting fed up with these damn types of calls!!!!

Look up  -- Fair Debt Collection Practices Act

It will tell you how to stop them

Send a Cease and Desist  letter telling them your aware of your rights under the law--reference in your letter
about the FDCPA. Demand they stop calling you or anyone about you.
Send it u.s. post office certified mail with return receipt
keep a copy of your letter you send
Also, your social security check can not be taken if they do sue you. dont let them scare you.
It is exempt. If they do sue you make sure you tell their lawyer and the judge in court that your social security check is exempt under federal law. If they sue you, make sure you send your bank a letter
telling them to note your account that it's social security and exempt from lawsuit judgements. Send that letter certified mail with return receipt. also tell your bank branch in person if your sued , that under federal law your s.s. is exempt from judgements.
change your phone number as well. careful what businesses you give it to as collectors call them trying to get it

Never pay a voice on the telephone that calls you out of the blue.

1. How old is the ALLEGED debt ? Check the statute of limitations for you state on debt. You said it was
concerning capitol one so I assume it's a credit card. Check your states statute of limitations on credit
card debt. Is the ALLEGED debt beyond the statute of limitations ? If so, do not acknowledge the debt
is yours. Admit to NOTHING. DO NOT AGREE TO OR say you will pay it or anything on it.
Could possible reset the statute limitations if it has ran out.
2. Demand they send you validation of the debt. Copies of the statements, original contract you signed,
etc. Do not accept a simple printout saying an amount and your name. That's not validation.
   Lot collectors will try that.
3. Demand a copy of their assignment of debt they received from Capitol One. That's like a title to the debt.
It will show if Capitol One has authorized them to colect the ALLEGED debt from you. You just don't pay
someone who calls up and demands you give them money. If you do, I want your phone number LOL
4. If you want them to stop calling you, send them a CEASE AND DESIST LETTER , demanding they stop
calling you at home, work, your neighbors, relatives, or anyone else. Send that U S Postage Certified
Mail with Return Receipt Requested. Keep copies of everything. Keep forever.

5. If the debt is past the statute of limitations in your state for credit cards[assuming it's a credit card]
They can't legally sue you for it in court. They can still try other ways but nothing legally in court.
Lot of collection agencies still try to sue people for ALLEGED debt that is past the statute of limitations.
If they do, make sure you dont ignore the summons, Show up in court, make sure you goto court!
Best to get a lawyer since the amount is so large. So you make no mistakes in court.
I think in some states they have a certain amount of time just after the statute of limitations is past
to sue in some cases. So best to get a lawyer if they sue past the statute of limitations.

Personally when I send a cease and desist letter I send it to the person or company that accepts court summons for the collection agency as if they were being sued. It is called the REGISTERED AGENT
for corporations. Call your state Secretary of State for your state. Tell them you want to sue such and such cor[oration and give them the name and address of that corporation. They will give you the name and address of the registered agent. Send cease and desist letter to them certified mail, return receipt.
I send one to the registered agent as well as the main address of the collection agency itself.
Lot of collection agencies refuse delivery of certified letters because they know it's likely a cease and desist letter. I put on the envelope ATTENTION--- ACCOUNTS RECEIVABLE

I send letter to both. Keep all copies and receipts from USPS
The registered agent is a back up and secondary but I like to be thorough.
Does the trick for me

P.S.  The warning statement in my posting above in quotes is what is required on all letters from a collection agency.

They did'nt want some small amount of money.
THEY WANTED YOUR BANK ACCOUNT INFORMATION SO THEY COULD EMPTY YOUR ACCOUNT.
I have found all over the internet where these people have robbed victims bank accounts.

This Firstsource is also mixed up with hospitals. They send you letters wanting you to sign a power of attorney to , now get this-->> to help you ....
They claim to want to help you get a monthly cheak from the government, a medical card, etc.

It's a scam to get peoples personal information under the disguise to helping people.
They also wanted me to sign a paper saying they could access my medical records, get copies of , etc.
The paper said they could re-release my personal medical records to anyone they want.
It also said my records would no longer be protected by law.

