Obama has now twice campaigned for Penn. Ave. on the prospects of relief from unfair burdens on anyone who is not already a millionaire. It would be absurd for him to sign in a new law -- one seeing absolutely no publicity as a House or Senate bill, by the way -- which would effectively make a criminal class of perhaps 95 percent of Americans in debt and alleged to be in debt.

Just to be clear on something which should be disclosed in 32 point type on every lender's contract, consumer debt in the USA is NOT A CRIMINAL OFFENSE. It is strictly a civil matter. You didn't have to wait for that answer from a BK attorney or anyone else. It's right there in the federal rules!

she works for crs a collection agency. she called me and threatened me with jail time if i didnt pay. she used a made up "bill" that was signed by oboma that allowed creditors (chase, wells fargo) charge a felony with any unpaid loan over $500. she claimed to me a mediator for a law firm of for my county. the scare tactic worked and i gave her all my information and was going to willing pay the amount by the end of the week. after talking to a close friend, then a bankruptcy attorney i called back asking for the name of the bill that oboma signed allowing creditors this power. her answer was "why do you want to know that", when i said just because she responded "well everyone has a reason so tell me why". when i again answsered because i want to know, she told me that the lawyers were out at lunch so i would have to call back.  when i called back she told me the bill was called FEDERAL LEVEE PAYMENT (or something around those lines i know when i looked it up it was NOT the "fake" bill she orignally discribed to me) because it does not exist. she is a collection agent trying to trick you into paying her by threatening you with jail time.

The Federal Trade Commission (FTC), the nation's consumer protection agency, is warning consumers to be on the alert for scam artists posing as debt collectors. It may be hard to tell the difference between a legitimate debt collector and a fake one. Sometimes a fake collector may even have some of your personal information, like a bank account number. A caller may be a fake debt collector if he:

is seeking payment on a debt for a loan you do not recognize;
refuses to give you a mailing address or phone number;
asks you for personal financial or sensitive information; or
exerts high pressure to try to scare you into paying, such as threatening to have you arrested or to report you to a law enforcement agency.

If you think that a caller may be a fake debt collector:
Ask the caller for his name, company, street address, and telephone number. Tell the caller that you refuse to discuss any debt until you get a written "validation notice." The notice must include the amount of the debt, the name of the creditor you owe, and your rights under the federal Fair Debt Collection Practices Act.
If a caller refuses to give you all of this information, do not pay! Paying a fake debt collector will not always make them go away. They may make up another debt to try to get more money from you.

Stop speaking with the caller. If you have the caller's address, send a letter demanding that the caller stop contacting you, and keep a copy for your files. By law, real debt collectors must stop calling you if you ask them to in writing.

Do not give the caller personal financial or other sensitive information. Never give out or confirm personal financial or other sensitive information like your bank account, credit card, or Social Security number unless you know whom you're dealing with. Scam artists, like fake debt collectors, can use your information to commit identity theft ? charging your existing credit cards, opening new credit card, checking, or savings accounts, writing fraudulent checks, or taking out loans in your name.

Contact your creditor. If the debt is legitimate ? but you think the collector may not be ? contact your creditor about the calls. Share the information you have about the suspicious calls and find out who, if anyone, the creditor has authorized to collect the debt.

Report the call. Contact the FTC and your state Attorney General's office with information about suspicious callers. Many states have their own debt collection laws in addition to the federal FDCPA. Your Attorney General's office can help you determine your rights under your state's law.>

Angela Daniels called me yesterday trying to settle  out of court on a debt that my ex-husband filed bankruptcy on 6 years ago. She threatened to have the Sherriff come pick me and put me in jail if I did not agree to pay 4000 dollars within 24 hours. I recently won a disability case after 2 yrs. I have survived only by the grace of God and the kindness and love of many. This woman and others like her need to be tracked down and intimidated with the truth. Angela I hope you get all that you deserve! God does not like ugly, and what you are doing is ugly, remember that!!!!!!!