Needless to say, I did not sign anything.
Upon doing some investigating I find they are sending the so called help letters collecting peoples info that owe the hospital. They are a collection agency in disguise. I am in the process of reporting them to the state dept. of Commerce and Insurance who regulates collection agencies.
The letters they send in the scam do not have the required state or federal collection agency
miranda warning alerting the recipient that their a collection agency.

" THIS COMMUNICATION IS FROM A COLLECTION AGENCY AND ANY INFORMATION OBTAINED
WILL BE USED FOR THAT PURPOSE"

For multiple days in a row, we have received calls from this number,by a person identifying herself as Jennifer from 1st Source Advantage. She leaves the number with a file# and says that we may not be aware of what is happening but this file has been left on her desk and we should call her right away.

I did receive a message at work from 888-850-7675 in regards to an account from capital one. I tried calling back the very next day and the number said it was disconnected. So I did call capital one and they some how put me through to this First Source Advantage. I did try to make a deal on paying for this very small dept. They would not take it. They said since I did not have a checking account and could not  make pre dated checks that I would not be able to resolve this account. Is this legal I did offer to Western Union them money. My account was last paid in April. It seems a little unfair to me that they can just tell me that they will handle it over to their attorney because I did offer to pay on it.. Can this really be legal..

First Source Advantage called me several times and even called my brother's house...wow? how did they find him and connect him to me?

Anyways, my biggest concern is that they are claiming that Capital One is considering suing me for our business card account (about $5,000).

My issue is, if it is merely a scare tactic for me to pay them?? I need to call Capital One to find out if the account was sold to them or they hired them to collect from me.

They were very aggressive and claimed that is is "easy" for me to take care of this right away and that I don't need them to send me a letter they supposedly mailed to my home address.  When I told them I never got it and to please send again, they got all wierd and said it's not too important and, again, reminded me to take care of this debt right away.

This totally sucks.

I've had four messages for a name that doesn't live here.  (Guess they don't believe my voice mail message).  They're closed when I'm at home, so can't get through to them.

Don't know if they are the "private caller" or the "out of area" text (since the number is not displayed), or both.

I'll pay more attention to the message next time and will enter better details.

Didn't say why so important to call, but presumably a debt - that's what it was last time something like this happened.  Last time they only had my last name and when I finally admitted that it was my name (they wouldn't identify themselves unless I did) it turned out there was a different first name, so they left me alone.

Just got off the phone after chatting with a guy named Frank. I was told it was in reguards to a credit card debt my husband owed. My husband doesn't believe in owning a card! He is a cash only guy. When I tried to explain there were four other men in our town with my husbands first and last name, Frank became irked. He told me to have my husband call him when he returned home and gave me a long string of numbers in reguards to that debt. I tried to ask politely ask him to hang on until I reached my computer so I could jot the number into notepad. He seemed short tempered again asking why did I need my computer, wasnt a pencil or paper handy. I explained that I could not hold a pencil, I am quadriplegic. He calmed himself and let me get to my computer. After insuring I had the correct referance number he just hung up on me. I googled the number and comany name only to find horror stories about the collection group. With as unstable as things are in the states right now, it scares me to have a collection service phoning over a debt we don't owe. One hears every night on the news about people loosing their homes over debts. I can't wait until my husband returns home and sorts this mess. I just know from now on unless I know the number, I'm not picking up.

A Mike from first source called.  Rude to my g/f daughter, rude to my g/f who both live with me.  My girlfried called to find out who they were, told them she had the wrong number, but obviously they have caller I.D. and knew my g/f was lying about having a wrong number. She told them they I already dealt with this company, recieved a letter stating I own nothing to them.  I don't owe them anything because It has been over 11 yrs. This is regarding a Verizon Phone and when I moved 11 yrs ago, I still had verizon and explained to them that how can I get my phone turned on at my new house if I OWED THEM.  I called verizon and they referred me to accounting, however, I did not call them and with in a week I recieved a letter from First source (ASG) again stated I don't owe a thing.  RUDE RUDE RUDE.

That is 4 calls in 5 minutes!!