This Angela Daniels called my friend and threatened to garnish her Social Security Disability and leave her only $120.00 a month to live on.  She further stated the only way for her not to garnish it is to send her $3,100 by the 12th of this month.  She even threatened that that amount would go up with additional fees and court costs when she files for a "Federal Levy" on her and put a RIT out for her arrest.  So my friend agreed to it and provided her bank account numbers.  My friend came to me in tears and told me what happened.

So that the rest of you are aware in the future, this woman violates the Fair Debt Collection Practice Act (FDCPA).  No one can garnish Social Security benefits except for the Federal Government to retrieve money due to the IRS.  The IRS is the ONLY ones that can initiate a "Federal Levy".  Needless to say, I called this Angela Daniels and told her that the agreement she made with my friend was illegal due to misrepresentation, scare tactics and violations to the FDCPA codes 15 USC 1692e & 15 USC 1692f and that she will be reported to the Federal Trade Commission, our state Attorney General, Better Business Bureau and could face a civil suit all for the FDCPA violations.  I also told her that she will be report to the Social Security office for federal charges.

Of course she hung up on me .... LOL.  Knowledge is POWER!!  I hate when people pick on others who are vulnerable.  I told my friend to go to the bank now and close that account out!

Know the Fair Debt Collection Practices Act & how to report violations

These people are terrible...  they called my mother who believed everything they said and gave them her credit card number over the phone thinking she was paying off an old credit card debt of mine.  Thank goodness someone caught it at her bank.  They stopped the transaction, cancelled that card and have issued a new one today.  As much as I hate big banks... good job B of A!

Now it's my turn.  Since they knew where I worked my mom thought they should have the correct number to reach me here.  5 calls in 20 minutes each time asking for me but refusing to say who they were or where they were calling from.  Each time I asked them not to contact me at this number and by doing so I was at risk of termination.   Not true but sounds good.  Next time they call, my boss has said he'd like a word with them.  And they will wish they hadn't gone there with him if they do call me again!  ha

Lesson to be learned...  might want to let parents know such scammers are out praying upon good intending parents trying to help out their kids.  Their banks might not be as quick.

Yes, I got the same call as you today, prior to that they were telling me I only had 24 hrs.
Now weeks later they tell me I have 48 hrs and I could expect all the same BS that you mentioned in your letter about your sister.
I have nothing outstanding..everything was closed out years ago.
They will call people who are acquaintances and bug them also...they tell lies stating they were put down as references etc.
I have also read where there is a lawsuit against this company.
The call comes in unavailable number....also they want you to verify the last 4 digits of your SS#..Why would I do this...I have NO proof of who they are...and what are they doing with this info to begin with.  They can say they are from such and such company...but that does not make it true or legit.   Thanks for posting as this really does help to identify people trying to fraud you.

My sister was called and threatened by Angela Daniels at 1-888-671-5378 saying that she works at a lawyers office and is trying to help my sister before they put a lien on her house, serve her for fraud, garnish her wages at 35%, and have the sheriff come to her house. The problem was taken care of in 2007 (paid off) and closed. I checked the county records myself online, because her name means nothing to me. Always check for yourself and do not believe what the person on the other end of the phone is saying. She also has my sister's social security number which is not listed on the county records. Now I guess that it is time for us to file a complaint against her having personal documents. She really just works for a collection agency and will get to keep most of the money that she collects. This website helped us to identify her scam.

Its fraud...she says she is an investigator, yet an investigator wouldn't offer to drop the price of anything from the original down to you only paying 10%, which is what she tried to do to me. I simply called back and let them know I wouldn't be bullied, not to mention the "urgent information" they had was all wrong except for the name. Then she expected me to tell her the make and model of the vehicle that we do have as if I am an idiot!!! SPAM!

Angela Daniels stated she was an investigator requested me to call her regarding a case # before 10am the next morning prior to her sending in her report on a case # that was filed in my district.  I had received numerous calls from this same number for months from someone who left messages stating it was urgent that I call them back referencing the same account number.
